Digitek Class Action Lawsuits filed

Two weeks after a nationwide Digitek recall, several class action lawsuits have already been filed on behalf of users who took the heart drug. Manufacturing problems resulted in some tablets being sold with twice as much of the active medication as they were supposed to have. While Digitek class action suits are seeking reimbursement for the cost of the prescription medication and funding for medical monitoring, those who have suffered severe injuries or death after taking Digitek, should consider pursuing an individual lawsuit.

The lawyers at Saiontz, Kirk & Miles, P.A. are reviewing Digitek lawsuits on behalf of individuals who have suffered severe reactions to the double strength digoxin tablets, known as digitalis toxicity. As a result of the increased exposure to the medication, some patients could accumulate too much digitalis in their body, leading to nausea, low blood pressure, decreased heart beat or death.

Digitek class actions suits have been filed against Actavis Group, their subsidiary, Actavis Totowa, LLC., and their distributors Mylan Pharmaceuticals, Inc. and UDL Laboratories, Inc. The plaintiffs are seeking to represent all individuals who purchased or used Digitek (generic digoxin). The lawsuits allege that the defendants knew or should have known that the Digitek was defective, potentially increasing the risk of digitalis toxicity, and that they failed to take steps to protect the public.

The lawsuits seek to establish state and national classes to obtain refunds for those who purchased Digitek, compensation for those who suffered side effects of Digitek and a medical monitoring class to provide screening, medical services, research and other steps to ensure that prompt treatment is provided to reduce the risk of life-threatening injuries.

DIGITEK LAWSUITS

For individuals who have taken Digitek and suffered severe physical injuries consistent with digitalis toxicity, they should consult with an attorney to review the potential for an individual Digitek lawsuit, as opposed to participating in a class action suit.

The Digitek lawyers at Saiontz, Kirk & Miles, P.A. are reviewing individual claims for individuals diagnosed with digitalis toxicity, those who suffered problems requiring medical treatment for low blood pressure, cardiac instability, bradycardia, or those who suffered fatal injuries. While I did not suffer serious side effects from Digitek, I did suffer from my blood pressure being low and I was very legargic, not able to work after my heart surgery and being on Digitek. If this has been going on so long and no one said anything to patients I feel that we should be compensated for any future problems because of this drug. I was prescribed Digitek in Feb 2008 and it was already known that there was an unsafe dose in the tablets. Someone has to be held accountable. Who knows what may happen in the future as a result of this? I would like to know what recourse I have other than a refund of a prescription?? That to me seems like the company is being slapped on the hand and that’s it.

My mother died June 7, 2008 after having been on Digitek since January. Neither her cardiologist nor the pharmacy where she had gotten her prescriptions filled for 30 years bothered to call her regarding the recall. She had all the symptoms associated with Digitek prior her death.
I believe not only the pharmacuticalbut also her cardiologist and pharmacist should be held responsible! Mom did not have to die!!

Digitek was one of the first meds prescribed for my Mother over 10yrs ago, she as like marys daughter had never been told she was toxic until Jan 08. ( Was there a reason the Dr. knew we didn’t to test her?) Now after the fact It all makes perfect sense, Mom had been going down since early fall of 07 and passed on Easter. All the signs were there if my brother and I had only knew..We were asked to let her go without the proper knowledge…And may I add she never knew the truth she thought she was getting better and continued fighting..My brother and I had different opinions regarding making the desision to let her go.. I personally will never forgive the individuals involved in making us make such a terrible choice, I pray no one else has to go through such pain over negligence of others..

[...] an MDL has many traits similar to a digoxin class action lawsuit, the cases do remain individual claims and there is no class representative representing all [...]

My mother took digoxin for years but was switched by the mail order pharmacy to Digitek because it was cheaper. Shortly after taking Digitek, she began going downhill. (shortly before taking Digitek she had a normal EKG while on digoxin).
I called her cardiologist and demanded they do something about her meds (I didn’t now about the Digitek recall then and found about it by accident on the internet - nobody ever told us about the recall). The cardiologist immediately took her off Digitek (and digoxin). Within a year, she had to have heart ablation. A few weeks after that on 9/4/2008 she had a massive stroke. She died on 9/11/2008. I knew and it didn’t help! I pray for all of you who lost loved ones like I did. It is devastating!!

My father suffered very severe complications because of this drug. He went into cardiac arrest twice and has to be brought back to life twice in Sept and Oct of 2007. After the October incident, they figured out and diagnosed him with digoxin toxicity. He also went into kidney failure twice and the doctor asked my mother twice if she would pull the plug. He was unconcous for almost a week. He is still struggling with his health today. He actually retired a few years back because he was too weak to work which the doctor now believes was related to digitek. He was NOT informed by the pharmacy that this medication was recalled. I believe that somebody needs to be held accountable for what happened to my father and I will not rest until justice is served.
