Mentor ObTape Bladder Sling Lawsuit Consolidation Ordered by MDL Panel
According to an Order issued December 3, 2008, by the United States Judicial Panel on Multidistrict Litigation, every federal Mentor ObTape bladder sling lawsuit will be transferred to the U.S. District Court for the District of Georgia, where they will be consolidated for pretrial proceedings before Judge Clay D. Land.

Over 35,000 women worldwide received the Mentor ObTape transvaginal sling while it was on the market between 2003 and 2006. As a result of a defective “nonwoven” design, a number of women have experienced bladder lift problems caused by the ObTape sling, such as infections, erosion and other painful complications.
Consolidation of individual product liability lawsuits in an MDL, or Multidistrict Litigation, allows the parties and the Court to conserve resources and helps avoid inconsistent rulings by different judges in different states. It also allows plaintiffs to pool their resources and expenses by avoiding duplicative discovery.
An MDL has many traits that would be similar to how a Mentor ObTape class action lawsuit would be handled, but each case does remain a separate claim. The consolidation only applies to pretrial proceedings, and if the cases do not settle or otherwise resolve, they will be transferred back to the original jurisdiction where they are filed for trial.
There are currently only 22 Mentor ObTape Bladder Sling lawsuits that have been filed in federal court, but many more potential cases are still being investigated and reviewed throughout the United States for women who have experienced problems like:
