First Seroquel Trial Ends in Defense Verdict
Following a month-long trial, the first Seroquel case to reach a jury ended in a defense verdict last week. While the Seroquel lawyers at Saiontz & Kirk, P.A. were closely watching this case and hoping that the New Jersey state court jury would hit AstraZeneca with a large verdict as a result of their failure to warn about the risk of diabetes from Seroquel, this loss does not spell doom for the Seroquel litigation and these cases are far from over.
There are an estimated 26,000 Seroquel lawsuits pending in federal and state courts throughout the United States. No one involved in these cases expected the plaintiffs to win every single lawsuit that goes to trial, and the evidence is overwhelming that AstraZeneca knew about the risk of weight gain and diabetes from side effects of Seroquel.
The New Jersey state court Seroquel trial involved a case filed by Ted Baker, who alleged that he developed diabetes after taking Seroquel for three years for post-trauatic stress disorder. Based on the evidence presented in this case, the jury found that AstraZeneca’s was not responsible for Baker’s diabetes.
In each of the cases that reaches trial, a jury will weigh the individual evidence surrounding that claim and determine whether AstraZeneca’s warnings were adequate and whether any failure to warn was the cause of that plaintiff’s diabetes or other injury.
We remain confident that plaintiffs will win many of these cases and that individuals diagnosed with diabetes and other Seroquel injuries will be compensated for the drug maker’s decisions to place their desire for profits ahead of patient safety.
