A Rhode Island zeppoles pastry recall was issued this week by the Rhode Island Department of Health after a number of people have suffered food poisoning illness after eating pastries that may be contaminated with salmonella. The pastry shells used in the zeppoles, which were made at DeFusco’s Bakery in Johnston, Rhode Island, were stored in egg crates and they may have come in contact with raw eggs.

The pastry shells were used in zeppoles sold at DeFusco’s Bakery locations in Rhode Island as well as at other area bakeries, such as Crugnale Bakery, Colvitto’s Bistro, Sal’s Bakery and Focaccia World. The contaminated zeppoles may have also been sold to a distributor, where they may have been sold to Roch’s Market in West Warwick, Meal Works in Coventry and Touch of Class Catering in West Warwick.

A bologna recall has been issued in Maryland, Pennsylvania, New York, California and Colorado after an E. coli food poisoning outbreak has been linked to approximately 23,000 pounds of the meat distributed in those states. The lawyers at Saiontz & Kirk, P.A. are reviewing potential bologna food poisoning lawsuits for individuals who have been diagnosed with E. Coli after eating Seltzer’s Beef Labanon Bologna.

>>REVIEW A CLAIM FOR FOOD POISONING FROM RECALLED BOLOGNA<<

The U.S Food Safety and Inspection Service (FSIS) announced a Seltzer Beef Lebanon Bologna E. coli recall on March 22, impacting bologna manufactured by Palmyra Bologna Company, Inc.

The contaminated bologna may be linked to at least four cases of E. coli O157:H7 food poisoning identified by the U.S. Centers for Disease Control and Prevention (CDC). The bologna food poisoning cases were reported in New Jersey, North Carolina and Pennyslvania between January 28 and February 12, 2011.

E. coli O157:H7 food poisoning can cause dehydration and can be potentially life-threatening if left untreated. Most healthy adults recover from E. coli food poisoning within a few weeks, but young children and the elderly could be at risk for more severe illness. In some cases, E. coli poisoning may lead to a form of kidney failure known as Hemolytic-Urenia Syndrome (HUS).

The bologna was distributed in California, Colorado, Maryland, New York and Pennsylvania and was produced in December. Consumers should be on the lookout for 6, 12 and 16-ounce packages of Seltzer’s Beef Lebanon Bologna with lot code 01351 and a best-by date of April 22, 2011. Retailers have been told to look for whole chub packages with lot codes 01351 or 06337 and best-by dates of Feb. 14, 2011, Feb. 15, 2011, Feb. 16, 2011 or Feb. 28, 2011; half chub packages with lot codes 01351 or 06337 and best-by dates of Apr. 6, 2011, Apr. 7, 2011, Apr. 16, 2011 or Apr. 19, 2011; and 12-pound bulk boxes with lot code 013151 and a best by date of Apr. 21, 2011. Each of the packages will have an establishment number of 474 in the USDA mark of inspection.

>>REVIEW A POTENTIAL APPLE CIDER FOOD POISONING LAWSUIT<<

At least seven people have fallen ill and three people have been hospitalized due to an infection by a strain of E. coli O157:H7 which Maryland health investigators have tracked back to unpasteurized apple cider sold by Baugher’s Orchard & Farm in Westminster, Maryland. At least one of those cases has resulted in a form of kidney failure known as Hemolytic-Urenia Syndrome (HUS).

On November 4, the FDA, Maryland Department of Health and Mental Hygiene (DHMH) and Baugher Enterprise issued a Baugher Apple Cider recall. The cider was distributed in Maryland and Pennsylvania in half-gallon and gallon containers.

Officials are warning consumers who have purchased the unpasteurized apple cider not to drink it, and to discard it in a way that it can not be consumed by people or animals. However, if you, a friend or family member have suffered an illness as a result of the bad apple cider, the contents and packaging should be preserved in a manner that will ensure it is no longer consumed until it can be determined whether you may be entitled to compensation through a potential apple cider lawsuit.

Maryland health investigators are examining the Baugher production facility in order to track down the source of the contamination.

E. coli symptoms commonly include abdominal cramps and diarrhea, which may become bloody. While most healthy adults recover within a few weeks, more severe cases may result in hospitalization and a potential risk of kidney failure from hemolytic-urenia syndrome (HUS). Children, the elderly and those with a weak immune system may have an increased risk.

>>FDA LINK (5/6/2010): Shredded Romaine Lettuce Recall

On May 7, a recall of shredded romaine lettuce was issued by Freshway Foods after E. Coli O145 was found in some of their unopened products. Confirmed illnesses have been reported in at least three states, and the contaminated lettuce was distributed to food service outlets, wholesalers, delis and grocery stores in Alabama, Connecticut, District of Columbia, Florida, Georgia, Illinois, Indiana, Kansas, Kentucky, Maryland, Massachusetts, Michigan, Missouri, New Jersey, New York, North Carolina, Ohio, Pennsylvania, Rhode Island, South Carolina, Tennessee, Virginia, West Virginia, and Wisconsin.

Although the shredded romaine lettuce could have been used in a variety of food service locations, the manufacturer has specifically warned customers not to eat any “grab and go” salads sold at in-store salad bars or delis inside of of the following stores:

Kroger

Giant Eagle

Ingles Markets

Marsh Stores

The recalled romaine lettuce has been linked to an outbreak of food poisoning involving E. coli that has resulted in 19 confirmed illnesses, including 12 severe cases that required hospitalization. Three of the cases of E. coli poisoning have resulted in hemolytic uremic syndrome (HUS) after eating the romaine lettuce, which is a serious and potentially life-threatening condition that can result in blocked circulation or bleeding in the brain or kidneys.

Symptoms of shredded romain lettuce E. coli food poisoning could include severe abdominal cramps and diarrhea. While most healthy adults are able to fully recover within a few weeks, children, the elderly and those with a weakened immune system may be more susceptible to severe injury or even death.

A nationwide cookie dough recall was issued on June 19, 2009 after people throughout the United States have reported suffering from food poisoning.

>>FDA LINK: Nestle Toll House Cookie Dough Recall

As of Friday, the FDA and CDC reported that 65 people in 29 different states have reportedly suffered E. Coli food poisoning after eating raw cookie dough manufactured by Nestle under their Toll House brand. However, this likely only represents between 1% and 10% of the true number of food poisoning cases that may have been caused by the cookie dough.

Symptoms of cookie dough food poisoning could include diarrhea and abdominal cramps. The diarrhea usually starts watery and become bloody within 24 hours. While most healthy adults recover fully within a week or so, in severe cases it could result in dehydration or more serious health problems, including a condition known as hemolytic uremia syndrome (HUS), which is associated with kidney failure.

Children, elderly and those with a weak immune system have an increased risk of HUS or more severe food poisoning.

Although the recalled cookie dough products contain information on the packaging that they are not meant to be consumed raw, it is very common for consumers to eat the product uncooked and the warnings are not adequately displayed on the label.

Federal health officials have recommended that people immediately stop eating any Nestle Toll House Cookie Dough products. People should not try cooking the raw cookie dough, as the E. coli bacteria could get on their hands and still infect them. However, non-raw, refrigerated dough products are not impacted by the recall, such as Nestle Toll House cookies or chocolate chips.

COOKIE DOUGH FOOD POISONING LAWYERS

Although Nestle has asked consumers to return any unused packages to their grocer for a full refund, if any illness was experienced after eating the cookie dough, it should be preserved for future testing if you intend to review a potential Nestle Toll House cookie dough recall lawsuit. Any unopened or uneaten portion of remaining packages should be stored in a manner to prevent anyone else from eating them.

The salmonella food poisoning lawyers at Saiontz & Kirk, P.A. are investigating potential lawsuits for individuals who were sickened by contaminated products that were part of a recent pistachio recall. Millions of pounds of pistachio nuts have been recalled due to concerns that they may be contaminated, and these nuts were used in a number of different products that could cause severe and potentially life-threatening food poisoning.

The pistachio recall was issued on March 31, 2009, for all nuts processed at a plant in California. The inshell and shelled pistachios were distributed to a number of different manufacturers who sold them to the public as individual packages of pistachios and in a number of other products, such as ice cream, trail mix, cakes and mixed nuts.

The pistachios may be contaminated with salmonella bactereia, which could cause symptoms of food poisoning, like abdominal cramps, nausea, vomiting, bloody diarrhea and fever. For young children, older adults and those with weak immune systems, consuming the tainted pistachios could cause more serious food poisoning, potentially resulting in hospitalization or death.

According to the FDA pistachio recall website, there are currently 77 different products that may contain the contaminated nuts, including:

According to the FDA, Peanut Corporation of America, the food manufacturer which sold contaminated peanut butter, peanut paste and chopped peanuts used in over 1,500 products sold by more than 100 different companies, was aware that the ingredients they were providing to other manufacturers and distributors could cause salmonella poisoning before they ever shipped them.

Investigations have uncovered that on at least 12 different occasions between 2007 and 2008, Peanut Corporation of America detected Salmonella during their own testing.

Although a prior report suggested that Peanut Corp. obtained additional testing which came back negative before shipping their products, the FDA indicated last week that a review of the company’s records suggests that the shipments went out before the new test results were ever known.

The peanut salmonella poisoning lawyers at Saiontz & Kirk, P.A. are investigating potential lawsuits on behalf of individuals who have suffered severe illness after eating any foods that contained peanut butter or chopped peanuts.

While it is unconscionable that Peanut Corporation of America would knowingly expose millions of people to a risk of food poisoning or death, the culpability for this salmonella outbreak does not end there. The manufacturers which used the peanut ingredients in their crackers, cookies, ice cream, nutrition bars and other products may also bear responsibility for failing to ensure that their food was safe.

PEANUT SALMONELL LAWYERS

Our food poisoning lawyers are reviewing potential cases on behalf of people throughout the United States to determine if compensation may be available. To pursue a case, it is necessary that a salmonella poisoning diagnosis be confirmed through medical records or that there to be medical treatment for symptoms of salmonella poisoning with sufficient evidence to establish proof of the product consumed.

If you, a friend or family member have experienced salmonella problems, request a free consultation and claim evaluation.

The salmonella attorneys at Saiontz & Kirk, P.A. are reviewing peanut butter lawsuits on behalf of individuals diagnosed with Salmonella typhimurium food poisoning after eating any products with peanut butter. Although initial indications suggested that contaminated peanut butter was served at nursing homes, hospitals, schools and other food service institutions, recent reports confirm that the bacteria may have also contaminated peanut butter crackers, peanut butter cookies, ice cream with peanut butter and other products sold direct to consumers.

>>INFORMATION: List of Peanut Butter Recalls

The first cases of food poisoning linked to this recall surfaced in September 2008, with the most cases developing between October 2008 and December 2008. Thousands of large containers of peanut butter produced at a plant in Georgia have been recalled, as well as a variety of snacks, candy and ice cream made with peanut paste produced at the same location.

Over the weekend, Peanut Corporation of America, which owns and operates the peanut butter processing plant in Georgia, expanded their peanut butter recall to include peanut paste sold to a variety of manufacturers of consumer products that contain peanut butter.

As a result, a number of different products have been recalled which received the peanut butter ingredients from Peanut Corporation of America, including (as of 1/19/2009):

Austin Peanut Butter Crackers

Keebler Peanut Butter Crackers

Famous Amos Peanut butter Cookies

Keebler Peanut Butter Cookies

Mnoster Cookies

Peanut Butter Reese’s Pieces Cookies

Peanut Butter Chocolate Chip Cookies

Lunchbox Peanut Butter Cookies

People Chow Party Mix

Perry’s Peanut Butter Ice Cream and Frozen Yogurt

Shurfine Peanut Butter Cup Ice Cream

Wegmans Peanut Butter Ice Cream

Little Debbie Peanut Butter Crackers

South Bend Chocolate and Fudge with Peanut Butter

Food Lion Peanut Butter Cookies

Lofthouse Peanut Butter Cookies

Chuck’s Chunky Peanut Butter Cookies

Pastries Plus Gourmet Cookies

Wal-Mart Peanut Butter Cookies

Meijer Peanut Butter Crackers

Meijer Peanut Butter Cup Ice Cream

Kroger Peanut Butter Ice Cream

ZonePerfect Chocolate Peanut Butter Bars

ZonePerfect Peanut Toffee Bars

NutriPals Peanut Butter Chocolate Nutrition Bars

As a result of the growing number of peanut butter recalls being issued, and the difficulty determining where different manufacturers received their peanut paste ingredients, the FDA has urged consumers to avoid all products containing peanut butter. However, at this time, there is no indication that any peanut butter jars sold directly to consumers were manufactured at the Peanut Corporation of America plant in Georgia.

Individuals who have suffered from salmonella food poisoning after eating anything with peanut butter at a hospital, nursing home, school or other location with food service, could be entitled to financial compensation through a lawsuit against the manufacturers and distributors of recalled peanut butter contaminated with Salmonella typhimurium.

A nationwide salmonella food poisoning outbreak began to surface in September 2008, with the most recent reports indicating that at least 434 people in 43 states have been sickened. However, the true number of people who have suffered from this strain of food poisoning is likely in the range of 5,000 to 50,000, since reported cases usually only involve about 1% to 10% of all adverse events.

The food poisoning outbreak appears to be linked to large 5 to 50 pound tubs of peanut butter served at schools, nursing homes, hospitals and other locations. The peanut butter was manufactured by Peanut Corporation of America at a processing plant in Georgia, and was distributed by King Nut Companies under the King Nut peanut butter and Parnell’s Pride brand names.

None of the recalled peanut butter has been sold directly to consumers at retail stores, but hundreds of thousands of people could have been exposed to the bacteria while eating any products containing peanut butter at nursing homes, hospitals, schools or cafeterias.

The peanut butter recall is particularly troubling, since young children who may eat the peanut butter at schools, elderly who may eat the peanut butter at nursing homes and those with weak immune systems who may eat the peanut butter at hospitals, are particularly susceptible to salmonella food poisoning, and could suffer more severe forms of the illness, potentially requiring hospitalization or resulting in death.

The food poisoning attorneys at Saiontz & Kirk, P.A. are reviewing and investigating potential peanut butter recall lawsuits on behalf of individuals diagnosed with salmonella food poisoning after consuming any peanut butter products since September 2008. Over 400 people throughout the United States have been sickened by a recent salmonella outbreak, and recent reports suggest that a possible cause may be large tubs of peanut butter sent to hospitals, nursing homes, schools and other food service providers.

>>REVIEW A CASE WITH OUR PEANUT BUTTER RECALL LAWYERS<<

On January 10, 2008, a King Nut Peanut Butter recall was issued for about 1,000 large tubs of peanut butter that may be contaminated with salmonella bacteria. This could result in food poisoning within 12 to 72 hours after consuming the product, with symptoms such as:

Diarrhea

Abdominal Cramps

Nausea

Vomiting

Fever

Testing by the Minnesota Department of Health found salmonella bacteria in an open five-pound tub of King Nut peanut butter that was sent to a nursing home.

These large tubs of peanut butter were not sold directly to consumers, but the fact that the peanut butter may have been distributed at nursing homes, hospitals and schools is particularly troubling, since elderly, young children and those with a weak immune system are at an increased risk of severe and potentially fatal food poisoning as a result of exposure to salmonella.

The peanut butter recall comes only days after the CDC indicated that hundreds of people in 42 states have been sickened by salmonella food poisoning, with about 1 in 5 of the cases resulting in hospitalization. The sicknesses have involved a strain of the bacteria known as Salmonella typhimurium.
