Ortho Evra Attorneys Continue to Review Cases Even as Lawsuits Settle

Digoxin Recall Leads to Congressional Inquiry
Following a series of recalls issued by Actavis this year, including a digoxin recall for all lots of their Digitek heart medication in May 2008, the U.S. House Committee on Energy and Commerce has requested additional information from the FDA about their oversight of the drug maker. This inquiry is part of a continuing investigation by the Committee into the ability of the FDA to protect Americans from dangerous prescription drugs, food products and medical devices.
Eli Lilly Agrees to Pay an Additional $62 Million to Settle Zyprexa Lawsuits by 32 States
Eli Lilly has previously settled over 30,000 Zyprexa lawsuits brought by individuals who suffered diabetes, pancreatitis and other injuries as a side effect of this drug. This week they agreed to pay an additional $62 million to 32 states and the District of Columbia over claims that they improperly marketed the drug off-label, and this is not likely to end their legal troubles.
Recommendations to Reduce the Risk of Hospital Malpractice
According to the Fifth Annual Healthgrades Patient Safety in American Hospitals Study of 2008, there are over 270,000 hospital deaths every year that could be prevented. These hospital malpractice mistakes should not occur if doctors, nurses and hospital staff follow the proper standards of medical care, and there are several steps that family members and friends can take to help reduce the risk of a serious injury.

Zimmer Durom Hip Lawsuit
Although Zimmer has indicated they will begin making the Durom hip replacement part available to doctors who undergo special internet training, the company continues to face Zimmer Durom hip lawsuits from people who have had their hip replacement fail as a result of the company’s prior failure to provide adequate warnings and instructions to doctors about the surgical techniques required by the hip implant.
Nursing Home Problems More Common at For-Profit Facilities
According to a recent government report, residents at nursing homes owned by for-profit companies could be at greater risk of nursing home neglect and abuse injuries. In each of the past three years, 94% of for-profit-nursing homes were cited by inspectors for deficiencies, compared with only 88% of non-profit nursing homes.

We have posted several times about the stability problems with the Yamaha Rhino ATV, which have resulted in a number of serious and fatal accidents for riders and passengers. While the U.S. Consumer Product Safety Commission (CPSC) does track ATV deaths, there is no reliable data available for the number of Yamaha Rhino deaths, which would likely highlight the substantial risk posed by these side-by-side ATV.

Surgery Fire Malpractice Lawyers
Research suggests that between 550 and 650 people are affected every year by surgery fires, and many of these sudden fires result in severe and disfiguring burns. Razor Scooter Recall: Torn Achilles Tendons
Yesterday, a Razor Scooter recall was issued over 100,000 three-wheel “PowerWing” scooters sold between October 2007 and September 2008. The Razor scooters contain sharp edges on the underside of the foot platform, which has caused several children to suffer severe ankle injuries and torn Achilles tendons.
