Cerebral Palsy Botox Lawsuit filed by Maryland family
A lawsuit has been filed against the manufacturer of Botox by the parents of a four-year-old Maryland boy, whose death in 2007 was attributed to off-label injections of the anti-wrinkle cream which were prescribed to help improve his symptoms of cerebral palsy.

Jalapeno Salmonella Food Poisoning Recall
Over the past two months, over 1,200 confirmed cases of salmonella food poisoning have been linked to a particular strain of bacteria known as Salmonella Saintpaul. While health officials initially thought certain raw tomatoes were responsible for the salmonella outbreak, it now appears that jalapeno peppers may be responsible for sickening people throughout the United States. Dangers of bus and truck drivers who have suffered seizures, heart attacks or other medical problems
The Associated Press published a summary of a federal study from the Government Accountability Office, which was obtained in advance of its release later this week. The report highlights a major threat on our nations highways, were hundreds of deaths and serious injuries could have been caused by bus or truck crashes where the driver should not have had a commercial drivers license due to prior seizures, heart attacks, unconscious spells or other serious health problems.
Stevens Johnson Syndrome Lawsuit Results in Defense Verdict
Last week, a California jury ruled in favor of Johnson & Johnson in a Stevens Johnson Syndrome lawsuit which alleged that the ibuprofen in Children’s Motrin caused an 11-year-old girl to develop a severe skin reaction, which blinded her.

Congressional subcommittee passes bill that protects right to file nursing home lawsuits
On Tuesday, the U.S. House Subcommittee on Commercial and Administrative Law passed an arbitration reform bill that will protect the ability of nursing home residents to file personal injury cases in court. If the bill becomes law, mandatory arbitration clauses in many admission agreements would be deemed invalid, preserving the rights of individuals injured by abuse or neglect to file a nursing home lawsuit against the facility.
Avoid the risk of a Levaquin tendon rupture
Following several years of concern about the increased risk of tendon ruptures associated with Levaquin, the FDA announced last week that a black box warning would be added to the antibiotic and other fluoroquinolone antimicrobial drugs, such as Cipro and Floxin. Users will also now receive a Medication Guide which will provide additional information about the side effects and recommendations which may reduce the risk of a tendon rupture.

Although Chantix is effective, side effects outweigh benefits since there are safer alternatives available
New research confirms that the stop-smoking drug Chantix is effective at helping people kick their nicotine habit. However, alternative therapies are available which are also twice as effective as quitting on your own, which do not carry the same risks of serious and potentially life-threatening side effects associated with Chantix.

Worst Insurance Companies for Consumers
On July 9, the American Association for Justice (AAJ) released a report detailing the worst insurance companies for consumers in the United States. They outlined the tactics these insurance companies employ to force claimants to accept less than they are entitled to, putting profits before their policyholder. The findings come as no big surprise to most accident lawyers who deal with these insurance companies every day, but most consumers are unaware that even if they pay their premiums on time, they may not be “in good hands” with Allstate and some of the other insurers on this list.

Laser Eye Surgery Lawsuit Results in $2.1M Settlement
According to the New Jersey Star-Ledger, a prominent New Jersey laser eye surgeon has agreed to settle a medical malpractice lawsuit for $2 million after performing a corrective vision procedure on a man who should have been ruled out due to a pre-existing eye condition. Most people do not appreciate the risk of medical error associated with Lasik surgery. However, with over a million of the procedures performed each year, laser eye surgery malpractice does occur, and it can result in devastating vision problems.
Cipro and Levaquin Black Box Warning added by FDA
On Tuesday, the FDA announced that they are requiring the makers of fluoroquinolone antibiotics, such as Cipro and Levaquin, to add a black box warning about an increased risk of tendinitis and tendon ruptures. They are also requiring that patients receive a Medication Guide highlighting the possible tendon side effects.
