There are a number of factors that will go into determining the amount of any Yasmin or Yaz compensation that is awarded. There is no “set” amount of money that will compensate a particular type of injury. Any potential Yasmine or Yaz settlement will be negotiated based on what a jury is likely to award in compensation. If the case proceeds to trial, a jury will take into account the nature of the claimed injury in each case, the severity of the damage and the economic impact of the Yaz or Yasmin injury.

In determining the amount of Yasmin or Yaz damages that may be awarded in a case, the following are some of the common factors that a jury will consider:

  • The extent and duration of the injury suffered;
  • The effect that the Yaz or Yasmin injury had on the overall physical and mental health or well-being of the plaintiff;
  • The pain and mental anguish suffered in the past and which will likely be suffered in the future;
  • The extent of any disfigurement or scarring (particularly in the case of gallbladder removal from Yaz or Yasmin or other surgery caused by the birth control pills);
  • The amount of any past or furture medical expenses caused by Yaz or Yasmin;
  • Any lost wages or loss of earning capacity;

Yaz and Yasmin are both once-per-day birth control pills that combine ethinyl estradiol (a form of estrogen) and a progestin known as drosperinone, which has never been used before in a birth control pill sold in the U.S. Drosperinone can increase blood potassium levels, a condition known as hyperkalemia, which can cause Yasmin or Yaz side effects.

The potential health problems of Yaz and Yasmin can include heart attack or stroke, deep vein thrombosis, pulmonary embolism, gallbladder disease and sudden death.

    I was taking yaz for many many years. I started to have small things happen like increased infections and kidney infections n stuff like that but then in 07′ I was being rushed to the hospital a few times a month for anaphalaxis shock yet I didn’t have food allergies. Then the fatique started , I was barely able to work but I did and I would come home n crawl right into bed no shower no dinner just bed. Eventually I wasn’t able to hold a job at all , everything became way too hard for me. Even to this day I do not work. My family has helped me so much during these years. They watched a healthy 27 year old woman do a complete 180 in 07 and hasnt gotten much better since. I just manage it. Everything else started after the fatigue, angina, shortness of breath, dizziness, light headedness, confusion, skin pRoblems, muscle aches especially in the legs and arms too at times, migraines, heat arythmia , n ulcers . Plus I was diagnosed with a thyroid problem yet my thyroid is not enlarged. Plus adrenall shutdown where 90% of my adrenals where not working at all . Im in pain all the time, my body hurts always and my right leg extremely hurts from my ankle all the way up to the top of my leg. I have a bunch of doctors I see all the time, I pretty much live at doctor offices since 07′. I believe the symptoms started before 07′ but I didnt know it until then because the signs weren’t as obvious as what they began to be starting in 07′ til now.

    When I hear stuff like this on television and about all the other side eftfces, it is basically saying take at your own risks. Because if you are experiencing strokes, blood clots, deep vein thrombosis or pulmonary embolisms, by the time you do sue for damages, then you might not even make it to receive any compensation.

    I am currently involved in a suit against Bayer for two blood clots in my brain as a result of taking this medication. The problem with clots is that most of the time you do not know whether you are prone to clotting OR you may not even be someone who has a clotting factor (which was my situation). The warnings given on t.v. are no different than taking any other drug. You simply do not know if such things will happen to you. You can only rely on a medical professional to make those calls.

    All birth control pills pose a risk. . .the problem with Yaz and its drosperinone sister drugs is that it’s 3x more likely to cause clots than other BCPs. The claim is that Bayer knew this and failed to adequately warn the doctors prescribing it and the patients. Also, if you read some of the pharmaceutical message boards Bayer sales reps knew this and were told to gloss over the risk factors if asked and instead push how it’s this miracle pill that will take away PMS, clear up acne, and keep you from ever getting a headache again. In this case you couldn’t rely on a medical professional for making the call because they were completely misinformed by the drug company and the sales reps.

    There is absolutely NO medical reason why I should have ended up with a DVT and Bi-lat PE’s (and my doctors agree), and yet. . .
