Thousands of women throughout the United States have pursued a lawsuit after being diagnosed with type 2 diabetes from Lipitor.

While substantial evidence suggested that Pfizer knew or should hae known about the increased risk of diabetes for otherwise healthy women, yet failed to provide adequate warnings for consumers or the medical community, new cases are no longer being reviewed by our law firm.

In February 2014, the U.S. Judicial Panel on Multidistrict Litigation (JPML) established centralized and consolidated proceedings in the federal court system for all Lipitor diabetes lawsuits filed by women in the federal court system.

The cases were centralize before U.S. District Judge Richard M. Gergel in the District of South Carolina as part of an MDL, or Multidistrict Litigation.

While such consolidation is often confused with a Lipitor class action suit, each claim actually remains an individual case where the plaintiff must establish that her diabetes was caused by Lipitor and Pfizer’s failure to warn consumers and the medical community.

In November 2015, the first federal Lipitor trial was expected to begin in the federal court system. While the outcome of the case would not be binding on any other women, it was expected to help the parties gauge how juries may respond to certain evidence and testimony that will be repeated throughout the litigation and evaluate.

Following a motion for summary judgment, the Judge Gergel granted Pfizer’s motion to dismiss the federal litigation and the decision was upheld on appeal.

Factors in Negotiating to Settle Lipitor Suits

Any negotiations to settle Lipitor lawsuits would have been based on what a jury was likely to award in each individual case, including an assessment of the relative strengths of the suit. If a case proceeds to trial, a jury would take into account the severity of the damage and the economic impact of the diabetes diagnosis on each individual plaintiff.

In determining the amount of any damages from Lipitor, the following are some of the common factors that a jury may consider, and which will be taken into consideration when evaluating a potential Lipitor settlement offer:

  • The extent and duration of the injury from Lipitor;
  • The effect that the diabetes diagnosis had on the overall physical and mental health or well-being of the plaintiff;
  • The pain and mental anguish suffered in the past and which will likely be suffered in the future;
  • The amount of any past or future medical expenses caused by Lipitor use;
  • Any lost wages or loss of earning capacity

    I have been on Lipitor for a while now & I’ve been diagnosed with type 2 diabetes & I ‘am having other complications such micro protein in my my urine & my triglycerides are at 237 I just had lab work done on 7-20-2013

    I had a stroke in 2002 from all the stress I was under,it was really a bad one. I was put on Lipitor in the hospital the attending doctor said it was only preventive, I never had High cholesterol problems or high sugar or high blood pressure. Since being put on Lipitor I have type 2 diabetes, high cholesterol, and high blood. I was never tested for diabetes,I stayed sick a lot even asked my doctor to put me in the hospital to see why I was so sick all the time. This went on for 3 years, my husband are the ones that figured it out. I never showed any signs like a diabetic, thirsty, going to the bathroom a lot and really dry mouth. I was dizzy a lot passing out, could remember things I would get confused.

    my health was pretty good until I was put on medicine
    then with in 3-6 months I was told I needed to be checked for diabetes and in fact I did then I am told I have fibromyalgia/high blood pressure/chronic anxiety/
    heart problems my question is this I am still on a lot of medicine like these satin drugs and if the pharmacy company has to pay out for what they knew they were doing to women then I would like to have my compensation my health has gone down so much in the past 7 months and if they are not going to settle soon then I would like them at least to throw me a figure so I could borrow against it.

    Don’t know why this is for women only? I have been on Lipitor for years and now at age 67 I have developed type 2 diabetes along with very hard to control hypertension. Along with the long list of blood pressure medications I’m now taking my doctor want’s me to take a prescription to control my blood sugar! I feel that Lipitor has put me on this road to poor health without proper warnings!

    Why is this just for women only? I took Lipitor for years and was diagnosed with Type 2 Diabetes after taking it. Been treated for Type 2 Diabetes now for several years post Lipitor.

    Too bad they didn’t offer the warnings on Lipitor the years I was taking them!

    im writing on behalf of my mother,she started taking lipitor in 2004.since taking this medicine she has been diagnosed with all kinds of problems, such as inflamed liver, also her kidneys are affected from medicine. she been in the hospital now for well over a week.today makes 10 days being hospitalized.seems to be getting worse but i pray to God she pulls through this also.

    I had been taking Lipitor and Astorvastin daily for over 4–5 yrs and now have diagnosed with Type 2 Diabetes. I’m now taking Metform daily. I have No family history of Diabetes. This has altered my life dramatically.

    I am wondering if it is even worth it to join the lawsuit. Doesn’t very little, if any, of the money actually go to those of us who were harmed by this drug? I don’t have any problem with lawyers making money, but don’t they get almost all of it? If this lawsuit means we would only get maybe a couple hundred dollars, why bother?

    I do not understand why this law suit is for women only. I was prescribed Lipitor in 2005 my blood sugar was normal at the time and in the past. After taking this medication a few months develop leg cramps and rapid heart beat and weakness. I found myself urination frequently. I stopped taking this medicine and call my doctor, who stated Lipitor was found safe with no complaints. I changed medicines, however a few months later my blood sugar was at the top of the scale at 12. I was put on diabetes medication and have been on it for years. This upsets me that no warning was given and now I am having to put up with meters, strips, medications etc. Perhaps this is due to my low testosterone level?

    I have always kept my weight within 5 lbs of my usual weight since I was 40 years old with diet and exercise.When my cholesterol got up to 200; my doctor suggested that I start taking Lipitor.No one told me sense I of post menopausal there would be a risk of me developing type 2 diabetes.If I was fully informed of the risk of developing diabetes I would have not taking Lipitor.After two years of taking Lipitor I was diagnosed with diabetes.I did not have any of usual signs of diabetes.No increase thirst,weight loss or frequent urination.I went to the ER for being extremely drowsy while driving and during lab work was found to have a glucose level of 585.I was not showing any ketones.So as a nurse I knew that this was not a natural metabolic change;but was mostly caused by one of my medications.Through research I found out about the link between Lipitor and Type 2 diabetes.I now after to take a medication to control my glucose level that cost $970.00 dollars every 3 months.My initial HGB1AC was 10.4.I am fearful of what this disease is during to my overall health in the future.The long term effect of diabetes can be very scary.

    I haven taken Lipitor off and own for the last 10 years and have been di diagnosed with Type 2 diabetes. I am also suffering when anxiety high blood pressure depression muscle pain. I take over 17 different types of medications daily including medication for diabetes high blood pressure depression anxiety and have just been given another prescription for Lipitor. I’ve been off work off and on for over a year do to my illnesses. I have been to rheumatologist oncologist cardiologist neurologist nephrologist and nobody could tell me what’s going on with my body. I have always been and healthy individual careful about what I eat my weight, etc. My weight is up and down

    I was prescribed lipitor for “high chloreseral”< spelled wrong I KNOW ...and ON my BIRTHDAY a year later this is what my doctor said AND I QUOTE " Happy Birthday, you have diabetes" end quote. I cannot get mt A1c below 9.8. No matter what I do. My doctor said if it keeps going UP I may need to go on insulin shots. I have panic attacks just polking my FINGER to test blood NOW. I am beyond terrified of ANY needles...I fear if I am put on insulin...I will die from diabeties...I just cannot CAMNOT perposly inject myself. Prior to lipitor I WAS HYPOglycemic....now O am in danger of dying from diabeties. Thank you LIPITOR....and I AM a partisipant in the lipitor law suite.

    I took this stuff and now I have type 2 diebete, my sugar is also uncontrollably and before taking lipator iwas a healthy 175lbs.full of life and now I only weigh 119lbs,I guess that some comes from taking something that suppose to help, yea right.

    Hello, Iam writing in regards to this drug! My mother was on it for several years, then type 2 diabetes and kidney issues, then in final stages was placed in hospice where she passed away 3 months ago at the of 69, she also was on other meds that I feel was not good for anyone. She was given in hospice 3-5 days and lasted 11 weeks off of this drug! This is ashame what the med world is doing!
