Zimmer Durom Cup Class Action Lawsuit
On July 22, 2008, Zimmer announced that they were suspending sales of their Durom Cup hip implant due to an unusually high number of reported failures and hip revisions. The Zimmer Durom Cup class action suit was filed last week in the United States District Court for the Southern District of Indiana on behalf of individuals who purchased shares of Zimmer Holdings, Inc. between January 28, 2008 and July 21, 2008. Although the Zimmer lawsuit has not yet been certified, the lawyers who filed the case are seeking class status.
The complaint alleges that Zimmer materially misrepresented the company and its products. Specifically, the Zimmer class action suit was filed because they failed to disclose material flaws in the quality systems at their Dover, Ohio facility, which makes Zimmer Orthopedic Surgical Products, and because they failed to disclose that a large number of hip replacement patients who received the Zimmer Durom Acetabular Component, which is used during total hip replacements, were experiencing cup loosening and requiring hip revision surgeries.

Could Have Been Discovered Sooner
The Zimmer lawsuit does not seek to represent individuals who actually received the Durom Cup, but rather represents shareholders who saw a drop in Zimmer stock from $70.88 to $66.01 per share in one day.

I had a Durom hip replacement February 2007. I have experienced continued pain, audible nosie and limited physical activity. My doctor informed me about the “recall” and I want to find out if I have a defective part! I’m only 39!

Right hip (total) replacement has dislocated five times, requiring conscious anesthesia. Finally surgically replaced and last September that also displaced requiring procedure as above.

I have bilateral hip replacements in 2005 and 2007. Still have some pain and trouble with start-up, and movement in general. I am 39 yrs also and worried!
