Settlement agreements have been reached in thousands of Yaz injury lawsuits and Yasmin injury lawsuits filed by women throughout the United States, and negotiations continue on a case-by-case basis for claims involving blood clots caused by the popular birth control pills.

Bayer has faced two “categories” of cases involving side effects of Yaz, Yasmin, Ocella, Beyaz and other drospirenone-based birth control pills:

  • Blood clot injuries, such as pulmonary embolism, deep vein thrombosis and stroke
  • Gallbladder disease and gallbladder removal cases

Yaz Blood Clot Settlements

According to Bayer’s 2013 Annual Statement, which was released in February 2014, the drug maker had agreed to pay more than $1.69 billion to resolve an estimated 8,250 lawsuits alleging women suffered a:

However, the drug maker still faces more than 4,600 additional claims involving a venous or arterial thromboembolism injury. Bayer is continuing to negotiate venous clot injuries on a case-by-case basis, after complete documentation and presentation of the claim by an attorney.

The process of settling Yaz and Yasmin lawsuits is far from over, and our lawyers are continuing to review and evaluate potential claims for women who suffered a pulmonary embolism, deep vein thrombosis, heart attack, stroke or other blood clot injury while using the popular birth control pills.

Yaz Gallbladder Settlements

In addition to blood clot lawsuits, Bayer also faces a large number of claims brought by women who have suffered gallbladder disease or a gallbladder injury from Yaz or Yasmin, which often resulted in the need for removal of the gallbladder.

While the lawsuits allege that Bayer failed to adequately warn about the increased risk of gallbladder problems that may be caused by drospirenone, as the litigation has proceeded, plaintiffs have faced an uphill battle establishing that the birth control pills increase the risk of gallbladder injury when compared to other oral birth control pills.

After refusing to consider settling Yaz gallbladder lawsuits, Bayer did agree to a settlement program in March 2013, which does allow plaintiffs who suffered gallbladder injuries to secure recovery, despite negative scientific findings that may have made it difficult to succeed at trial.

Under terms of the agreement, Bayer has agreed to pay $2,000 to women who can establish that they suffered a gallbladder injury and $3,000 to women who required gallbladder removal. However, the total of all settlements the drug maker is willing to pay is capped at $24 million. To participate in the settlement, women must have filed and served their lawsuit before March 25, 2013.

According to information released by Bayer in August 2013, at least 8,800 women have elected to participate in the gallbladder settlement, which means that the minimum participation level of 90% has been met to move forward with the resolution of these claims.

Our lawyers are no longer taking on new claims for users of Yaz or Yasmin, where the only injury involves the gallbladder.

    I can’t believe the length of time it takes for a settlement for this negligence! I know for a fact how it has take away 2 years of a person’s life after being rushed to the hospital for blood clots that went to their lungs. Their leg was week for almost 2 years and their breathing was difficult, which made it impossible to have a normal life. It also amazes me that this product is still on the market for others to suffer life altering blood clots as well as possible death. Shame on those that oversee the safety of drugs and allows this product to continue to sell.

    I’m a massive stroke survivor, as a result of taking Yaz, and I too am surprised the product is still being pushed by Bayer. I had my stroke almost 4 yrs ago, and my speech and my strength on one side will never be the same. And even though i have all my mental faculties, its very hard for me to read at length and write. After 4 yrs! But at 27yrs, I made an amazing recovery and to any girl, or family, who’s been affected by any of the side effects, be patient (I know this might be hard to hear), be strong and keep going!

    I agree with “Jen”. After almost 4 years since my massive stroke, I am unemployed, bored to death, cannot use my left hand/arm, and am a high risk for falls, all the money in the world cannot give me back or my family, the last 4 years of our lives( although the $$ will provide some things we cannot afford since I had to stop working). Every day is a struggle; to fight depression, caused by disabilities I should not have suffered! Shame on Bayer and the FDA for continuing to make this product available.

    I had multiple blood clots in both of my lungs in Sept. ’09 and I was hospitalized for 12 days. Before my ordeal, I was in perfect health, mentally and physically. Now, I’m a complete mess!

    I experience shortness of breath on a regular basis, simple gas feels like someone’s shooting bullets through my body, chest pains, etc. (too many issues to mention)

    Each time I feel anything even remotely similar to a symptom, I lose it. I’m 36 years old and for the rest of my life, I can no longer take any form of birth control (excluding condoms). Also, it’s possible that I may no longer be able to have kids, which wouldn’t be such a big deal if I’d already had a few.

    Bayer is going to fight this when they know there’s a problem? WTF? We need to start writing our Congressmen. We need to tell them to stop taking legal bribes from pharmaceutical companies because people like us are suffering.

    I never again want to go through that again.

    BTW, I already have an attorney. They were hired in 2009, shortly after I was discharged from the hospital. And the clock keeps ticking!

    I just Got out of the hospital in the bigining of August for my gallbladder and I really never thought anything about my birth control untill someone showed me they advertisement for the Yaz and Yassmin… and I was on YAZ for a year…..Its no fun and I am young and Healthy… Working and Just started a new Job No insurance being in the hospital for a week test after test to try and Figure it out then they told me it was my gallbladder and I had it removed its a Scary thing and Im glad a friend told me bc YAZ should be resposilble for this… If I would have known that this was a High risk Side affect I would have never gotten on it… but of course they never told me the side affects of the birth control

    I too had multiple blood clots in my lungs and was hospitalized. I am home now and my life has certainly changed. I am grateful to be alive.

    I was taking Yaz for PMS and acne, not even for birth control since my tubes are tied. So not worth it.

    NRH, I can relate. I feel like I’m a walking time bomb, waiting for something else to come up………will the blood thinners work? Will I have other issues? What is this pain? Can I take care of my kids? Will I always be this tired? Yikes!

    I cannot believe that this product is still on the market. I guess they figure they would take their chances to make a profit. At what cost? I’m glad I called the attorney.

    I had a blood clot from my ankle to my hip and was hospitalized for three weeks. The clot went into my lungs, then I had to endure a nine hour surgery to remove most of the blood clot. Two years prior to that I had my gallbladder removed. I had been on Yaz since 2002.

    Lisamarie, I also have the same concerns as you. I’m grateful to be alive, however I ended up loosing my business and my husband because I was so depressed after. I am better now but have to take warfarin the rest of my life.

    I’ve had an attorney since 3/10 and hopefully something will get resolved soon.

    The really need to take this product off the market NOW!

    I agree with all the posters. It is outrageous that Yaz and Yasmin are still on the market. The FDA has removed other meds from the market for a few hundred injuries/deaths. The serious injuries and deaths from these drugs are numbering well into the thousands and the prevalence of these medication in the general population is scary. I got a 2 1/2 foot long blood clot from Yasmin five years ago. After 9 intravenous surgeries, I ended up with 2 stents and a filter, spent a month in the hospital, and 8 weeks at home with a walker and a cane going through intensive physical therapy. I was lucky to be only 23 at the time and managed to survive and work through the challenges as best I could, but it breaks my heart that other women and young girls continue to be at risk b/c of Bayer’s negligence.

    Many of you who post on here were smokers at the time you were taking the drug and yet you feel the need to blame this on Bayer. I know someone who smoked heavily and is now suing Bayer for her blot clot problems and lost teeth when in actuality it was her smoking in combination with the drug that did her in. How dare some of you people try to blame the drug when you didn’t follow the drug warning labels. And now you want Bayer, who clearly marked on the drug warnings NOT TO SMOKE, to pay for your misdeeds. Shame on you. And for lawyers who take up such cases and try to hid the fact that your clients were smoking, you are acting unethically. Shame on you as well.

    I had my gallbladder removed in 2008. I was healthy, not overweight, and only 23! I was warned not to smoke while on Yaz because of the blood clot risks. I was never told by my Dr. or read anything that warned against developing gallbladder disease. I almost died after the surgery from complications, and at present am daily throwing up bile and have chronic diarehea. If I knew a stupid birth control pill would almost take my life, I would have never used it. Thought I was doing the right thing and be responsible by preventing unwanted pregnancy, but instead I now face a lifetime of being sick to my stomach and constantly running to the bathrooom.

    @Jim, I was a NCAA Division I full scholarship athlete at the time I suffered a pulmonary embolism. Never smoked a day in my life and my BMI was (and still is) well within the normal range. Don’t generalize because of ONE stupid smoker you know. Jerk.

    wish i new what i now know back before my then 17 year old child went on yaz ! as about 99 days later it took her young life !and placed me on the verge of losing everthing i own as i now still to this day stuggle just to paid the interest on my credit card i had to used to buried her

    I was only on Yaz for 2 1/2 MONTHS. 2 days after my 27th b-day i was in the hospital with clots in my lungs. I read the instructions every time I opened a new box. I followed them to the letter and this is what happens? I have 2 small kids and to keep from having to bring a child into this world I could not provide for, I used birth control. I was checked up by my doctor who told me I was healthy enough to use the pill. Now I am on blood thinners for the rest of my life. I have to go once a week to have my blood drawn and to see a specialist. Why was my doctor nor I informed of the risks?

    Hey Jim. Thanks for the laugh. I had to laugh at your ignorance and lack of respect for the horror that women like myself have gone through in regards to the poor judgement and negliance the FDA and Bayer has shown in marketing Yaz, Yazmin, and Ocella. Just recently I had a PE and a DVT that went from navel all the way through my calf. No smoking, no drinking, and active lifestyle. My leg was almost amputated and I had an IVC filter put in to save my life (since I already had 4 clots in my lungs). This filter can not be removed so I now have to live in concern over this for the rest of my life with a new batch of concerns The blood thinners are making my hair fall out and I still experience chest pain almost daily. I took Ocella for acne which Bayer said it helped (we know FDA NEVER approved it for this). So Jim, my question…who said these women were smokers? I didn’t read one remark that stated that anyone was a smoker. Actually, I would have been mad after reading your post if you actually sounded like you had one ounce of intelligence, but really I am left in awe that you can actually figure out how to post a blog with your truly limited intelligence. Keep fighting ladies, this isn’t just about us! It is about defeating giants like Bayer and protecting young girls and women from going through what we all have been through.

    I took yaz and ended up with 9cm liver tumor, major surgery with post multiple hernias that changed my whole life. Bayer needs to be responsible and take yaz off market and settle these claims.

    Jim, I am appauld by your assumptions! I was not a smoker when I developed my blood clots. Shame on you for making these comments based on one person! I had my first blood clot in my lung in 2007, which was very painful and scarey. I am a mother of 4 kids and didn’t know if I was going to come back home to them. I then had another clot in 2008 so now I am on blood thinner for the rest of my life. So you explain to me why I should have to endure pain, mental anguish, medical bills, and physical issues due to this companies bad decisions! I was 31 yrs old when this happened to me and I will have medical bills for the rest of my life not to mention the permanent damage to my lung!!! IT IS MEN LIKE YOU THAT RUN BAYER!!! YOUR ARE A JERK!

    I’ve NEVER smoked ANYTHING but meat.

    I’m not a smoker and I have about 2 drinks a year. Yes, 2!!

    I was a cheerleader & in gymnastics for 10 years and I’ve always been in excellent physical shape. Actually, my vascular surgeon said had I not been so healthy, I would not have survived.

    Now, go back to work manufacturing those poison pills.

    My heart goes out to you rking. You’re in my prayers.

    Every day is a struggle for me. From the outside, no one can tell what I’m enduring. I still have problems breathing and every now and then I have chest pains and shortness of breath and I wonder if I’m going to end up back in the hospital. Mentally and emotionally, I’m a freakin’ wreck. I originally posted on 08/21/11..was doing some searches and somehow ended up back on this site.

    Jim! I was never a smoker!! I was hospitalized for Pneumonia and they found 4 pulmonary embolsmsi. I spent 2 weeks in ICU, missed a lot of work. I had to get lovenox injections daily and take coumadin. I have had to see multiple hematologists. Two years later I became pregnant and was put back on lovenox shots,as a prevention. At 4 months I had a miscarriage. I have been told that I will not be able to have children. I am married 28, I have a fulltime job and was looking forward to my life, and thanks to Yaz I will not be able to have the American dream! Whenever I feel a cold coming on and the slightest congestion I worry, no one should have to go thru that! It is a nightmare

    I was 18 when i started taking yasmin, noone warned me about increased side effects compared to other birth control. I was on it for 2 years and at 20 I had my gallbladder removed because of it. Not a common issue for a young woman who is not at all overweight. I consider myself expremely lucky after reading what some of you ladies have gone through. That could have been me. Non the less my surgery was not fun, it cost me money i didnt have to spend and now i have to watch what i eat all the time because a lot of foods cause severe stomach cramps. If i’d been given the facts up front about this pill, I never would have taken it.

    @Jim…I’m a smoker, but am VERY conscious about where I smoke in relation to my wife. I NEVER smoke in her presence, in the house, etc. She took Yaz/Yasmin/generic for a year 2010-2011, and suffered a severe blood clot in her arm. We caught it before anything serious really happened, but what some of these people are going through is ridiculous. How dare you come on here and assume you know what people’s lifestyles were while they were taking a drug that harmed them. Are you a psychic? Are you a lawsuit stalker, or private detective on Bayer’s payroll? My wife and I weren’t as affected by most, and managed to stop and get pregnant successfully…when we wanted. My heart goes out to all of you women affected by this. And believe me, you can shake what people like Jim say off like the scum he is. Hey Jim, if you were a woman, and pregnant, how would you like to stick a syringe into your belly EVERY DAY for the term of your pregancy, EVERY PREGNANCY? That’s what my wife has to do, for blood thinners, just to reduce the risk death in child birth…that I might come home with mom AND baby.

    jim, I have words for you I will not use because I am a mother but because of yaz that was almost not an option for my husband and I. I took yaz for 2 years are started noticing things going wrong. When I stopped to start a family I was faced with my tubes blocked full of blood clotsand underwent a $15k surgery that insurance would not cover due to “infertility”! The surgery was successful but am now a high risk pregnancy, migraines, blood clotting, and much more. My baby is 14months but we don’t know if we can even have more! I am having a simple surgery this month on my ankle but the doctors are on high alert due to my clotting and the fear of not coming home to my baby and husband is unthinkable! You are a sick sick person and if you do have a wife and kids I feel so bad for them and would never wish what we are going through on anyone and I hope this lawsuit stops it!

    YOU are a sick sick man! I have so many words for you that I will not use as a mother which i was almost not a mother due to Yaz! I took yaz for 2 years and started noticing things going wrong and when my husband and I started trying to start a family we were faced with the reality that we couldn’t due to my tubes blocked with blood clots causing infertility. Not to mention the many other things like the migraines, er visits for blood clots which they would send me home with blood thinners and much much more. If you have a wife and kids I truely truely feel sorry for your family and can only wish them the best because I would not wish what my family is going through on anyone much less what other families have gone through way worse than me including death!

    I have read on the internet that 70 cases have been settled by Bayer as of March 12, 2012 concerning the yaz lawsuits. Does anyone know what order these cases are being settled? I am sure we will never hear the amounts or particulars but it would be great to know what the process being used to determine which cases are being settled is.

    My sister who was more like a mother to me died as a result of using Ocella. She was healthy, non smoker who was taken from my family to soon. I miss her so much and want her back. No amount of money would ever heal the hole that this has caused in my heart. It amazes me what drug manufactors will do for a buck. While the CEO of Bayer contemplates which Mercedes Benz to buy I was busy picking out the casket to bury my sister in.

    I was on Yaz from Dec. 2007 until my near death experience on Aug. 5, 2008. Soon after beginning the YAZ pills I developed a cough. I was given a zpack to clear the cough 3 different times. I was scheduled for an outpatient procedure: uterine ablation on Aug. 5th. I kept telling my doctor, the nurse, the nurse who scheduled my surgery, the nurse at the hospital during preop paperwork that I had a hard time catching my breath. I would fold a towel and I had to go lie down because I felt as though I just ran the marathon. They all kept just telling me it’s because you are anemic once you have the ablation you will fill better. Thank God, my mother requested a friend of hers to be the anesthesiologist that morning. I was suppose to wake up from the procedure in 20 minutes instead it was several hours with the nurse yelling at me to stop hypervenalating…They told me I have asthma and they would send me home with an inhaler. I’ve never had allergies or asthma before and the dr said well you do now. The anesthesiologist told my mom, No, something is wrong don’t let her go home until they figure it out. So they agreed to do an xray…nothing so were going to send me home…mom said no test more so they very hesitantly agreed to do a CAT SCAN. Low and behold both lungs were filled with many blood clots. Of course then they did many tests and put me on iv blood thinners coumadin and was in the hospital for a week. The anesthesiologist walked in and did the sign of the cross and said I don’t know how you are alive…I looked at him and smiled and said you and I both know…and I thanked him for keeping me alive. I knew before my surgery something wasn’t right and I prayed that all was well between God and I cause I just felt something was going to go wrong. Nobody would listen when I said I can’t catch my breath.

    I can’t believe Bayer is allowed to market this pill knowing that they are killing people and causing permanent damage to others all for the outcome of the almighty DOLLAR!!!

    I delayed to get in on the lawsuit because I just don’t like to sue. Under the circumstances I believe we all need to stand up for our right to live and their obligation to be honest about the pills they are giving to us.

    Judge said he would not let this go on forever but in Dec,11 he gave til April now i see he again gave til June if Bayer settles another 70 is he Again going to GIVE them MORE TIME ??
    and what was settled and whom????????????

    I too was going to get on here and give JIM an earful but those that have posted before me have done well slamming this MORON. What a D BAG assuming that all of us smoke and somehow deserve what has happened to us. I ended up with a saddle embolus d/t a DVT from YAZ. My pulmologist told me I should have died. I just got out of the hospital and am dreading what lies ahead of us (my family).

    Not to add fuel to the fire but I also just realized that Bayer has another product call Beyaz. This is the same poison contained in Yaz, Yasmin etc but they have added folic acid. I guess since their products are pretty much now generic (thus their profit margin has dropped), they tweak it by adding the folic acid (yes the product you are suppose to take before you get pregnant). Now they have a NAME brand product thus higher revenue. I still can’t believe that Yaz, Yasmin etc are still available, but to me it is CRIMINAL that they product another product (BEYAZ) that will basically cause the same side effects as it is basically the same product. Now Bayer will have exclusive patent rights for ??? years thus boost their revenue. I hope each and everyone of you receive adequate (if that’s possible) compensation for your damages from this multi BILLION dollar company. SHAME ON YOU BAYER111

    I have had been taking yazmine and ocella since I started my first period when i was in 8th hrade so almost 5-6 years because I had cysts and the doc thought it would ease the pain and how long they were. I just moved so haven’t found a doctox. I have been having weird hurting sharp thronbing pains that become hot an red. Are these sytoms of a clot? I stopped taking it a couple months ago because insurance ended but I have a weird feeling I have one.

    My perfectly healthy 25 year old daughter had a Yaz-stroke in February,2006 . She will always suffer as a result of this stroke that would not have happened if she had been informed about the known dangers of Yaz/Yazmen. She contacted a lawyer as soon as the information was made available to her. This was by advertisements on television. As of yet she has heard nothing but that they are working on it. She waits, wondering what will happen. What are the long range effects of using this drug? Will her symptoms get worse? Will this issue ever be settled? I think 6 years is about long enough. Bayer knows what they did. It’s time for them to make a settlement although no amount of money will restore what my daughter lost. This needs to end.

    @ Erica: hey, contacting a lawyer doesn’t hurt! Hopefully it’s NOT a clot, but I would email or call an attorney right away. I wrote months ago on this site, and I came upon it again today while checking on the YAZ litigation status. I’m happy to see that Bayer has started to settle – thank god! 641 cases @ $142+ million, so far. My heart goes out to all who were affected by a horrible side effect of YAZ. Though any amount of money can’t begin to make up for myself, any other survivors, or any of their families, I’m glad Bayer is being held responsible. (((((((((<>))))))))) { virtual big hug to all!

    I don’t smoke. I have been a nurse for over 20 years. I was in training to pass a PT to apply for a police academy. I took Yaz for 3 weeks and I ended up in ICU for a week. One lung was full of blood 100% and the other lung was full to 90%. When I went to the ER the physician said if I had waited 1 more hour to come I would have been dead. I am PISSED about all my dreams that will never come true bc my physical health is FOREVER compromised. I can’t run anymore. I can’t walk without being short of breath. The thought that I might not be able to raise my girls is heart breaking. I have a stent in my heart that will need be able to come out. I can’t play with my kids or road bike anymore. I owe 200,000 dollars in medical bills alone. I saw where Bayer settled 650 cases for 218,000 dollars each. That doesn’t even come close to what I have suffered and loss bc their product was dangerous and they were deceptive in their selling practices. And to the man who said its MY fault bc I “smoke,” how dare you judge anyone. Until you have lost your wife or daughter or had their lives forever changed, keep your mouth shut.

    Are the cases getting settled by rankings of severity? My understanding is that half of the original 11,000 are true PE or DVT cases and can be settled. If 651 have been settled as of 5/12 that still leaves over 5000 left to settle! Perhaps these latter cases are more severe and may actually receive a just settlement they deserve. Bayer paying out a meger $218,000 per settlement is to me chopped liver and an insult to the damage yaz has caused these families. Lets hope the folks who received this were not as severly affected by the yaz drug as others are. I would be horrified to think a severe case was settled for that pittance. Is there a lawyer in this forum that can answer any of these questions?

      @billy – It is probably a fair estimate that about half are PE or DVT. Early figures in the federal MDL suggested that about 40-45% of the filed cases involved a venous thromboembolism, such as a DVT or PE. About 10% of the cases involved strokes or other outcomes, which generally resulted in more severe or catastrophic consequences. Bayer is negotiating individual cases based on the circumstances and consequences of the injury. This is being done on a rolling basis and on a firm-by-firm basis. The reported averages are just that, averages, which are impacted by the exact make-up of each case that is part of the settlement group.     My heart goes out to all those who have had their lives so viciously compromised, especially those who have lost someone. You will get thru this, besides God, sometimes time is the only thing that can heal. I don’t mean to say, “God” in such light terms, he is the ONLY one who can “heal a physical and emotional broken heart”! I too, didn’t want to be involved in a law suit, but my laywer, explained that Bayer has very deep pockets and sometimes the only way to get thru to these company’s are thru the pockets, otherwise…many other women will continue to suffer. I think humans are sometime guinea pigs and are made to be the trial study until enough people die and people finally stand up to these uthinizers!

    I was given Yasmin back in 2003 and was told it was the mildest birth control on the market. I didn’t want to go on birth control but it was given to me to control my bleeding. 4 months later (I don’t smoke, drink, I excerise and ate very healthy at the age of 48) I couldn’t breath and was in terrible pain and for 5 days the doctors couldn’t find what was wrong with me. I was admitted into the hospital and they found that I had a blood clot in my lung. I stayed for a week and was told the last day that I was there that the doctors gathered around my file because I was suppose to be dead and somehow made it.
    My attorney told me that because this was back in 2003, I will problably be intitled to nothing but my situation will help other woman.
    All I have to say is …. nice I almost gave my life so I can get nothing but my case can help other women get their fair share. Not that I am not happy for that, but I went through some pretty bad stuff and still suffer from it after all these years!

    My wife had a pulmonary embolism in late 2005 – 2 cardiac arrests for a total of 30 minutes dead. 26 days in the hospital which began with open heart surgery to clear the clots. The result of being dead for 30 minutes was total and permanent blindness. Every doctor who has heard her story says she should be dead. 2 weeks before this happened, she had laser vein stripping surgery for clot in the leg – the doctor who performed procedure did not feel being on birth control was an issue. She sued doctor and lost because he excersized “reasonable” care. She may get money from Bayer but will never regain her eyesight.

    I was 25, had done 5 triathlons, played on 4 soccer teams, and was extremely active. I had a PE and the doctors couldn’t figure out what was wrong because I was in such good shape but whenever I stood I couldn’t breath. I was told that I should have died instantly when the PE happened and as a result I had moderate heart damage and went in with only 30% lung capacity and my O2 was below 80%. I was in the ICU and hospital for almost 2 weeks. My income dropped by over 50% because I am in marketing and couldn’t work in a job with as much flight and travel time anymore. I’ve been part of the lawsuit for going on 3 years now. Hopefully there’s some resolve before much longer. I am soooo sorry for everyone (and their loved ones) that were effected by this.

    I am a non smoker and drink about 3 times per year I have chest pain daily which makes me worried all the time I suffered a blood clot in my leg and often walk with a cane, was in icu for three days and have severe pain walking and climbing stairs and will be on thinners my whole life. I recently asked my job for ada accommodations and was dismissed as of the end of this school year. I am sorry I ever listened to my doctors praises of pill benefits. These pills had a detrimental effect on my body and my life. I lost everything…jobs, apartments, cars, etc. even my only child because I couldnt take care of him!
    Thanks for sharing…i try to tell young girls not to take bc pills because thier life may hang in the balance.

    I was on Yaz for several years, then all of a sudden in July of 2009 I started suffering from terrible chronic stomach pain. Because I had no predispositions to make it readily apparent that it was my gall bladder, it took until October to find out what was wrong and have surgery. I had my gall bladder removed when I was 18 years old because of Yaz. I suffered for months because it didn’t make sense that my gall bladder would be bad. I have struggled since it was removed and now several times a year I get sick and vomit bile. It is very upsetting that it is taking so long, my family had to pay for all of my medical for me and has gone in to debt to cover it. It’s amazing to me that by trying to be responsible as a teenager that I was put through so much pain and such a burden was put on my family. If I had known about these risks, I would never have taken Yaz. I would never have knowingly put my life and health at stake to ease cramping and heavy periods. And now, rather than full-on admit that they are wrong, Bayer releases “Beyaz” and makes us wait years to pay bck out medical bills.

    I just have to say that I was completely healthy until I started taking Yaz/Yasmin in 2004. I kept having pain in my back and side and kept going to the doctor trying to figure out what was going on and the silly doctor I had told me that it was something with my rib cage and had me wear this belt around my ribs. Well, I was suppose to leave for a trip to NC and while at work one night hurt so bad that I drove myself to the ER. When I got there, the doctor ran test and came back and started asking me all kind of questions about blood clots and I told her there was no history of it in my family and she then stated that I had them in my legs and lungs and immediately started me on heparin and all other kinds of medicines and put me in ICU where I stayed for about 2 and a half weeks. Because of the clots, a piece of my lung died and now I have problems breathing and am at a high risk of developing them if not cautious with what I do. The doctor also told me that if I had gotten on a plane, I surely would have died. Isn’t that crazy. I am still feeling the effects of what it has done to me and hope that everyone who has gone through this get some kind of settlement because it makes no sense for a company to continue to be in business when so many people have suffered. As for Jim, I have never been a smoke and have to tell you that you are an idiot for your comments.

    I suffered a stroke ending with some paralysis still on my left side. it was on 10/31/05. talk about changing your life and nothing being sacred anymore. However, I am getting along the best I can. I just cannot believe the number of women that this has affected and they let it keep going on. I will not use anymore Bayer Pharmacuetical products and will inform everyone I know ! I am in a litigation with them right now. there is know way they can givev me my life back how it used to be!No amount of money can put me back together.Itbwill have to be a miracle!

    I totally agree with what you are saying. I took it for 3 weeks to shrink an ovarian cyst in May 2007 and June of the same year, I had a PE and a DVT. I was called the “miracle patient” because the doctors told me that I should not be alive. I could not walk for three months and suffered pain so severe, I has a standing order for Morphine. As if that wasn’t enough, I suffered another DVT in the opposite leg in 2008, and it was much worse than the first one. This time I had to use a walker and my leg swelled up so bad, it is permanently discolored. Another clot in September of 2009 and the last one so far in January of 2011. Each time I wonder if this is the one that will take me off of this earth. The mental strain is almost as bad as the physical. I am on blood thinners for the rest of my life and cannot walk a few feet without being out of breath. I went to Jamaica for my wedding anniversary this May, and trying to walk to dinner was a chore. They had to call the nurse and give me oxygen. I am not going to read any ignorant , uninformed comments on here, but based on some of your responses, I can say whoever has something stupid to say….suffer like we have, lose loved ones like we have and then tell us what you think. Unitl then, shut your trap. God bless all of the victims and be at ease.

    I had started to take yaz after I had my second child to help with my acne as it got worse. Not much time passed and within a month I had a horrible migraine, nothing I ever had before and as I tried to relax and let it pass, I had what my husband and I thought was a mini stroke. I couldn’t pick up my head and couldn’t move my arm and leg on my left side. It lasted for about a half hour before I could move. A couple months later, i had the stroke like symptoms occur again. I played it off because my mom had mini strokes when I was younger. Finally, it got to where I happened in one week more than once; I was nauseous and would head to the bathroom but would loose strength, fall and couldn’t get up. My husband insisted I go to the hospital but I refused. I spoke to my coworker and she brought up the idea of my birth control. The last time it happened was while I was at work and I worked at a hospital so everyone insisted I go to the er. Test were done and the dr said I had conversion disorder, basically I was stressed. I mentioned my birth control but he said it wasn’t from that. My insurance wouldn’t cover the visit and at my yearly, my obgyn said I could no longer take birth control, my hormone levels were going to be off, and more kids could be an issue. Opinions on this??? It took weeks for me to get right after it happened at work, I stopped taking the pills immediately. I am having some irregularities with my periods now too. I started the yaz jan 2011 and stopped aug 2012.

    My heart goes out to each and everyone of you who have had to endore some awful side affect of this horrible pill. I was a division II basketball player in the middle of my senior year when i was taken to the hospital after a game and told I had multiple blood clots in my lungs. I was a healthy 21 year old athlete never smoked and was at the top physical shape of my life. Little did I know my life was about to change. I was admitted to the hospital for a few days put on cumadin and I was injected twice a day with another blood thinner. While in the hospital I was told I would not be able to play basketball anymore. I know it seems like a small thing compared to my life which I am greatful for each day but it was like they took my identity away and everything I worked so hard for. I think what pisses me off the most is that I went on yaz for acne and to be regular for road trips. I went into a deep depression and ended up not graduating. Now at 26 I am finally able to go back and finish my degree. I can honestly say I hate the bayer corp. and I wish every single women that filed gets what they deserve. Even money can’t changed all of our experiences. Thank you all for sharing your stories it feels good to be connected with other women who understand you. God bless you all!!!!!!!

    Can any of the lawyers on this blog outline how the process for settling these cases is progressing? The last news I have found is the news back in April of 70 cases being settled then in may of 651 cases settled. Since then, no news about any cases being settled. Is the process stalling or is settling still occuring just off the record? Surly Bayer knows that settling quickly would be far better for them than huge trial settlements. Thanks for any info you can provide.

      @billy – Settlements are continuing in the Yaz litigation, but we are not aware of any updates to the reported number of cases resolved. A status conference before Judge Herndon in the federal MDL is scheduled for this week, but I imagine that further proceedings will be stayed so that negotiations can continue. Given the large number of cases, Bayer is negotiating small batches on a firm-by-firm basis. Most rounds of settlement discussions have involved around 20 cases at a time.

    I was luckier than most to only develop a DVT in my calf. I was on Yaz for 6 weeks when I woke up one morning and couldn’t walk. I was a runner, had quit smoking a year before I started taking it. My doctor was not aware that this was likely caused by my birth control (well before it was highly publicized) but my father found an early article and mentioned sent it to me. I was 22 years old, and trusted the article stopping Yaz immediately. My heart goes out to those of you who have suffered worse

    As of today I am in the lawsuit against yaz. I was on this birth control to regulate my period because I had a tubal. And cysts and was losing 80-110ml of blood during my cycles. I am 27 and a mom of 7 children. While on yaz I experienced an extreme pain in mu back. Chest. Shoulders and legs. I couldn’t stop moving I was in so much pain. Crying and my husband rushed me to the hospital. I went through CT scans. And they had foud blood clots in mu left lung I was hospitalized for 3 days and sent home on medication to take. I had no medical therefore thanks to yaz and my blood clot. I am now 26000 dollars in debt for a 3 day hospital stay plus a 75 dollar prescription. If I had not found out about the clot I would have been dead!!! The hospital said it was pneumonia. Yet I had no side effects of pneumonia or bronchitis. Not even a cold. Just woke up from dead sleep in severe pain !!! Walking pneumonia my butt!!! Lies. And malpractice if you hear me.

    – As of 7/19/2012, Bayer faces 12,325 lawsuits involving about 13,530 claimants (excluding cases already settled)
    – Bayer is currently only settling cases involving a venous clot injury (pulmomary embolism or DVT) after a case-by-case negotiation
    – Bayer has reached agreements to pay $402.6 million to resolve 1,877 claims as of 7/19/2012
    – Bayer estimates that they face about 6,000 claims involving a venous clot injury

    I’ve been on Beyaz for 3 months. My obgyn gave me 3 months of samples. I almost finished my 3rd month and woke on a Tuesday with pain in my right leg. I worked 3 days ( I do homehealth, so I drive alot) and finally got in to see my pcp but they couldnt get me ultrasound until wed. This was a friday. Friday evening I felt it move from my calf under my knee. Went to the ER and they were useless bc they woulldnt call someone in to ultrasound me. So I came back the next day, Sure enough I had a superficial blood clot under my knee. Did I mention my twin sister had one a year before that on her same leg and in the same place? She was on Yaz and is doing the law suit… I feel for anyone going thru this. Its a constant panic wondering about DVT or PE’s. I pray for you all and your families…. God Bless!

    I can’t believe that doctors still prescribe yaz I went to my obgyn ghe other day and they had a yaz poster on the wall…I took yaz from 08-09 and in that short time I became pregnant had a spontaneous miscarriage. And had caught a dvt in my right leg from my hip to ankle, which a part broke off travled to my lungs and to my brain. I was rushed to a locak hospital then flown to another an was on deaths door in may of 09. I was then put into a coma where they then put tubes in my sides to get the blood out of my lungs, then performed brain surgery on me to remove an abcess(spelling?) from my right frontal lobe from the dvt traveling to my brain. When i finally awoke from my coma in july of 09. I had lost 60-70 pounds, had a giant scar going across the top of my head, tubes coming out of me from what seemed everywhere on my body and no longer could walk. I wouldn’t get back my abilities to walk until 1yr later an even then i walked with a limp an got picked on everywhereeee I went. So after going to numeroussss doctors I finally found that from having such a severe dvt in my right leg my hip joint and deteriated away an so at 19 a whole 3 goin on 4 years later I found that I needed a total hip replacement and recieved one dec of 2011. It was the worst part of my life. And to have the pain and embarrassment from that birth control drag on from feb 2009 to Dec 2011 I will never be the same person again emotionally mentally or physically even though I had my hip replaced I’m still limited on what I can do. So thanks a lit Bayer.

    I have never smoked and never used drugs. My doctors kept blaming diabetes for each health issue and kept me on Yasmin/Ocella for years. Over the years I had a mini stroke, ovarian cysts, multiple mini heart attacks, adenomyosis, and had to have a hysterectomy. I had kidney stones, and thought WOW! I am too young to be falling apart liek this! I had been vegetarian for many years and work out in the gym 6 days per week. Being that sick was beyond ridiculous. Now I know why and I am pissed off!

    I replied a while back, but it never posted. For those interested in the settlement process, once you finally receive the settlement letter it can be more than the 90 days it says for them to sign off on the settlement. Once that’s done, you will receive release papers. From there it takes 30 days and then an additional 30 or so days for it to sit in the court to verify if you have back taxes or medical liens. I’m still waiting to receive my settlement, but apparently my 30 day court review period is almost finished. The settlements do come, but from my experience can take a while. Best of luck to everyone. I never smoked, wasn’t overweight, and all of the guidelines; yet Yaz and my doctor at that time almost killed me.

    I was diagnoased with DVT and multipe PE in Dec 2010. The case was very severe. All tests indicate that the 8+ years of Yaz were the cause. My filter has been removed, but the continual pain in the leg remains almost two years later. This has been a long process, and the recovery many times harder than I would of ever thought – both, mentally and physically. The bills are so high, but we are working hard at plugging away at them. And, doing all the right things. I’m 32.

    Thank you Tracy for this important information, I also had a DVT and Pulmonary Embolism, I am in the waiting game too, I had insurance but my attorney told me he have work with the insurance company to resolve the liens, it is scary that out of what you get that medical liens have to be paid out of that too.I am waiting to see what happen now that I have signed my Release. If this is so I will need to check with the insurance company.

    Since it seems like the average settlement is still hovering around $215K and they are half way through the DVT/PE cases I’m interested to hear from anyone who has settled and whether they had both a DVT & PE or just one and if you did have both did you receive separate settlements for each? Obviously, you signed a non-disclosure agreement, so can’t give too many details.

    Mrs T: I had both. I have already settled,but I have not received payment yet, and I am only receiving one (1) check I was told early on before they settled that is only one check I will receive, but they stated that Bayer was only settling DVT or PE cases so if a person suffered both why are they only paying for one, my leg will never be right because it has become bigger than the other leg as a result of the DVT. I notice some people stated that they do not have to pay any medical liens to their insurance companies, I wonder what state is that, can anyone tell me.

    Traci and Randi, can I ask which states you are in and if you have now received your funds? I have signed all of the paperwork, had BCBS as well and am being told that Bayer is demanding that insurance companies determine the subrogation and lien amounts. If an insurance co is not participating, they are not going to release ANY funds, until subrogation is finalized and complete.

Bayer knows that these cases would yield much higher payments if they went to a jury and the subrogation of insurance would not hurt the plaintiffs as much financially. Can anyone who received settlement for PE who are left on blood thinners for life please post their general settlement amount like Randi did please? Judge Herndon said In a follow-up clarification, Herndon warns that if Bayer and Yaz/Yasmin plaintiffs do not act in good faith, he will start remanding cases back to the districts where they began. Who is determining this “Good Faith” premise,,,, Bayer?????

    I had a very large DVT in my pelvic region in 2007 after two months on Yaz. Was on bed rest for one week, did the Lovanox for a week, Warfarin for a year and blood checks every two weeks for a year to make sure my blood wasn’t to thin/thick. I received my settlement papers October 25, signed and Fed Ex’d back for October 29 delivery. My paper work stated it may take up to two months to have final payment and I may receive more than one check. My attorney’s also hired a third party to negotiate with the insurance companies on repayment. We are to pay back insurance 10% of settlement amount or 50% of total insurance bill (depending on which is cheaper). I’m assuming this is straight across the board and not attorney/firm specific??? I had to agree to an intital fee of $75 for this third company to look into my insurance. If it comes out that I have to pay back insurance this company will charge me another $125 for a total of no more than $200 – for their fee. I contacted my insurance company and my policy did not have a repay clause at the time of injury or during the year of treatment. I live in Texas so that may be why. I’ve found Texas to be more consumer friendly.

    I had to have my gall bladder removed at 18 years old. Young, healthy with no medical conditions. My attorney has told me that they are not even looking at those cases yet. Anyone else dealing with that

    Ladies,

    I posted on this forum in 2011…23 yr old (at the time) with 2 1/2 foot clot from left lung to knee, 8 surgeries, walker, cane, physical therapy, stents and filter….my lawyers are letting me know tomorrow what the settlement offer is…I will try and share a general amount (whatever I’m told I’m allowed to share) and the amount (if any) taken by the insurance company…I had Aetna at the time….I’ll try and share as much info as I can…my heart and prayers go out to everyone on here…My experience because of Yasmin was absolutely horrific and I’m sure that many of you experienced the same level of trauma…still can’t believe these drugs weren’t pulled from the market!

    I was just turning 21 and at the peak of health when a had a PE due to taking yazmin. It has been a little over 9 years since that day. I am grateful every day for each moment I have been given. I have already settled my case however I am still waiting to find out if there are any liens from my insurance company. If anyone else is in this spot please let me know how things are going for you.

    Three and a half years ago I had three PEs. I was 36 and healthy. Not a smoker, ever. I spent 7 days in the hospital with daily injection in my stomach, left on Coumadin for a year, missed my daughter’s 5th grade play, and missed Mother’s Day. Very, Very scary time for my family.

    The PEs moved into my lungs while I was at work. Freaked my co-workers out too. Missed three weeks of work. I just want this to be over. And for Bayer to stop selling this drug. How can they think it’s okay?

    Nicole, much like you, I’ve settled my case and am waiting to hear about liens from insurance companies.

    I lost my wife seven years ago to a pulmonary embolism due to this medication. I was told that my case was one of the top cases since it was due to a death. Losing her affected every aspect of the life of my children and I. Trying my best to be patient because I could use the funds due to losing a great job after my wife’s death. If only I could see the light at the end of the tunnel, then perhaps I would feel a little better.

My wife suffered the same DVT issues as many of you have and signed the settlement papers back at the end of August of this year. We have really lost faith in this system to play out in a decent time frame, but I will post letting you know when we receive the settlement to hopefully shed light on a potential time period to expect. I have been unable to get an answer, I also signed the paperwork to have a company negotiate the lien amount for $75 if there is no lien and $200 if there is. Has anyone else done this if so what were your results?

I don’t understand why they did not settle cases like yours first! You have obviously suffered the most severe consequence of this horrible medication.     Michael I am so sorry for your loss I hope things are settled for you as soon as possible! I also signed my paperwork in August and have not been given very good information on what is going on. My lawyers make me feel like if I call and ask how things are going I’m being a huge bother. I call maybe twice a month. Perhaps I am getting over anxious I just feel like I’m not being kept informed. All I ever hear is “we’re waiting”

    I signed the settlement papers in August and have been waiting since then. I spoke with the lawyer today and no update as to when. They are waiting like I am (and most of you). So frustrating. I’m not hopeful to see anything this calendar year.
    Nicole, I have not signed any papers like that. Sounds like you may be a little further along in the game than I am.

    Nicole and R – i too have settled my case about 3 months ago. I have been waiting for a month to find out what my insurance is going to take from me. I think they are allowed to take up to 15% of my gross settlement. I have been waiting for almost 8 years now for this day to come. I missed my 21st birthday because of this and have dealt with it since. I was told from the time i settled it would take 3 month at the max, but i am at 3 months now and have been told i wont receive my first check until January now. Like others have said, i am not going to hold my breath.

    I have read that they made a “matrix” system based on severity of issues. I have also read that many death and stroke cases have not been settled yet. They would most likely settle the cases receiving the least amount of money first in order to not cause a huge panic with their stock holders. Also, imagine if the public and attorneys heard about multi-million dollar settlements being made in round one…Bayer would want to avoid that press at all cost. These settlements are NOT about us. These settlements are abour Bayer paying us off as frugally as possible so they can get back to making multi-billions of dollars with their drugs. As soon as OUR FDA voted to not pull this drug from our shelves, we knew that Bayer won. The money they spend on us is small in comparison to their financial big picture.

    As for the insurance companies, just a couple of thoughts. If our insurance companies approved to pay or subsidize Yaz (and related products) cost, then they gave the permission for us to take them. My question is, are your attorneys going above and beyond the matrix amount to pay the insurance companies back? Also, since we pay premiums, then WHY would insurance companies have ANY money coming to them within our personal lawsuits. If we did not persue a lawsuit, then would they persue it seperately? If not, then I think our attorneys need to be fighting this a little harder. Also, they should be disclaiming this before we decide to sign up with a specfic attorney.

    I posted above about my injuries (August 2011) due to Ocella….1. massive DVT from navel through back of my calf, 2. several PEs 3. IVC filter (that could not be removed even though it was “temporary”) 4. Due to filter I will be on bloodthinners for the rest of my life..which means montly Coag appts. 5) missed 1 month of work 6) husband who is a nurse had to miss work to care for me….and on and on and on… But so lucky to be alive to see my girls grow up. Would just like to settle for an appropriate amount and know what the heck is going on!

    Good luck friends! Thank you for your stories. I find your stories comforting (and heartbreaking) since so many people don’t understand what it was like to go through this.

    Here is the latest information we have received from our lawyers and per my prior post it actually gets worse for payout timing. Bayer is now asking the banks for release paperwork on the monies in escrow. The banks are saying they have never heard of a request like this before. The firm we are dealing with believes this will now end up back in court and payout expectations should be targeted around April 2013, but no promises. They feel this is a tactic to delay payment by Bayer.

    Austin, if you feel this is divulging too much information then don’t post. If you can add further clarity to what I wrote I’m sure we would all appreciate it.

      @Tracy… Unfortunately, I really can’t provide much insight into this issue you are experiencing, as I have not seen this as a common issue. Generally speaking, in our experience the time from settlement to disbursement in these cases has been very quick compared to most mass tort litigations in recent years, since the settlement groups are fairly small.

    My name is Misty and I suffered a PE and was hospitalized for 4 days. I have 3 young children. Ages 2, 8, and 12 at the time. They were as you know very upset. Our hospital did not allow children under the agE of 12 in at all! That alone broke my heart. I have one lung that has been badly damaged from the clot. I continue to suffer various side affects. I have been waiting 2 yrs. I just got word from my attorney that they would like to offer a settlement. I have been told by many NOT to agree to the amount.

    Hi! I have received my letter regarding my settlement in mid November, which have been signed and sent back. I suffered from multiple PE’s and DVT’s. I signed papers that would allow the insurance companies negotiate with the lawyers to recover the money that they paid out for our care. I agree that it seems unfair since we paid premiums monthly for years for our health insurance and now some of them are able be repaid some of their money back. The insurance company that I had at the time (2006) went bankrupt in 2007, so it doesn’t seem logical that i would lose any part of my settlement to them. I was told that they were going to hold 30% of the settlement until the insurance company settled with us. That way we would receive our money that was awarded to us sooner. I have not signed the papers yet that state that we are signing off with Bayer and will not try and file anymore claims against them. I was under the impression that everything was moving along quickly, but it really doesn’t seem like it. I think that I will be waiting quite awhile longer. I have since then been having declining health issues and now unable to work. I’m hoping that we receive our settlements soon. It has been a difficult road and I am looking forward to all of this coming to an end.

    An update of frustration on mine- I had to sign more paperwork for an ammendment stating that if my insurance company chose not to participate in the PLRP, then they could withhold 30% of my payout. My insurance company chose not to participate, however, within day of signing the paperwork, my attorney was able to get lien resolution paperwork from them for a fraction of the 30%. That was on Dec. 14. Great- right? Last week, on Thursday I found out that I needed to speak with an attorney working with the QSF to see if I wanted it paid out in one lump sum, or in installments (then the interest plus principal gets paid out tax free). When I spoke with her, I told her of my wishes and was told that my check would go out the next day overnighted via FedEx. Lovely, since although my attorney’s office is local to me, they were going to be closed from 12/20-26. OK, so on Thursday 12/27 I should be able to go and pick up this check. I called them today at noon to see if I could pick it up, only to be told that they didn’t have it, had not received it and had not received the tracking number for the transmittal.

    I have spoken to the local attorney and have been assured that they have tried to get in touch with the attorney working with the QSF, but have not been successful in their attempts. Now, my attorney’s office is closed M-W of next week again. I think I would have a better chance at winning the lottery than receiving my check.

    Is Bayer paying punitive damages is the settlements or can you say?

    The purposes of punitive damages are to punish the defendant for outrageous misconduct and to deter the defendant and others from similar misbehavior in the future. The nature of the wrongdoing that justifies punitive damages is variable and imprecise. The usual terms that characterize conduct justifying these damages include bad faith, fraud, malice, oppression, outrageous, violent, wanton, wicked, and reckless. These aggravating circumstances typically refer to situations in which the defendant acted intentionally, maliciously, or with utter disregard for the rights and interests of the plaintiff.
    If not, this explains the settlements in a nutshell! They hid the info about the clotting from the FDA and are getting away with it

      @Jane – Punitive damages are a type of damage that may be awarded at trial if the judge allows that issue to reach the jury. For settlement purposes, any offers are not going to break down an amount for punitive damages. The settlement is the amount agreed to avoid the case going to trial.

    My wife was offered a settlement in the 300k + range. This was in September. Over the past months we have completed paperwork, including having a notary present for the most recent release forms. Had contact from our lawyer a week ago stating that everything was moving ahead smoothly and now they are negotiating medical liens. Was told another 30-60 days before we hear back. Hoping for more information around February 2013. So far everything has proceeded exactly how our lawyer has predicted, so were patiently waiting.

    Well i see once again the FDA is going to let the public down as this new pill inwhich has Drospirenone is a synthetic form of progesterone in it which is the same as yaz, yasimen, and others which Bayer put out and now is in mdl of ILL . as this carries some of ,many side effects and is the number 2 with side effect in the world now another pill with the same in it I WOULD THINK NOT BUT GUESS IT’S OK TO KILL WITH AT PILL, What you all think the mdl against Bayer for yaz and other birth control pill is not enough ?bayer product has killed more then 100 so far and my child included yet the FDA wishea to give them another pass .i would really hope not.If Bayer ever told the truth about all the money they made off of yaz one would really be amazed after all by Bayer on records they made more then 31 BILLION yet they wish to whine about what little they have paid out so far !!!!!!!! SHAME ON YOU BAYER

    My case just settled in Oct of 2012 and I had my release signed and notarized and sent back to the attorney for Bayer to release the money. My attorney’s have been very helpful and informative. Unfortunately like most of you women I am unable to take any estrogen birth control ever or if I become pregnant I am high risk and have to take Lovenox. The settlement money is great but not great enough where I could return back to being healthy. Which I was. I just want to know after the release is signed and returned to Bayer when they cut check? It is ridicoulous about the 30percent hold back fee

    This is an atrocity!!! I had P.E.’s form Nuvaring… I’ve had them on two separate occasions… These people don’t give a hoot… They are just out to get their money. They paid some people out of this Yaz litigation under a quarter of a million dollars… So sad. To the people that died Lord rest their souls… These peolpe will give their surviving family millions of dollars… able bodied people where they give us pennies… I had to get my tubes tied after one child because of the health dangers. Depression, and pains are all we have left… Ladies I pray for us.

    As promise I would update after my settlement offer from Jan 2, 2013. It was only $XXXk. I was shocked! After being in intensive care for 7 days, a permanent IVC filter, and many complications four years laters. That’s it! I did not accept the offer. Waiting on the next offer. I am willing to go to court. Because I was perfectly healthy and now I will have health issues plus anxiety over every pain I feel …. for the rest of my life. Some people have settled for very small amounts…if you need the money..I don’t blame you ..you have to do what you gotta do. But I can wait. Thanks for this firm for letting us keep this blog going because it’s the most up to date information that we can find on the internet.

    Our latest update and please read the lower portion and save yourself 4%:

    Timeline: Signed and notarized settlement papers in early September.

    Signed and notarized an addendum created by Bayer regarding the PLRP options and there are 5 and really 4, if you were not insured by Medicare/Medicaid.

    Our firm is telling us a 70% payment should be forthcoming by March 1st, because everything appears to be taking about a month and since we are a part of the early filers we are going through some of the kinks that are being worked out. He said all the major hurdles have been over come and this was the last one due to different interpretations between Bayer and the legal counsel.

    IMPORTANT FOR YOU BECAUSE YOU DESERVE EVERY PENNY!!!: Read the addendum you received closely, because you will gain 4% on your payout. Hopefully, I articulate this part clearly. On your original paperwork in the earliest stages of signing your settlement papers there is a statement about 6% taken from your gross settlement amount regarding fees and costs ( 2% for fees and another 4% for fees and costs equalling 6% ). This is in addition to the 40% your firm gets. On this latest addendum, it clearly states that there is a 6% fee; however, only 2% comes out of the Gross Settlement amount and the other 4% is covered under the 40% your firm is charging you. The addendum also states the information on this document supercedes all other information. I spoke with my attorney yesterday and had him confirm the later and he agreed that the 4% was in their 40%. Then I told him what the original paperwork said and he went silent and said he needs to read the original paperwork. I then immediately followed our conversation with an email thanking him for confirming the details of what we just discussed as a CYA.

    I am sorry for all that you have been through and will post as soon as we hear more or receive a check. I’m not holding my breath 🙂

    I had a PE and have completed all of my paper work. II’m at the stage where they’re contacting the insurance companies for liens and so on. I was told that hopefully I should have my funds by the end of February. I wasnt given a direct amount on what I would receive but was told that Bayer had paid the law firm a huge lump sum to be divided to the clients depending on the severity of the case. Does anyone know about how much would have to be paid out for all of the extra fees? Or does anyone know of a ball park figure that we’re expected to receive after all of the fees are paid out? I read the paperwork but it was just so much and differnt amounts here and there.

      @Jane – You should really speak directly with the law firm representing you, or their office, as this is not a global settlement process. Resolution of liens is going to be somewhat different in each case, and in some cases there may not even be any health insurance subrogation.

      @Sue – There are no new updates on the gallbladder cases. In the federal MDL, everything continues to be stayed while Bayer is focused on negotiating the blood clot cases. Bayer has indicated that they have no intention of settling gallbladder cases, and all indications suggest that they intend to defend these cases. That may change if some of the bellwether cases are permitted to go to trial, but right now I am unaware of any that are scheduled.

    @Janine – I would be very interested to hear more about the process for refusing an initial settlement offer. Looking back over my agreement with my lawyer, it basically says if they set forth an offer they think is fair and I refuse, they can drop my case, make me pay all the fees and my guess is that I start at ground zero again with a new lawyer.

    I won’t be surprised if this will be a take-it-or-leave-it situation since my case will be lumped in with 10+ other plaintiffs. Curious if we’d then negotiate a different settlement amount as a group. It almost sounds like you recieved an individual offer and were not part of a larger group offer.

    I too had a DVT/massive PEs and blood thinners for life (no clotting disorder).

    @Mrs. T – I did refuse the first offer and my lawyer agreed because he thought I had a more servere injury than his other cases because I have a permantely IVC filter. The second offer was way higher and my lawyer accepted without asking me (sent me a letter). But I’m satisfied. He explained to me (the first time) we talked and said that once Bayer makes a second offer, that will be the last offer, and it will go to court if I dont accept.
    I guess my lawyer did not want to go to court…i can’t speak for him but they probably would not have gone to court because it may be another 4 years.
    Waiting to sign documents, he said the process should be faster now since Bayer has worked thru some of the kinks in the Liens.

    I am concerned that the attorney takes 40%, your insurance companies holds 30% until the reduction/agreement is settled and it takes 6-months for you to obtain a check? i asked to settle in Sept. My attorney held out until Jan 2013 stating he could get me more $$ however; not the case. The case settled for the same amount in Sept. I filled out the paperwork for the insurance company to settle…I guess my question is how long to do have to wait to obtain any kind of payment? 60-months a year?

I’m so sorry that you need to have a permanent IVC filter; I think that blood thinners for life are bad enough (espcially for people who should NEVER have had a clot to begin with). I can’t imagine any of the cases (other than those involving death) going to court. The lawyers, the Judge, and Bayer know there is a maximum payout for non-death related cases. Time is money – courtroom battles waste a lot of time and the results might not be much different from what’s currently being offered – at least that’s what they’re betting on.

    In our case there was one offer and “yes” the time from signing the agreement papers to receiving the check was about 6 months.

    Michael,

    As Austin has stated many cases are treated differently, but I can speak to our case. Understand that the insurance companies are not holding the money. This is all in an account waiting for disbursement. The attorney’s handling this at the highest level actually did us all a favor by setting up the PLRP program. This actually, believe it or not, is expediting the process. Bayer did not want to pay out a dime until the insurance side of the equation was resolved for everyone in these groupings, so by setting this up we would get a portion earlier than later. Trust me this is advantageous for the lawyers as well, because they are not getting paid a penny until we get paid. Now to answer your real question Michael, “what is the PLRP holdback about?” Austin feel free to correct any misunderstanding in what I’m about to explain, because I’m not an attorney. The PLRP holdback is a percentage that ranges from 20% if your insurance company is in this listing of companies to 30% if they are not. You will know, because your lawyer has a list and this should or will be presented to you at some point in your process. This list is not a secret, because this was again created to speed up this portion of the process as well. If your insurance company is not on this list be prepared to make a decision on how you would like to proceed, because there are 3 options to chose from that point. Unfortunately, I cannot disclose those and our options may have been slightly different than yours. I know Austin speaks that everyone’s deal may be different, but I really don’t think so given Judge Herndon’s response and positive remarks made to the head legal counsel whom is truly representing all of us. He praised them for the PLRP holdback concept to move this process along swiftly, so the victims can get their funds sooner.

    Thanks Tracy for that info. From what I understand our lawyer\’s are currently meeting with Yasmin to discuss their cases and settlements. So I am assuming here in the next week I will be receiving a call offering a settlement amount. I am not too concerned with the insurance company and what they may want, as my wife did not have the opportunity to have any surgeries or inpatient hospital stays. Sadly her death was so sudden that she only had gotten as far as the ER, so there really is not much expense on my insurance\’s behalf. I am some what concerned for my lawyer contacted me wanting me to go to my county court office to pick up power of attorney form and guardianship forms for my children. However, they were not very specific as to which forms and considering there are a multitude of them I emailed the lawyer\’s office with the county website so they can obtain the forms needed. I was then told that I would need to get a hold of a probate lawyer and have him look into it. I find this utterly ridiculous as they should be more than capable in getting the needed forms themselves and in my opinion, this is what they should do to earn their share of my settlement. Has anyone else experienced such nonsense?

    I’m very sorry for all those and those with loved ones who took yaz and now suffering from the horrible side effects from it.. It makes me sad for all these stories. Well i am just confused because I am 18 and ive been taking yaz since i was 12 and started heavily smoking at 14. I never had problems with yaz it was just normal bc to me. Thats why i was so shocked about all the cases from so many women who had terrible injuries and death that happened to them. So I immediately stopped taking the a few months ago. I just thank God that never happened to me although of how long i took it and smoking also.. So i dont know for sure but maybe smoking dont have as much of an impact as what people think.. I do believe what happened to the women was definitely from yaz… But i do have a question what bc besides condumns is okay to take??

    I had a dvt in my leg in August 2007. I received a settlement offer this week. I have not been able to find any information on the long-term consequences from taking Yaz. Is anything known about this? It makes me nervous to accept this offer if I’m going to be experiencing long-term health issues, especially if it is going to affect my ability to keep health insurance coverage.

    After reading the comments on this page all I can say is shame on BAYER and shame on u JIM. How dare u get on this page where people who have been disabled severly or lost their lives or for families who lost moms, daughters, sisters. I have NEVER smoked in my life. I was healthy until 2004, then almost died due to multiple blood clots to my lungs. The pulmonologist stated specifically my lungs looked like swiss cheese. I was a healthy mother of 4, a nurse for 14yrs, home schooling my brillant children. During rehabilitation I had to put my kids in a school that was less than desirable. I lost my job. I lost my home. I lost my husband. JIM YOU ARE AN IDIOT. You have no idea, OBVIOSLY what u are talking about. If this ever happens to anyone close to you reguardless the drug….Nevermind reguardless of how cluless u are, I wouldnt wish what happened to me and my family on anyone. Even to an idiot. So glad u have permanant rose colored glasses on. Though being blind and all what good are they doing u? Gosh I feel better!

    @ Dominique. Speak with your obgyn about this and depending on your long term plans perhaps consider an iud I use the one with no hormones and it is good for 5-10 years depending on brand. It can also be removed at anytime if you decide to have children. Just remember it won’t protect from std’s so condoms are always a good idea.

    @Ms T. I read your post again and I did not answer your question properly. My attorney has 27 yaz clients and when he gave me Bayer’s offer. He ask me if I wanted to accepted it. I said “I think it should be higher” and he said he agreed and was surprise that I was offered a low offer because I have a permanent IVC filter. So the second offer, which was way higher, he accepted it without asking me. But as I said on my previous post I did not mind, because waiting for a 3rd offer would probably be bad news for me. Hope this helps.

    On a side note – I just signed my settlement papers (one month after my offer) and they said I should have the check in 30 days. They said the process is going faster now because everyone (Bayer and the Lien companies) have better systems in place now. My attorney fee is 33%. My lien will be 15% hold back and I will get that amount later. I will post when I get my check.

    I would first like to say I sympathize with all the women and young ladies that have been injured from yaz and orcella my family has been turned upside down from this drug my step daughter was 19 yrs in college doing well getting her career started she got on the pills in August 2009 and she was dead by April 2010 perfect health before she started with these pills to Jim have you ever lost a love one ?You dont know our pain you ought to be ashamed of yourself .God is watching you and all the ones involved these pills should be banned and they should be made to compensate everyone affected by these pills our lives will forever be destroyed try telling a mom or a father when thats your only child that you will never see again,never walk her down the isle to get married or never ever have grand children or never see her graduate from nursing school .Im very upset because Bayer is carrying on making money and ruining innocent people we are not guinea pigs are rats to be in labs we are human!

    I suffered a stroke in 2008 and filed for suit with the class action in 2009. About 2 months ago, my atty sent me a packet of release forms for health insurance and 2 pharmacies to allow them to send my information to the atty.

    Just curious what any stroke patients have heard yet or are we still going to be in the last group for settlements??

    @ Tonya I am SO sorry you suffered a stroke. I hope you get some financial relief from Bayer. I have had other medical issues since my PE but we are all SOL once we get this settlement and have other issues due to this medical problems as a result of Yaz. The best we can do is pray for good health, take care of our selves by eating right/exercising, and keep our medical insurance current.

    Can someone please assist me. I am seeking a step by step legal process in how all of this lawsuit works. I was offered a settlement back in January 2013 (yet to sign paperwork) signed in February 2013 a release, indemnity and assignment and PLRP nothing else. My attorney who is not good about communicating has noted I would receive a check within 60-days however; if I have not signed a formal settlement paperwork that won’t happen. I am so confused on this and want to know exactly what I need to do and see if I need to look for antoher attorney who can assist in communicating and letting me know exactly step by step what the procedure is.

    My attorneys tell me that a certified check is in the mail for me. I suffered a 7 inch blood clot in my left leg at Thanksgiving 2011, resulting in a 3 day hospital stay, 2+ weeks of Lovenox tummy injections (ouch!), and 6 months of Coumadin. I realize that I am much more fortunate than many Yaz victims, but am still hella mad that Bayer continues to make $$$$$ off of this poison.

    Hello everyone, thank you so much for your posts. I suffered a heart attack, PEs in both lungs and DVT (1 massive clots that extended from my pelvic to below my knee) in my right leg. Spent several days in the hospital and 3 months on disability, and will be on coumadin the rest of my life. I was scheduled to get a filter but was too unstable and the doctors were too scared to touch me. I have signed all settlement paperwork and awaiting a decision from my insurance company.

    Does anyone know when they will start settling cases with heart attack victims?

    But I am more concerned that Bayer is now offering an alternaltive drug to replace coumadin. My doctor suggested I take this medication. I am not comfortable taking any new medications from Bayer, don’t trust that they did the necessary research.

    I I feel so bad for all of you that suffered such great losses. I myself was on the same pill for over 8 years, which included all three variations of Yaz, Yazmin and Ocella. When I was rushed to the E.R. I told the doctors they were mistaken when they told me I had sever gallbladder disease and needed it removed immediately. I had NO health insurance. I had never even set foot in a hospital since I was a child, I was so healthy. I remember asking the doctors why was this happening?? I’m healthy, I eat right (-I’m a nutritionist!) , I exercise, there was no familial history of anything like this–WHAT was going on!!?? I have been paying hospital bills for three years now. I am APPALLED that Bayer thinks what I (we) went through is worth $3,000!!!! ! How much of
    that $$ will I EVER see after the lawyer takes their cut from representing me for three years, and their percentage? $3,000 won’t TOUCH the bills I accrued or even the time missed from work!! I’m insulted! All I wanted out of this was to have my hospital bills covered. This is more insulting than receiving NO settlement what-so-ever!! Gee Bayer, thanks for leaving us all with permanent scars and health issues while also f’ing me in the ass!!! Talk about adding insult to injury!!! I’m better off suing for burning my tongue on hot pizza! What a load of GARBAGE!!! Screw you Bayer for screwing us all!!!!!

    I developed PE back in 2009, after only being on Yasmin for a month. I was in the hospital for a week, and on blood thinners for a year. My case was started a month later that same year, and around January of this year, I signed paperwork for a percentage of the funds to finally be released to me, which should take 1-2 months.

    As of today, the law firm informed that the defense council is reviewing the paper work. Hopefully this will be the month, that I will FINALLY recieve my funds.

Really? serious? After the EMERGENCY SURGERY i had to go through and being transported to a hospital 2 hours from home, and since then, I eat greasy food, I shit like crazy, and $3 grand is supposed to cover that?

    I filed my claim in 2009, and as of today, my case has still not been reviewed or setteled. I live in Oklahoma, but my case was filed in the State of California on September 2010. I wish my lawyer would be more forthcoming with any information or updates. I have to call HER to get any information whatsoever, and that information is bare minimum and tells me nothing as to when the lawyers for Bayer are going to review my records. I suffered a DVT in my leg, was hospitalized for 7 days, was on blood thinners for six months. I am now disabled due to edema and swelling in my leg. Plus, I had to have an IVC filter placed in my leg/groin before I could have a major surgery in September of 2012. Is there anyone else in the same predicament as I am?

    Worried.

    I recently received the settlement release and consent forms. Unlike Tracy, there was no list of insurance companies participating in the PLRP but there was a PRLP form attached. It only states that I am participating in the PLRP if I sign but does not say which of 3 PRLP options I would be agreeing to. There was also no copy of the MSA attached but referenced in the settlement release. My attorney is working with a company other than the one under one of the options so I guess it’s down to two PLRP options. One of my regrets in all of this is the law firm I selected! They do not provide any explanations!

    hey everyone man i have been going thru this case for almost two years i have been in the hospital lasy year from jan 2012 to august 2012 about seven times aqnd this year about one week ago i found out that almost haif of my lung is gone because its no blood travelng thru it the doctor told me it was dead and now i have two blood clots in my left lung and a blood clot in my right leg i just thank got that all of those that didnt die from thiese blood clots we are really blessed i am only 37 years old amd have never been sick in my life and i took yazmin birth control only for six months and i didnt find out that i had cloths till two months later. ladies i think that we just have to hang in their and fight for what we deserve.

    Hi everyone. I had a clot from my ankle to my abdomen, PE, hospitalized for 3 weeks, temporary filter put in, however they were not able to take it out. Shots in tummy for several months and gallbladder removed.I’m also on coumadin the rest of my life. I filed my lawsuit in January 2010 and was told last week that a settlement will be reached no later than July 2013 with payment no later than Dec. 2013. Have no idea how much I’ll be receiving but it will never be enough. Lost my business and my husband left plus I filed bankruptcy. My thoughts and prayers are with all of you who continue to suffer both physically and emotionally.

    I am SO SO SORRY for the loss of your daughter. I cannot even imagine that pain. I suffered a stroke at the age of 35 due to hyperkalemia to a clot to a stroke.

    These type of cases take a long time and I think we’re all very antsy to get some sort of recoop of monies since we are hearing cases getting settled.

    Money will never replace what any of us have lost or will loose (ie I cannot get life insurance 🙁 ). But hopefully we can be good stewards with any monies we might receive or be able to take care of debts and our families. My thoughts and prayers are with everyone during this very anxious time.

    I am with you Savannah, but am so thankful that is all that happened as compared to others with strokes, blood clots, etc. I feel so bad for all of you and pray you get just compensation (if there is such a thing).
    As for the $3k, the attorneys will get 40% of that, so I will be lucky to get my meds covered with a small amount for the months of pain and suffering (not to mention lifetime of side effects). A probiotic does wonders though for those who had to have the gallbladder removed. Best of luck to all of you!

    Experienced DVT very large left popliteal area. Was given a money amt. which according to lawyer the judge agreed to. This was in Jan/Feb 2013. According to law office they are awaiting for release forms to be returned, Lien resolution process( in process already) and then I will get a call to discuss monetary issues . Not sure what release forms they are waiting for but think its the rest of the 21 cases which this Law firm is handling. Any insights when this appears to be settling??

    I have posted twice here before. Last month I received a letter stating that my attorney was about to meet with the mediator. After calling, I was told that April 23 (yesterday) was the date my case was supposed to be looked at. This on the heels of being told two months ago I will be on blood thinners the rest of my life (since they couldn’t take out the “temporary” IVC filter) and I have started having major pain in the leg where the navel to calf clot was AGAIN. All I know is that if my settlement is only big enough to pay attorneys and insurance company, I am not going to sign. I didn’t go through this hell to make other people rich. At this point a settlement would allow me to somewhat mentally put this behind me, but physically I will have to live with this the rest of my life. I hear about so many other stupid lawsuits where people are awarded crazy amounts of money for the stupidest things, but yet the average settlement for us is only 210,000 or so?? To me that is insane. I’m not sure that any of us are going to come away as winners. At best, we can get marginally bought off in a way that will allow us to just break financially even. Whatever the case, best of luck fellow survivors and families! I will update as soon as I hear anything.

    I contacted my Attorneys office this morning to see if I would have to pay my insurance company. My previous post shows that I signed all paperwork and PLRP form in early April. I was not allowed to speak with the paralegal handling my case. I was told that it could be up to a year before any funds are released. I am soo very frustrated with the firm I selected. I wish I had read this blog before signing with them.

    Had this reaction, pe in lung…end of 2006…it is now 2013 the settlement is done and the insurance company taking their forty per cent I imagine law firm will take fifty leaving me with about 50k. Better than nothing …but…wait..how come I am the one ill and I get paid if at all, last? Anyone else having this problem…I was told first of year..it is now end of April. I am told be patient. I was for six years or so. Anyone have any advice. Bayer is paying out which is great, but do they know their victims are not yet being paid. I say it is all bunk. Those who were put on warfarin forever, recheck that with someone. I went to ER and told them I had been on it for six years..they ER dr. was appalled said six month max..so am off of it and doing fine..I never had physical ailments like I am now…BEST of Blessing s to you all…

    I suffered multiple PEs in both lungs in 2006 – one of which was mobile. I was very lucky I got to the hospital when I did. I was hospitalized for over a week and my health has never been the same.

    I signed by settlement acceptance letter in November 2012 and signed & notarized additional paperwork (insurance releases, lein resolution forms, I wont come after bayer ever again, etc) in Jan. How long will it be before I seea check? Im calling my attorney tomorrow but I want to know what others have experienced in regards to turnaround times.

    Has anyone out there refused a settlement offer? I think most of us are pretty anxious to accept and pay off those medical bills, but there has got to be at least one victim that has the financial means to tell Bayer to suck it.

    However, I think most lawyers agreements basically says that if you refuse a settlement they deem fair, they can drop you as a client and force you to pay all the expenses, which would have you starting at ground zero with a new lawyer IF you can find one to take your case.

    I signed my settlement papers in January and my release in March, received my disbursement papers and signed that a week ago and now was told that Bayer has found problems with two releases and it would be 2 months plus before I see any money. I had my PE back in 2003 and was in the hospital for a week and was told I should have died. I started this process 3 years ago in April and still nothing!!! Every time I think it’s the last step … here comes one more!!!

    I wrote in March of 2012 and I too am still waiting for my lawyers to meet with Bayer. Mary made a comment about taking the blood thinners. I was told I would have to take them for the rest of my life. I was very much against it and my dr was aware of how I felt. He kept a close watch on me and let me stop taking them after 6 months. I’ve been off of them since Jan of 2009 with no problems. I even had a back surgery a year ago and didn’t take any blood thinners and had no complications. Of course it’s always on the back of my mind when I get congested or when my leg hurts but I’m sure that will be with me the rest of my life.

    I too was told that I should take blood thinners for the rest of my life as well. Since I had such a bad reaction with yaz back in 2003 and not knowing at the time because of Bayer, I was afraid of the side affect of the blood thinners. So after 6 months the doctor took me off and wanted me to take a baby aspirin every day. I have stopped taking the aspirin and had not had any problems. But like Tammy I still am afraid of getting another blood clot. My leg still hurts from time to time up to this day and still get pains like I am going through a heart attack, but just decided I have to live with it. I just feel blessed that I am not as bad as some of the other girls.

    I read this blog everyday but never posted before. I had a DVT and Bilateral pulmonary embolism in 2009 but only filed in Aug2012. I signed my acceptance letter in early February and signed a release in March. I already received my check 2 weeks ago. They did hold part of the funds for insurance settlement.

    Hi, I was wondering if someone can tell me the process of how these YAZ cases are being settled. I was told by my lawyers that Bayer chooses cases to settle. And that I just need to wait for my name to be called. I have been in this lawsuit since 2007.
    I got bilateral PEs after a DVT left my leg and traveled to my lungs back in 2003. I was hospitalized for two weeks. I was only 19 and I didn’t smoke. I was on YAZ for only a month or so. And I did not have health insurance when I developed the clots. I was put on heprin while in the hospital and when I was released I was put on coumadin. I had to get blood drawn twice a week, then once every week, then every month. My medical expenses were so high I had no way of paying them and they went against my credit. Plus I had bill collectors harassing me.
    Every time I have pain in my leg or chest I am scared about having another blood clot. I have been off and on blood thinners since I had the blood clots. When I was pregnant I was told I was “high risk” because of my history with blood clots. I had to inject myself with lovenox during the entire pregnancy. Thank goodness I didn’t get another clot and my baby is now 3 years old and healthy.
    Last year I had to have knee surgery and once again due to the blood clot BS I had back in 2003, I was put back on blood thinners. I developed an allergy to coumadin. So If I get another blood clot I don’t know what is safe to take.
    I am writing this to tell my story, hoping that others will come out and tell theirs too. They need to Recall YAZ. SO that no one else gets hurt.

    I was just wondering if anyone experienced seizures while on yaz. I was on yaz in 2008 and I was having 4-5 seizures a day…I stopped taking them and about 2 days later the seizure activity completely ended. Anyone else have this symptom?

    Hello. I am new to this board. I, too, suffered from a DVT in my left leg that was diagnosed on Memorial Day in 2009. I was hospitalized for 3 days with a stent and a filter implanted. I was on heparin at the hospital and warfarin for 6+ months. I was also diagnosed with gall stones while hospitalized and had my gallbladder removed in December of 2009. I was 24 years old in good health during this ordeal. I was also a light smoker. I was on ortho-tricyclene lo prior to starting Yaz in November of 2007, also a smoker at that time with no issues. I know that many of you will feel that I brought this on myself because I smoked while on this bc, but I was told that because of my general good health and young age, the risks were not severe. Since then, I quit smoking, can never be on birth control again and had to give myself lovenox shots daily during my pregnancy in 2010-2011 and was extremely high risk during my pregnancy. I struggled with the decision for years on whether or not to move forward with a lawsuit, but because my left leg is still 50% more swollen and larger than my right leg and I am in constant pain, I finally decided (with the support of my family and my health care providers) to finally move forward. I have been very forthcoming with my attorney about my smoking and they assured me that although it may effect my settlement amount, it by no means mitigates a settlement. The fact is, the suit is being filed because Bayer failed to be forthcoming on the increased risk of side effects, especially the risk of blot clots and PEs. I am happy to report that my case is moving along as scheduled and I am currently in the allocation and insurance lien state. I have been told to expect a settlement by the end of this year, at the latest. Thanks to everyone who has shared their story and i hope each and every one of you receive the result you hope for. This has been extremely traumatic for me to put it mildly, and i know now that even though i could have helped to prevent this by not smoking, it most likely would have occurred anyway. I was a ticking time bomb according to my doctor, and lucky to be alive. I thank God every day for that. 🙂

    I have been reading this blog for months now. I had a pulmonary embolism back in 2009. I didn’t file a claim until August 2012. I signed settlement papers in November. I have no medical liens because at the time I had NO insurance. So yeah… You can just imagine what a 2 week hospital stay looks like. I signed a release form in March, now I’m just waiting to receive my check. They said it could take up to a year. I’m hoping it will not. Has anyone else revieved their settlemt yet?

    I was hoping Austin could provide his opinion or me. I have been on yaz since 2009. I suffered a dvt and bilateral PEs in January 2013. With the label change in april 2012 is bayer still settling cases such as min where he incident occurred post label change? After the first month on yazi never bothered reading the a book so I never really knew about the change. My pharmacist never mentioned the change either. You would think tha with such a big issue such as clots bayer would have notified the physicians and the pharmacists to let the patients know. Your thoughts?

      @Demure — Whether Bayer will settle your case at this time or not, it certainly appears that you have a case worth reviewing further. Despite the warning update in 2012, there are very strong arguments that individuals who began using the medication before 2009 were not adequately warned.     They held 15% from my settlement. I lived in Arizona at the time of my injury, so they are trying to negotiate to pay nothing to insurance. The insurance company needs to respond in 60 days and they may get another 30 days if they request it. I will post it as soon as i hear something.

    How can it be legal that Bayer just slams through this take it or leave it settlement for all GallBladder Victims! This is outrageous! 3k for almost dying because my gallbladder blew! How is this JUSTICE???? The attorneys all gave up on GallBladder Victims and then this 11th hour payout that amounts to a CYA so that Bayer does not have to pay out big money later? Everyone is told by the attorneys who are inept and in collusion with Bayer to take this settlement when their should be fair and adequate compensation… I should receive atleast 100% for pain and suffereing what was the medical costs by the insurance company! Not 3k!!!!!!! WHERE IS JUSTICE IN THIS OBVIOUS SET UP!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

    I got this info from Garretson resolution group and they did a good job explaining anti suborgation law.

    Question: What is an anti-subrogation state and how are these states accounted for in the PLRP?
     An anti-subrogation state is a state which prohibits private health plans, through statute or
    case law, from seeking reimbursement. These states include AZ, CT, KS, MO, NC, NJ, NY and VA
    and apply based on a Claimant’s state of residence at the time of injury.
     If a Claimant resides in one of these states, there is a rebuttable presumption that the Claimant
    will not have a repayment to a Participating Plan. However, the Participating Plan may rebut
    this presumption by providing plan documentation to GRG which shows the Participating Plan
    has a right which is based on Federal law and preempts the applicable state anti-subrogation
    law. If the plan is a Medicare Part C plan, the Health Plans’ Representative may provide proper
    certification to rebut the presumption.
     If the presumption is not rebutted within the timeframe (sixty (60) days from the date of
    receiving a proposed payable lien amount with a possible thirty (30) day extension; total time
    period of ninety (90) days), the Health Plans’ Representative must produce a no interest letter
    for the Claimant.
    I signed PLRP documents on March 21st. I am hoping to hear something from them in June. I heard insurance companies can still find a way around this law.

    Hi everyone, I was diagnosed with DVT ( 2 blood clots) in left leg on August 29, 2012. I just finished the blood thinners in February. I filed a lawsuit regarding Safyral in the fall of 2012. I have also been told that Bayer is currently refusing anymore settlements filed after April 2009 when the stronger warnings were issued (supposedly). I, for one asked my OBGYN doctor specifically if it was safe and told her I didn’t want to take something that was like Yaz, Yasmin, Ocella, etc. She told me it was safe. Never once mentioned the similarities between Safyral and these others or I would never have taken it. What I would like to know after reading all these posts is if anyone thinks ( injured parties, affected parties, and the lawyers too) think that Bayer should be put through a trial and punitive damages awarded as well? What about accountability and preventing future generations from being victims of this despicable company? I just found out that a new generic form of Yaz is being released in 2014. I have a 14 year old daughter. Others have moms, sisters, aunts, nieces, etc. It seems to me that going to trial might be the only way to really stand up to this pathetic company and hit them where it hurts( their deeply selfish & greedy pockets) and also save others from what we have all suffered. I would hate to think that I have to accept a settlement because all my attorneys care about is money? What about true justice? And why aren’t we suing the FDA while we are at it? They continue to let this company operate and make money creating a line of BC pills that kill people and alter their lives and health forever. When does it stop? Who’s responsibility is it? By the way I read that they’ve made billions selling these poisonous pills. Just some points to ponder….. They are getting away with too much and it certainly isn’t at their expense. Its at ours.

Still no check…the 27 of us who are using the same attorney had to resign our paperwork and I don’t know why because it was identical to th paperwork that our attorney had me sign and get notarized. but Bayers reps said it needed to be resigned. Did that in Late march. Just talked to the law firm and they got the check today but will wait til they clear then send checks out to clients. It’s frustrating and you never know howv things will twist and turn. Best wishes to everyone

    Hi all. Just checking back. Has anyone received their settlement monies? I hesitate to harass the law firm. But just take your cut and lets get on with our lives? I was told never to discuss this with any one anywhere ever. What is up with that. As a law firm you make money off of peoples trauma. Might you not be grateful you are getting that money> and if so, getting that payment out to the victims? I am trying to get off as many medications as possible. I think that we should all go to alternative medications and do the best we can to avoid pharmaceuticals. This is a racket and I do not pretend to understand, but our welfare is not the issue. I will let you know if I ever see a penny of the monies supposedly received on my behalf.

    My condolences to every one whom have lost love ones from this drug.I almost lost my life from a P.E. Mds were amazed I walked out of the hospital in 2004. Was on Yasmin for 1 month. I never smoked.Signed my settlement documents September 2012. Was due to receive payment in February. As of today I have not received a payment First informed that my insurance co. was not participating,arrangements were being made to release 70% of funds. They did not know when.I discovered my ins co WAS on the list.Recently I have changed insurance companies from BCBS to Medicare, they are checking to see if funds are owed or taking any medication relating to the injury. Have not been on blood thinners since 2005.Form was signed and returned in December 2012, asked attorney how long for a response ,stated did not know,the government takes a long time. Spoke with Medicare, if you do not owe= 90 days.Unbelievable. I lost my home, my husband,and the bill collectors are constantly calling,the list goes on.To be disable have to deal with this is unfathomable.
    I want to thank everyone for their information they have provided.And keeping this blog open.Good thing I have faith .Everyone, hang in there,take care of yourself.

    I find it interesting that women are starting to report continued swelling in their legs when they had a dvt. My dvt was in Aug 2007 and in June 2012 I had to start taking baby aspirin, potassium and a diuretic because of the swelling I started to get in both legs. The left (where my dvt was located) has swelled the most. My doctor said to take it for a week to get the swelling out, thinking it was due to the long hours in the car and then sitting at a conference, but after 1 week of not taking the meds, my legs both swelled back up. I am now on having to take these meds for the rest of my life. When my law firm was ready to send my case to settlement, they called asking if I was having to take any new meds due to the dvt. What does Bayer really know about long-term effects? I strongly suspect they know we will suffer serious long-term consequences and any settlement amounts we -eventually – receive will not cover our future medical costs…….I pray I am wrong……

    Terra- I am so sorry for the loss of your daughter. How tragic. My heart is with you . I do know, thru reading A LOT of legal documents about the cases that they are waiting to settle the most severe cases, including stroke, heart attack and death. Most assumingly, for potentially bigger payouts. They did not want to include those before the last big shareholder meeting.

    Anyone else with LONG TERM SIDE EFFECTS? Mine are chronic migraines (almost daily), aphasia, and frequent trips to the doc and ER when I have leg cramping from pooling blood. ugh.

    I just called my attorney to found out when the money will come. Signed the release in January than again the disperse of the money in late March. She told me that the group that is handling the PLRP has to ask Bayer for permission to get the money, then their firm have to ask for permission from that group for them to get the money and then ask Bayer for permission to disperse the money to me …. all I have to say is … WHAT … never heard of such a thing!!! Is this just something to shut me up? It’s sad that the insurances will take your money since you did all the work to get to this point and with no laws protecting you from that and also sad that half of the money goes to the attorneys. It’s seems that all that you go through and suffering is just a gain for the big guys and you may end up with a very small portion. I am glad that I am still here and thank God daily for watching over me. I thought I went through a bad time but I pray for those who suffered worse or at all. I am grateful for anything at this point …. if it ever comes. Good luck with all and may you keep God in your sight.

    I have been working on my case for a year and a half after suffering a DVT in 2004. I was provided with samples of Yasmin along with a prescription. Because I have no proof of purchase, Bayer is denying my case. I have doctor and hospital records indicating Yasmin use at the time of my DVT, but because there are no pharmacy records I’m at a road block. I’m just curious if anyone else received samples and has had any success. Your advise is appreciated.

    I am a survivor my symptoms started as cold like symptoms. Clamy, weak, eyes where yellow, was sent home from work treated it as if it was a cold. In the middle of the night I went to get up and go use the bathroom and I could not move paralyzed. I called out for my husband who ran to me tried to lift me but the pain from his touch was unbearable.. I was rushed to the emergency room 5 blood clots on the left lung and 2 on the right to hear the Doctor say to my husband we do not know how she is still alive 32 days in the hospital could not get my inr and ptn normal heparin shots, coumadin, lovenoc shots in the stomach, had a hysterectomy and due to the clots I can not longer take synthetic hormones my life is unbearable at times, facial hair, voice changing and I am only 40 years old!

    @ Janine- this is absolutely crazy. I thought I was done but received a proof of rep form from my attorney this week for the PLRP and Medicare. I have never been on Medicare in my life. This is a travesty!

    Nicole: My sister died after taking Yaz (large PE in her lungs)…she too had samples of Yaz but no prescription….it is not stated of exact date on her records that she had taken Yaz 30 days prior to her death, although we know she was taking Yaz up until she died….she died before her next scheduled appointment with the doctor…..not sure where the attorneys are going with this next. I too would appreciate any information any one could give me if they have had the same experience.

    Ok looking for some information..cannot get thrum to lawyer to ask…they avoid my calls (I know they are busy but some validation would be considerate)…the last thing I signed was a paper that insurance could get their cut (actual
    middleman handeling the negotiation of that)…then was told they (lawyer) were to meet with bayer lawyers in April…told that went well for 27 in my case..then told they would call me about the end of may with an offer…..that was the end of my communication with anyone…..I’m still waiting…haven’t heard a word…is this normal? What’s the process from here? How long?

    @Austin – Do you know if the Canadian Class Action lawsuit will or is having any affect on those U.S. cases that have not yet settled? I’m curious to see if Canada does anything to pull the Drospirenone pills off the market even though Health Canada gave the same results of their review of the pills as the FDA did (big surprise there).

      @Mrs.T – I am not sure I entirely follow the question, but any litigation in Canada would not have any effect on the lawsuits pending in the United States. It is possible that if there are changes to the regulation of drospirenone birth control pills in the U.S. or elsewhere it could impact settlement values on individual cases that are not yet resolved.

    Prayers for you Sharon. Possibly try homeopathic…I use electrolyis for years and has helped the hair growth calm down..I totally know your pain and am glad you survived. It was like getting shot..Still hurts to breathe deep. This whole scene with this medication is unbelievably evil. I hope this company shuts down. I for one am trying to reduce my use of any medications through diet, no salt usage and exercise. I do not know any other way then to eat natural and treat myself with the foods God put on this earth as well as seek natural remedies…Apple cider vinegar…every day…potassium foods and I have to drink it..but trying…Prayers for us all..

    Wow, my experience sounds shockingly similar to many individuals on here. I was given a 3 month trial of Yaz by my Gyno. Approximately 2 months later I had developed a DVT in my subclavian vein at the ripe old age of 25.
    Fast forward to present, and I was just notified by my lawyer that my case reached a settlement (although they couldn’t tell me the amount). The overnight’ed a release form and lien for me to sign which I promptly did and sent back. Since then its been crickets. My lawyer told me she had wasn’t sure when they would know the amount of my settlement but that the next steps usually take about 6 months so I guess I will just wait and see.
    Everyone please keep posting with updates and any status changes you may be experiencing.

    @ Nicole – I did not hit any roadblocks in reaching a settlement due to taking samples.
    The biggest issue for me was remembering WHERE the Yaz came from. I called every pharmacy I could possibly think of but could not locate any existence of an Rx. Then I remembered that I was actually given Yaz packets as a sample. Once I remembered who and where I received them from it was smooth sailing.

My lawyers office told me that alll im waiting for now, is a check from bayer… Not holding my breath either, would be helpful to know something:/ Thank you!

    @Spot – you may be in the same cluster of cases that I am in. I received the medical paperwork which I signed and sent back. I was told that 27 cases were settled and that we would receive paperwork in a couple of months laying out the proposed settlement. I actually called last week and was told they are trying their best to get the paperwork out to everyone as quickly as possible. I am hoping to get that paperwork from them this week or next week.

    @Roxanne – thank you for responding. I know they are extremely busy and most likely overwhelmed with paperwork. I would just like an update…..how much to expect and when. It is a shame that there even has to be a case against Bayer but they have damaged so many lives. I wish I could go back and not have ever taken Yazmin…….I continue to have leg pain (almost daily), my left leg is larger due to the DVT,I have swelling in both legs, I have had gall bladder issues in the past, weight gain, increase in blood pressure, headaches, and now thyroid issues. Honestly, I blame all those issues on Yazmin. I had absolutely no health issues before taking that awful pill. Money will never give us back what was taken but I hope it makes an impact on Bayer and a statement to other women out there looking for a safe BC to take. Please continue to post any new information you get and I will do the same. Best wishes to you all.

    @Spot – just a quick update. I was called by my law firm last week so they could verify some of my information. The cases were being sent to the person in charge of basically reviewing each case and figuring out how much each person should get. They were trying to send the paperwork to this person/company late last week. They are hoping to have this process completed soon! I will let you know when I have any other updates.
    I suffered a stroke back in June of 2011. I was hospitalized for 8 days and basically was out of work for almost 6 months. I was terrified that I would have another stroke or that a clot would kill me. I am happy that the process is almost over but it has taken a long time. Good luck and I will keep you updated!

    Oh roxanne I am so sorry……I hope you have recovered to some degree……although a stroke can be devestating and being completely normal again can be tough (although I nave not had a stroke.. I am a caretaker for someone who has suffered a stroke)….my thoughts and prayers are with you. Thank you for the update…..I hope this is over soon. Blessings to you!

    I am now 24 years old. I had my gallbladder removed (after 8 months of many many gallbladder attacks and trips to the ER) This was when I was 18. I have still not received ANYTHING and was told by my lawyer it can take many more months until I do. I was told it will be between 800$-1,000$.

    @Austin – If we are a plaintiff living in CA (whose lawyers are also in CA), but the claim is ultimately filed in Illinois as part of the MDL, which states’ Subrogation Laws or “Made Whole” doctrines are enforced?

      @Mrs. T – Certainly discuss this with your attorney to evaluate specifics in your case, but if proper venue for the case was California, that state’s law would apply to the case, even if the matter was subsequently transferred into the MDL or directly filed in the MDL. However, health insurance subrogation requirements may be impacted by the state where the policy was written or the terms of the agreement.

    Its so comforting to hear that others still struggle with the after effects of pulmonary embolism. I just thought I was losing my mind after numerous trips to the ER thinking I was dying when in reality I’m just experiencing anxiety 2 years later. Has anyone heard of a timeframe or deadline for the settlements??? Seems like this is gonna drag on forever…

    Has anyone tried using their state’s “Made Whole” doctrine to fight against insurance companies’ Medical Liens? I don’t remember there being a clause in the PLRP agreement against it.

    Anyone know of any law firms taking cases that happened after label change. I was not aware and suffered a DVT last month. Was in ICU for four days, had a IVC filter placed. Had an 8 inch blood clot from my belly button to hip, whole Iliac vein. Any advice is appreciated!

    FINALLY, they called and said they were putting a check in the mail today. I paid $25 fee for them to Fedex it to me.
    Still holding back a small percentage (that I will get later- don’t know when) but I’m VERY happy to finally be getting SOMETHING. Took eight months from the time they made me an offer…hope that give someone hope.

    Product-related litigations
    Yasmin™/YAZ™: As of July 8, 2013, the number of claimants in the pending lawsuits and claims in the United States totaled about 5,400 (excluding claims already settled). Claimants allege that they have suffered personal injuries, some of them fatal, from the use of Bayer’s drospirenone-containing oral contraceptive products such as Yasmin™ and/or YAZ™ or from the use of Ocella™ and/or Gianvi™, generic versions of Yasmin™ and YAZ™, respectively, marketed by Barr Laboratories, Inc. in the United States. In Israel, one class action was served upon Bayer in June 2013.
    As of July 8, 2013, Bayer had reached agreements, without admission of liability, to settle the claims of approximately 6,760 claimants in the U.S. for a total amount of about US$1.4 billion. Bayer has only been settling claims in the U.S. for venous clot injuries (deep vein thrombosis or pulmonary embolism) after a case-specific analysis of medical records on a rolling basis. Such injuries are alleged by about 2,800 of the pending unsettled claimants. Bayer will continue to consider the option of settling such individual lawsuits in the U.S. on a case-by-case basis.
    In March 2013, Bayer agreed to settle, without admission of liability, lawsuits in which plaintiffs allege a gallbladder injury for a total maximum aggregate amount of US$24 million. As per July 8, 2013, about 8,800 plaintiffs have decided to participate in the settlement, which represents more than 95% (90% participation required) of the eligible plaintiffs, so the settlement will go forward.

    I spoke with my attorney the other day and was told that we were just waiting for Bayer to release the money…I was originally told we would be receiving the money in July…so perhaps it is coming soon. It’s nice to hear that some people are actually getting checks because I was starting to wonder if this was all for real or not…

    I have been in this lawsuit since 2007. I had DVT and then bilateral PEs.
    I still have no offer. I’m losing hope of ever getting one.

    Good News!!!! Recieved my check yesterday.

    I was originally informed back on July 12th that the check was mailed out sometime that same week. It wasn’t until 2 weeks later that something wasn’t right. They either didn’t mail it out, or it was lost with in the USPS system. Anyway, they cancalled the first check and sent another one out via FedEx Priority Overnight…..why they didn’t do that in the first place we will never know.

    A word of advice, please be sure to get a tracking number from the attorney. The first check was sent out regular US Postal mail without a tracking number, so there’s no telling where it is.

    Hello – I’m new to the intensity of this comment page (which is pretty amazing as it is one of two places on the internet with actual information as well as personal experiences with this crazy process). After reading all of these comments, I consider myself lucky as I am at the stage where I’ve already accepted the settlement, signed the Bayer release, agreed to participate in the PLRP program, and now am just waiting to receive the first portion of my settlement (though it sounds like it could be an endless wait). How long of a wait have people experienced? Like so many others, I have a lofty list of debts I’m eager to use my settlement for (mostly hospital bills and student loans) and I just hope to I will receive part of my settlement by the end of the year.

    I had my bilateral PE almost two years ago to the day (this Friday is the anniversary…how exciting -_-) when I was 21 years old. I was a non-smoker, not obese/overweight, not a Leiden Factor 5-er, and in perfect health until that day. I still deal with the day to day fear and anxiety of never knowing what the lasting effects of Yaz are and if/how it could affect me in the future. It’s SCARY! I just hope we can all find the closure we so badly need <3

    @HLC yes 15% hold back, @Casey it took almost 8 months only because of Bayer and the lien process was not clear. I think the timeframe for settlements is smoother now for the new cases.

    Still waiting on my other half because I did not owe any hospital or insurance bills because the VA paid my hospital bills.

    I signed all of my paperwork in February 2013. I called my attorney mid-July. I was told that my insurance wasn’t going to take any money and they were just waiting for a check from Bayer (which they expected in the next 2-4 weeks) and then they would send it to me. I haven’t received any check as of today. I had a doctor’s appt last Friday. I was told that any time you have a venous blood clot, that it “roughens” the lining and I will most likey continue to experience swelling in that limb. I had hoped that it would heal over time and this increased swelling would get better. I will have to stay on a diuretic for the rest of my life. Now I understand why the attorney wanted to know about any medications I have been prescribed since the dvt. We need to be careful how we spend/invest the settlement, as we will most likely be experiencing continued side effects from this drug. I pray for all of us…..

    I developed a dvt and bilateral pe’s after taking Yaz for 8 months 2007/2008. I had no idea what what was wrong with me. For a few months I was having a hard time breathing. One morning I woke up and tried to get ready for work and passed out. An amulance came and after they took me to the hospital, they found the dvt/bilteral pe’s. I filed a suit about 4 years ago. I was offered a settlement and sent my release to my attorney’s office beginning of june/2013. My attorney’s office said that I should have received the monies a month ago and now they are saying that they are still waiting for Bayer to release the funds. They say it should be any day now. I was wondering if anyone else if having the same problem and if they have any answers as to why bayer has not released the funds?

    I experienced several clots (dvt) in my lower left calf and was only seen in the er. I do have factor v which was discovered during tests after released from the er. I am on aspirin therapy for life and always worried about another clot. Long story short, I did receive a settlement offer and it is a joke. Because of my age (40+) and the fact that I was not actually hospitalized, my offer is horrendous. Do not believe that the “average” is $212, 0000. There were 26 of us and the payouts were anywhere from. $50, 000 – $284, 000. I am turning down my offer!!!

    @ Kathryn- It seems as though the process had went fairly quickly for you considering your issues was only two years ago. How long have you been part of the class action? I lost my wife by bilateral PE’s back in 2005. Granted, I did not jump onto the class action ban wagon until about a year and a half ago. Where is the other site that you receive information from?

    I wish many of us on this blog could share email address so that we can compare more detailed information in regards to this case. I wish everyone the best of luck in their search for some sense of closure.

The paperwork arrived in the mail exactly 2 weeks later for my review and signature. Does anyone know approximately how long after the attorneys’ receive the paperwork does it take to see a settlement check? I was thinking 3 to 6 months. Is that a fair assessment?

    I suffered a massive brain stem stroke from Yasmin in 2005, my case has been pending for 6 years now….I was told that Bayer is not currently paying out on cases of stroke, only cases of dvt or pe. I was wondering if anyone who suffered a stroke from yasmin has recieved a settlement yet?

    I had a clot and bleed dec 18, 2007, 5 days after my 30th birthday! Way too young, just started rocking in my career, as a mens hairstylist. I was left paralyzed on my left side for months, did intense Ot,Pt, and speech therapies. Thank the lord I have a great support system, and was able to receive disability, which I’m still on. No amount of $$$, will give me back anything. At this point, I don’t want or need anything or anyone from my past , \hat I lost. I would not wish my situation on my worst enemy,I don’t want anyone to ever have to go through it. I thought I was being responsible, trying not to get pregnant, in return, for not being able to bc I’m too high risk to bleed out or clot!

    @Amanda – I had a stroke back in June 2011. I recently was told that an offer was made on my case, along with 29 others. I received the paperwork and have signed it and sent it back. I, as well as 3 other individuals in my group, suffered a stroke. It is my understanding that they are taking cases in lumps of 20 to 40 and trying to settle them that way. I am so sorry to hear that you suffered a massive brain stem stroke. I wish you well and hope you hear something soon about your case.

I was told at the end of July that they had received confirmation from Bayer that everything was done and they anticipated receiving my settlement check within 2-3 weeks.     My daughter is a heart patient. Born with a very rare heart defect that only two hospital’s could operate to repair here in America. One in Houston, Texas and one in Indianapolis, Indiana. Indiana children’s surgeons flew to Houston to learn the procedure on a girl about a year before our daughter was born. My daughter has never smoked; never drank; never been sexually active. I know this because after numerous hospital errors through the years, my daughter has been on total life support; they lost her five times; sent home a vegetable. She has been blind for two weeks following her first open heart; given a pacifier in an infant unit from a child who was recovering from spinal meningitis; and I have seen my share of errors in the medical field. She was put on Yaz for messed up periods. Since the day she went on Yaz, she has had multiple problems. Lung problems; going down her jugular vein to take a biopsy of her liver; heart failure; liver pressures and heart pressures too high; severe pain in her abdomen; later gall bladder removal and finally a blood clot that broke from her leg and they had done a D-dimer test to verify this; threw her into heart failure again. My daughter cannot talk due to previous doctor/hospital errors. After seeing the commercials, my daughter and I made an appointment to have her taken off of Yaz as she was showing too many signs and we had concluded this one medicine was the root of all of her pain and troubles. Her doctor felt it best to leave her on it. A little over two months later when she was experiencing heart failure and nearly having another stroke;I took her off of Yaz. Her test results supposedly got lost between hospitals; she will never receive anything from the clot or all of the pain and tests she endured. Her heart was found to be bleeding more from the tear of the clot going through her heart. I am devastated to hear this drug is still being made or sold by Bayer. My daughter will never see any money because of errors; but we would have rather not had the suffering she endured because of this drug. Her problems from this drug still impact her life today after being off of this drug since September 2009. If you are prescribed Yaz or any of it’s relatives; say no. Bayer, the FDA and America should be ashamed and made responsible for the life altering devastation of these drugs they use on human’s to more or less test, knowing that they will make enough profit in the run to settle some meaningless class action suits. Everyone needs to stand up and be heard. These dangerous drugs to help people are actually life threatening and should be stopped.

    Just wanted to give those waiting there is light at the end of the tunnel I orginally received my settlement offer over a year ago and just received a partial payment. The process is long and who knows how long before I get the rest but, for those of you that just signed paperwork don’t expect anything within a few months I would say at least a year minimum there are lots of hold ups in the process. Hope this helps some of you.

    (Very long story summed up) I am currently 21 years old. I was 15 when I started taking yaz to help with my horrible periods. I wasn’t a smoker and not over weight. About 2 months after taking yaz I had horrible back pain and struggling to breathe, I even started to stop breathing in my sleep. Went to the hospital and ended up having multiple blood clots in my lungs.lots of pricking and proding later I was put on lovenox for 2 month (daily needle injections) then onto koumadin. (Pill blood thinner). At 17 I made my claim against them and have been in the process since! At 19 I got pregnant and due to the blood clotting I was again put on 2x daily injections, to keep my or baby from a clot. Had my baby and 2weeks later I got more blood clots and an infarction on my lower left lung (some of my lund died due to a clot cutting offblood flow) I now am on koumadin for life and may not be able to have another child due to the high risk of clotting while pregnant due to this horrible drug!

    @ Jim – you are a complete idiot. I never smoked a day in my life – ever! I did and still do lead an active lifestyle. Yaz caused a DVT in my right leg. 3 years later, I have a second DVT in the same leg. And now I’m on blood thinners – with all of the complications – for the rest of my life. Screw you and screw Bayer! I’m just thankful after reading all of these horror stories, that my story didn’t end with my children being motherless.

    I finally heard from my attorney’s after sending them so many e-mails. i signed my plrp agreement in March. They finally audited my insurance claims and adjusted to zero since i lived in Arizona at the time of my injury. They are waiting to hear from the insurance company for the last 3 weeks.

    @TC I don’t know of anyone who has borrowed against their settlement but I would HIGHLY RECOMMEND NOT’ to DO THAT. I received my settlement check and there will be A LOT of deductibles for this and for that so you will not know how much you are actually getting until you get the check in hand. PLUS the lien hold may take an additional 9 months to get that portion of your check. Please beware of anyone wanting to give you a loan against your settlement. You just might get into debt doing it- which all a loan is – is debt.

    I started taking Yaz in 2008, for cramping only then in Jan 11 I had a severe headache, landed in the hospital with venous sinus thrombosis – two blood clots in my brain one in my jugular – I was hospitalized for 7 days, 3 days in ICU – they performed a surgery called TPA. They threaded medicine starting in my groin up to the clots in the back of my head sinus area left quadrant in my head and jugular vein to break up the clots. I could not be given any type of pain meds while in surgery as they had to be able to speak to me – most severe pain I have ever endured. I was on coumadin for 6 months. I just heard that the attorney has presented the settlement to Bayer this week and should hear in a few weeks on what the offer will be. Please dont take this drug. I was lucky that I didnt die, as I heard most people with what I have had died or had massive strokes.

    Even after reading all the comments there still seems to be no clear timeframe or rhyme or reason to how this process is actually done. Austin I would really appreciate if you could let me know what my attorney rep means when he says they are waiting on Bayer to release the funds. Who does Bayer release them to, the attorney or Garretson? @TC I sadly got sucked into a loan against my settlement and the admin at my attorneys office put it in motion and come to find out she was FIRED shortly after so now my attorney is telling me that it will put a delay in my lien process!! UGH my attorney said that the admin processed paperwork for over 20 pre-settlement loans and none of them were aware of what she was doing. I signed my PLRP paperwork in aPRIL/May of 2013 and my attorney rep is never ever accessible and last we spoke he said they are still waiting on Bayer to release funds which he still hasnt explained to me what that means

    Just wanted to share that I got the second part of my check a few days ago (the 17. 5% Lien hold) it took 3 months from the time I received the large check, so now my case is officially over.

    I am a 36 year old woman. Up until I got very ill at 27 I was fit and well like all my friend were BUT one day I got really sick for weeks and I knew something was wrong and I wasn’t going to hospital as I didn’t think I was that sick until a really close friend of mine said she was going to call a ambulance and get me to hospital weather I like it or not. When I got there I go put straight into high priority next to someone who had just had a car accident and someone who was having a heart attack. That’s when it came to me I was really sick the next thing I was put into intensive care and then the doctor came to see me and said IN THE MORNING YOU WILL BE HAVING OPEN HEART SURGERY. And this was just the start of things to come!!. After the operation I was in hospital for a little over 6 months and that’s when I moved down with my grandmother (in Tasmania ) and that’s when I found out I had EPILEPSY and then before you know it I was in hospital again for my second open heart surgery then 3 months lather I had my first STROKE then I decided to move back home with my mother after about 4 weeks of being home I had my second STROKE and then I found out I was PREGNANT and then I had to be induces at 32 weeks as it was to much on me and my heart and the baby plus I had to give myself needle twice a day to thin my blood as normally I am on warfarin but warfarin is no good for the baby plus it can cause birth defects so the less warfarin the better. It was a really very hard pregnancy but it was not to much longer and I was PREGNANT again and this one was just as bad if not worse as I didn’t even get a chance nor a break from rack baby PLUS I had a stroke midway through this pregnancy AND they came on the same year my little girl January 2009 & my little man December 2009. The doctors tired my tubes the very next day but I don’t care I have what t want I’m happy and I did it all naturally NO EPIDURAL, NO GAS, NO NOTHING, ALL NATURALLY . And for someone one with a heart condition I think I did really well even if I do say so myself .

    First, this blog has been so helpful & I truly appreciate everyone sharing their stories and the information they have around the process. This whole experience is something none of us should have had to go through in the first place. I ended up in the hospital 4 weeks after my 30th birthday with 3 large clots in my left lung, spent days in the hospital and months on coumadin, not to mention the weekly visits to get blood drawn and the constant wondering what every single pain I felt was and if it was happening again…so scary and still is. I started the process last October, received my offer at the end of April, received my settlement papers in July which were returned within days. I did opt into the PLRP and I was told by my attorney that it should only be a few more weeks.

    Does anyone know if Bayer changed the process for the lien resolution program? that is what I am being told regarding the delay in receiving my remaining funds. I was under the impression from the paperwork received once an amount of the insurance lien was determined that remaining funds would be released now I am being told they need to be paid and insurance companies need to sign a release for you to get your remaining funds. I don’t understand how they can change a process when I signed an agreement that did not state that. Also I don’t think its fair we are at the mercy of a health insurance companies that we paid to cover medical costs and who did not have to pay any legal fees to get money from our settlements. Also I see above that someone asked how much the insurance company took, for me it was 50% of my medical bills of my care for the injury related to my case which was equal to 11% of the 17.5% hold back, or equal to about 2% of my overall settlement but this will depend on your medical costs, your insurance companies claim for charges related and the audit process done by Garretson. However allowing the Insurance companies to get a windfall like this is just a shame in my opinion, if they can get money for medical treatment I technically paid for then they should have to redistribute funds to me that I paid over time and didn’t use, however if that was the case I would be the one getting money, or at the very least they should have to pay a percentage to the attorney fees.

    @PBD I agree with you! I signed settlement papers in January and have been told the insurance company has to be paid before I receive a dime. That is not what the settlement papers said. My insurance company has been reimbursed triple fold for their costs 10 years ago through my premiums which average 6k a year. I am so disappointed in this entire process. To date I have not received anything. It will be a year in January

    I received a portion of my settlement within 3 months of accepting the offer. They held 15% for the liens. Looks like this process is not consistent with all the claimants. They may have changed the rules somewhere along the process.

    I did receive a portion of my settlement in February of this year, the remaining was supposed to be released to me upon determination of my final lien amount, which was determined in June. From what I understand now the process has changed and no funds will be released until the the lien amount has been paid, the insurance releases us of any further obligation and the defense reviews this release. (I don’t know how this applies to people who have thus far received nothing from their settlement). Of course this still makes absolutely no sense to me as they know what my final lien amount is and was agreed upon by the insurance company so I don’t understand why they need to retain anything in excess of that. You should refer to your settlement papers as they may have been worded in a way by the defense which is contradictory to what you signed in the PLRP agreement resulting in the new change, in my opinion it was still very vague and not described as what we are now being told.

    My atty rep keeps telling me Bayer will release the funds to Garretson once they have fulfilled any liens, so it sounds like things have changed because if thats the case I should get one lump sum minus any liens VS a portion here and there.

    I called my attorney’s office today. Was told in June 2013 that no liens were placed and all of the paperwork was sent to Bayer and I should have my check in about 2 weeks (which I figured really meant at least 6 weeks). Today I was told that even tho my insurance and the government denied to place any liens and Bayer had all of the paperwork, that Bayer had decided that they needed another letter from the insurance company. My attorney said that they provided that letter to Bayer 2 months ago and they weren’t sure why Bayer hadn’t released the funds. They did offer to release a partial payment if I would like. They said some people didn’t like to receive the partial and preferred to wait for the full payment. They said it would take about a week for them to transfer the partial payment and then send me a check. Since they have access to the funds it makes me question why they haven’t at least sent, or at least offered to send, the partial payment. Has anyone else had this sequence happen to them???

    Update, I received an email from the attorney today stating that they received authorization to distribute funds. and that I should receive in the next 10-14 days. Crossing my fingers….I will keep you informed. I called to ask if it was a partial payment or the lien process was complete and the secretary said she didn’t see anything about a partial payment, but honestly every time I do speak to someone they never sound like they know what they are talking about!

    So I found out that Garretson is not handling my lien process. The firm is using James Street/The Plaintiffs Resource. Has anyone dealt with this group? I was under the assumption that Garretson was handling all of Yaz but I guess that is not the case?!?! Still so confused~

    I hope that they get this dangerous drug off the market SOON! I had a superficial clot in 2009 — about 1 1/2 years after starting Yaz for PMDD. By then the commercials were airing so I asked my doctor if perhaps it was related to Yaz and did I needed to come off the Yaz. I was told no–Yaz only affects the deep veins. (Hello—where do you think the DVTs start?? I didn’t know it then but I know it now and the dr should have known that). I was not refered to a specialist, but iIt scared me though so I tried natural hormones for about a year before going back on the Yaz to manage things better. My doctor said it was safe as I wasn’t a smoker.
    It only took another 1 1/2 years and then another clot. This time I was 24 hours away from getting on a plane. I knew something was wrong and because of the 1st experience I knew I could not put it off til after the trip like I probably would have done since it was a very inconvenient & stressful time. I ended up in the ER. I was not allowed to drive or fly. I followed the ER doctor’s instructions and I went to a vein specialist ASAP. (Irony is that at the time this happened I already had an appt on the books to get my veins checked out—for 13 days later) I did everything they recommended and in 1 week’s time watched it move to from behind the knee to 1 cm from the femoral artery. I was so upset as I had done all they asked (including immediately stopping Yaz) and it still moved about 2 feet in 1 week! So then followed the shots and the Warfarin and weekly lab visits as well as the lovely thigh high compression hose …. They told me that I came in early so we were watching the process of it trying to become a DVT. The 1st clot experience probably saved my life as I knew I couldn’t put off getting it checked out . I am very thankful I did not wait!.
    I was so mad when I was told by the vein specialist that I should never have been told it was ok to go back on the Yaz in 2009. They told me that it used to be they would see a young woman come in maybe every 3-4 months with a DVT—in the old days; now with the new 4th generation BCPs they see one every 3 weeks or so—young otherwise healthy women. The common factor in all is 4th generation BCPs like Yaz, Yasmin, Ocella, Gianvi etc. They said Yaz was a very bad drug and they expected it to be taken off the market soon. I was so mad I filled out an on line form for a lawyer. They called and e-mailed me for 9 months before I finally sent in paperwork. I just didn’t think I would have a case since I narrowly escaped a DVT and the last year I had used generic Yaz (Gianvi) due to insurance not paying for Yaz.
    It took a full year of waiting for my veins to be healthy enough and then having the medically necessary procedures done to fix my veins — EVT in both legs and phlebectomies in the lower portion of both legs. I have to at a minimum wear knee high compression hose now and thigh high when I fly, travel long distance or do a lot of walking. And yes, I do honestly know how lucky I am— as inconvenient and hot as the hose are.
    I am awaiting a settlement—according to my attorneys there has been an offer. I have seen nothing in writing as to the $$ amount—just a verbal amount quoted by my attorneys and reams and reams of paperwork that I had to fill out defense attorneys. (It literally took me about 10 hours or work to pull together everything they were asking for) The disturbing thing to me is that the law firm will take 45% plus 5% for expenses. Then federal law requires them to hold 30% of the remaining for my health insurance to make claim against it for claims they paid related to the Yaz damage. So I will get only 35% of what the attorney’s received. Yes, it’s better than nothing, but I wonder if Bayer thinks that my case is worth “XXX” and I’m only getting “X” and you know that they don’t factor in for attorney’s fees…… I wonder what long term damages could later surface that I am not aware of?? I can’t believe the law firm gets to take so much from every person and we may not have enough to cover any future medical needs related to Yaz. It’s just disturbing to me, but then again I pause while I pull up my compression hose and remind myself that I am one of the lucky ones.

    I posted back in March and I have an update. On September 13th I received my release papers with a settlement offer. I was told countless times that I would receive an initial check before the end of the year. It’s been the same story for well over a year. The clock is ticking and I really think that is not going to happen. A rep from my attorney’s lien resolution group called me last week but I missed the call (of course), but his message said they were currently working on the lien and to call him back if I have questions. I definitely will call him back. I am very nervous that I won’t receive some sort of check soon because we are in a ton of debt and won’t be able to sustain for longer than a month. We’ve planned to receive our check (the first one at least) by this month since they always said it would be here but I know that is not going to happen. How long did it take from the time release papers were signed to get a check? I signed plrp paperwork back in March, 6 months before my release papers. A lot of people said they didn’t receive their plrp paperwork until after their settlement offers. I was hoping the lien resolution would be done in the meantime but of course it wasn’t. We had to take out an advance against our settlement, which I regret, but we had no choice. It was either that or file for bankruptcy. We want to move forward when this is over, not be stuck in bankruptcy with no credit for 7 years at least. I plan to email my attorney rep tomorrow and ‘demand’ answers (in a nice way of course). As long as a settlement is received by mid-March, not a lot of interest will accrue on the advance.

    THE GALLBLADDER HAPPENED TO BE LIKE STONE. THEY CALLED IT CALCIFIED GALLBLADDER. WHICH I GATHER IS VERY RARE.

    UPDATE- I spoke to my actual attorney today (rather than the usual paralegal) and he wanted to tell me that my ccse is pretty much complete. I will NOT have to repay BCBS…hallelujah!!! Apparently I will not be able to get the full amount until January, however they are authorized to pay partial immediately. I should be receiving an email with the breakdown tomorrow morning (12/13) and something to sign. Once i return that, they will send request for partial payment (- lawyers fee and 30% for lien, even though I don’t owe) to QSF. They (QSF) are apparently mailing checks on the 17th. Could it be? I will wait and see…..and of course I will keep you all posted. I think this is he first time I actually feel like I have a clue what is going on!!

    I experienced a blood clot in my lung back in 2005 after only taking yazmine for a month at the age of 19. It was suppose to help with my acne and regulate my periods according to my doctor.But I spent a week in the hospital and was on coumadin for 6 months. B/c of the clot I’ll have a high risk pregnancy and can never take birth control again. I took part in a lawsuit back in 2009. I got my first payment in April 2013 and still waiting for the rest of it. My insurance covered everything so I didn’t have to pay anything back. I hate reading these stories of lives being lost and severe illness caused to others b/c of this stupid drug. I really hated seeing the commercials when they just called it yaz, as if that had made it better. I pray everyone of you on here receive your funds. It hasn’t been easy, but getting this money will help me and my family. This wait is just so hard, it seems unreal.

    I finally received a partial payment this week. The firm representing Bayer is insisting on a particular letter from my insurance company before they will authorize the release of the 15% holdback! even though all insurance firms have declined, in writing, to require repayment! I started the paperwork 15 months ago to give some perspective. I signed the settlement paperwork in July 2013. I was in the 5th settlement group. @ Jazz, I don’t know how many were in my group. The attorney’s office did not know how long it would take before Bayer would ok the release of the 15% holdback. I found it interesting that my attorney is in St. Louis, the original case was brought there and yet my check came from an attorney in Baytown, TX.
    I am confused in the amount of the settlement. The attorney gave me an initial settlement amount. When the paperwork arrived, it was a little higher amount. When I got the check, it showed a third, higher amount! How do I find out for sure what amount Bayer really settled with me for?
    @CAM – my family physician has told me that once we have a clot, that the clot “roughens” that vessel and we have an increased risk of developing another clot in that vessel. Unfortanely, we will live the rest of our lives under the threat of another clot. We must be smart and vigilant.

    I GOT MY 1st CHECK!!!!! Woo-Hoo…..God is good! So timeline for me was settlement offer/accepted in February 2013. PLRP paperwork signed late July 2013. A secondary Medicare paper signed September 2013. Signed breakdown of fees, etc. 12/13/13. Check was cut from QSF on 12/17/13 and mailed 12/19/13. Received 1st payment 12/23/13. I will keep everyone posted when I hear word of the next check. Hope everyone has a happy, healthy and safe holiday!

    I passed 5 bloods through my heart and into my lungs. Thank goodness I was healthy prior to such an ordeal. The mental side affects from anxiety, thinking it could happen again are horrible. I went almost immediately through menopause at 41 from the post traumatic stress. Never a hot flash or anything. Just done with it all. Some may think that’s great but not so much. As a result of early menopause, I may no suffer heart disease and early Alzheimer’s. Not to mention that my 7 year relationship was ruined because I couldn’t bare children and was emotionally a wreck. 7 years later, here I am. Still not a penny from the lawsuit and still worry about it happening again. I’m sorry to all that have experienced this along with me. I will never forget what happened and not a day has passed that I don’t think about it.

    Be weary everyone waiting on a final payment in regards to liens being handled. The attorney we went with after choosing to send a general letter and waiting 180 days only to find out they handled it wrong. To do another general letter we are looking at another 180 days. Thats assuming our attorney won’t screw it up again. My advice is be as involved as possible. Request copies of e erything and check their work. Our situation they sent to wrong address and didn’t use a middle man. Both mistakes require the entire six month process be repeated. The attorney dosent care they already got their 40% payment. Be diligent people some attorneys suck.

    Amy I see you posted in regards to the lien process. Garretson is to handle all the letters being sent to ins. Companies. Maybe there are more “middlemen” I’m not sure but I know our attorney sent the letters themselves and after waiting the full six months we find out they used the wrong address and were required to use garretson. Now we need to do the entire process again. Oh and since the first letters went out incorrectly one of our two ins. Companies joined the 15% cap list so we are required to contact them directly. This will have a faster outcome but is not how we originally planned to do it. Thanks a lot crappy attorney at least you’ve been paid eh.

    Are any viewers of this blog having their class action suit settled with a firm in LA, Calif? If so, have you gotten any where with your case? Trying to get updates is dang near impossible. Lost my wife back in ’05 from bilateral PE after being on Yaz for a few months. Waiting for some financial relief from the madness I had experienced due to her loss would be nice. However, I am beginning to question if it will occur at all. I can be patient, but I would just like an update from time to time.

    I know my attorney did not send letters directly to ins. co. They are using James Street/The Plaintiffs Resourse. I actually spoke to Garretson directly (before I realized they weren’t handling my lien) and they confirmed that they are not solely handling Yaz related claims. This process is a long, sucky one and I hope you get closure soon.

    I am so glad to come to see this page. Yes,I am one of the victims that took YAZ! Started in my legs broke off to my lungs.hospitalize for 10days..horrific/horrible! Still to this day suffer shortness in breathing when walking and sometimes some pains come and go in my legs omy! Never for get passing out at the Fiesta Casino in vegas “Death” I was told it was not my time yet (:…I still carry that box that carried yaz just hoping one day I can throw it in the maker of it face!!!!

    I took Yaz over 9 years ago. I have not really had insurance until recently so every time I would say something is wrong with my stomach the doctors would just blow me off. Well I went to the er less then a week ago with my left leg severely swollen and a lot of pressure and pain. Come to find out I have a blood clot between my abdomen and belly button the size of my hand. I had two surgeries in the hospital one was
    To try and break up the clot and the other was to put a filter in so the clot couldn’t get past a certain point. Next week I have to go have a stent put in to make sure this doesn’t happen again. I just started filing my law suit. I am supposes to hear from the lady tomorrow. Please prey that this all works out.

    I finally received a partial settlement check. They are still holding 30% for liens. Total time,,, one year. Signed the agreements in December 2012 and January 2013. No word on the final payment. I’m just glad I received something. My insurance carrier is contesting my lien amount. They are trying to claim over 50k in charges. Many of the charges are unrelated to the medical event. Good luck and stay in constant contact with your Attorney. It will not be easy as they appear to be very busy.

    I received my first settlement check. I signed all of my release paperwork in or around the spring of 2013, was given a settlement amount around September 2013 and received my first distribution on January 27, 2014. They are holding back around 35% of my settlement to be sure all the medical liens and other charges get paid back. I suffered a stroke back in June of 2011. I think the process is getting better with each group of cases that settle so I can only hope that all of you will hear something in the near future.

    To say that I’m totally dissatisfied and disgusted by this entire ordeal is an understatement! First, we are being paid pennies for our pain and suffering and near death experiences as is the case in my situation and on top of that, we have to pay medical liens out of our settlements and then on top of that wait eons for our money!!! I had my pulmonary embolism 4 years ago in January and have yet to get a dime. I was contacted in October, 2013 saying that an offer had been made which I accepted and I have yet to even receive my settlement papers from the defense almost 4 months later!! This whole process does nothing to serve the injured and just further victimizes us. I just want to conclude this matter and be done with this entire travesty!! My prayers and love to all that have been harmed by this awful drug and are going through similar or worst circumstances.

    I’ve had the same issue as you girls had, recently the doctors told me that i got another blood cloth in my leg and I’m really tired of this situation, that is why i filled a suit with an attorney company who dedicates to this kind of lawsuits.

    Hi everyone! I was wondering if anyone had a arterial blood clot? I had an arterial blood clot in 2008 which caused me to have 4 strokes in one day. Luckily I walked away ok. My question is..did anyone with an arterial stroke get a settlement? Bayer is refusing to settle my case it was arterial and not venous in nature. I’m afraid that these jerks are going to get away without having to settle my case. They need to pay for what they have to all of us!

    I suffered from 3 blood clots from the generic brand of yaz(gianvi)! 2 in my groin of my left leg and one in my upper left leg. My entire leg swelled up and I was hospitalized. I could have lost my life like other girls who have due to this horrible medication that is used to get rid of acne. My leg will never be the same, I can’t sleep normally without my leg getting extremely irritating. I can’t sit or walk a long time or my leg swells. I constantly have to lift my left leg when standing for a long time which is all day at my job because I am a dog groomer. It is painfull and tight and I doubt the money I get from bayer will give me my old leg back or that period of my life where I could not walk faster than turtle pace and cried because it hurt so bad to walk. As well as crying every time I got shots twice a day to my stomach so that I could take Coumadin orally. The shots literally felt like fire was injected into your stomach. Couldn’t wear normal pants because they didn’t fit my one leg. Also I had kankles for months which really hurt me. After quitting gianvi my acne got so bad I have scars from it on my face which will require laser surgery. This medication should not be used as a form of birth control nor should it ever be used for acne. Your acne will come back 100 times worse and you could possible lose your life. I took this medication for almost 3 years and then one day the build up in my system got to me. I am truly lucky to be alive

    Hello friends. I have a question for those you who have received money or have knowledge of the process. My attorneys are going with the Garrettson group. Here is my question…if you have 30% kept back for the lien process, is that thirty percent based on the total left after attorney and court fees? Or is it taken from the gross total before anything is taken out? I hear people say the first check is the “large check” but if they take the thirty percentage out based on the raw gross amount, my first check will be smaller than the thirty percent taken out to be held. Thanks for any information on this! 🙂

    Girls, be prepared for a long ride. After reading many posts, I feel that every case varies based on attorneys used, dates cases were filed, insurances, etc. Here is my story… Began paperwork in 2009, just received partial payment in 2014. Yes, 4 1/2 years later. I feel I have a great law firm because they have kept me fairly well informed throughout the process. For the inquiring minds- after I signed my settlement offer, my partial payment came 9 months later. I do not know how long before I know about my medical liens, I had medicaid plus private insurance (my state required 20% holdback). I know that it is a long wait, and I understand how it is to think about your injuries everyday, and the stress that comes along with it. No, this is not going to make any of us rich, but I am grateful that I received anything at all. If it covers your expenses, and you have a little leftover, it is still more than you started with. Stay strong, stay positive…

She was very weak but strong through the whole thing. When we arrived at the urgent care not knowing what was happening they took one look at her and the nurse started praying over her. This really scared my daughter and I. They then called an ambulance to transport her over to the emergency room. Upon arrival and after their speedy assessment they said that my wife was dieing from a blood clot that had released from her leg and had went to her lungs and that I need to make arrangements now because she may not make it another hour. She was never sick. Never smoked anything in her life. We had 2 daughters after being married almost 18 years. I got hurt and she had been strong and helped me for almost 12 out of the 18 years. She went off too the critical ICU unit once she was stabilized enough to be transferred. She stayed there for almost 2 weeks fighting for her life. She was in a induced coma with all of these hoses and tubes coming out of her. I just sat there next to her for days on end getting to know god alot more. Days, weeks went by. She finnaly just out of the blue started coming around. Wondering where she was and what had just happened. In the mean time I was told that her birth control pills had caused all of this. YAZMIN AND OCELLO. Her gyn had been slipping her free samples of the stuff for months. We had no idea it would lead to this. I am a very smart man when anybody in the family was given any kind of med I would hurriedly go to the net to learn of any bad side effects. YAZ HAD NON TO SPEAK OF AT THE TIME. And they were being handed out for free like candy so they had to be OK right? After 2 more different scaled down ICU stays she was finally sent into rehab where she stayed for a long time. My daughters and I got pretty used to mom being in the hospital. But that was OK because they saved moms life. I contacted an attorney and presented everything to him to go after this company (Bayer) for such negligence in the way they got my wife to take that stuff in the first place. Its been almost 5 1/2 years now. Still nothing. My wife is still weak she never was the same after all of this. She sits in her chair all day long and falls asleep most of the day but she’s still here with me! The after effects have been over whelming for her. She has kidney trouble now along with heart murmers. She’s since had almost a dozen surgeries for this and that. She had a temporary clastomy bag for almost a year. She gets winded very easily and when I am close to her I can hear her struggling to breathe.     I was in Group #5 to be settled. I used attorneys in Illinois. I received my first payment after about 14-15 months. Bayer decided that they needed a specific letter from my insurance company, even tho the insurance company waived (in writing) any lien on the settlement. My attorney had forgotten to tell me this info, so I called to see what was going on. At that point they offered to send a check (less the 30% holdback). They said they did not believe the judge was aware of this specific letter Bayer was requiring. Four months later I again called the attorneys’ office. They apologized, I had once again fallen through the cracks, and said they would let the company holding the funds to release the holdback since Bayer had received the required letter. Within a week I had received my final payment.
    I had a DVT behind my left knee. The first check was over 4 times the final (holdback) check. I don’t believe the judge is aware of this holdback for a specific letter after the insurance company has declined any lien. I wonder if this isn’t a way for the attorneys to earn a significant amount of interest on the money Bayer has deposited into these accounts. I have wanted to write him a letter asking if he is aware of this delay…… Maybe I am just paranoid, but after this experience, I find I am a lot less trusting. Just something else Bayer took away from me. I now have to wear compression hose on both legs every day due to swelling. Some days, it feels like my left calf is going to split open it is that bad. I will be on baby aspirin therapy the rest of my life and I have been on a diuretic for the past 2 years, with no hope of ever getting off these meds either.
    The payment I received will not cover my medical bills associated with complications of that clot. But at least it is something. Be smart with the money, we are going to need it for the rest of our lives……. Good luck to all of us!

    It seems strange to me that documents had to be signed over a year ago for the gallbladder settlement but no one has gotten their money as of yet. If I weren’t going to get the money I should have held out and taken my chances on more. Does anybody have an idea when this will be paid if ever?

This is the only place to get information from people that have actually experienced what we have experienced. August will make 5 years since I began my process ad still have no info on how much my medical liens may be. No correspondence whatsoever regarding this. This is my only hope for valid time frames!! I have sent emails to the lien resolution group and to 2 of my attorneys unanswered. Thanks to all that allow this open discussion and to those who participate and share.

    First of all I am a smoker and was put on yasmin at the age of 19 after my first born died at the age of 2 1/2 months. I was trying to prevent another pregnancy and instead ended up pregnant while taking yasmin and had complications the whole time and had to have surgery while pregnant. My son still had to be born early and not even 2 months after that emergency gallbladder surgery was needed. I am now 31 years old and have recieved nothing. I find out that I’m only to get $3000 minus my attorney fee of 40% and expenses …. this is getting rediculous as to how long I’ve waited and for so little. If smoking was such a risk factor then why did my Dr put me on it, stupid comments need to stay with the ignorant commentor

    Yaz, or Bayer, doesn’t even want to consider responsibility for my blood clot. Since my clot was arterial and caused a stroke in my brain. Some scientists get to decide my fate. I’m happy for all of you who are within Bayer’s guidelines, and may actually see a dime. I, on the other hand, suffered my stroke on May 31, 2008, and am still trying to get my lawyers to even attempt to get my case in. Seems like I’ll never get a settlement, because they don’t feel I have a case. I didn’t even get to choose my lawyer. Seems all of my choices have been taken along with my memory, ability to work, ability to spell, ability to have another child. It’s not fair and I’ll never get over this! Bayer already cost me my life, then it went a step further and made me have to have a medically necessary abortion. And now to find out I probably don’t even have a case according to my lawyers, I’m really at my wits end. 15 pills a day, and living with the horrible memories is what I get. Thanks Bayer.

    **finally** got a letter from my attorney saying they have heard back from claim administrator and that I’m qualified and approved for $3000 settlement (thought I already was), and now they are working to see if I have any medical liens. Happy to hear from them, but…frustrated because I thought I was already waiting on the medical part, not to get “approved”.
    Oh well, at least I heard something and one step closer.

    I found out about my settlement in January 2013 and still have not received my pay out. They’ve paid the liens and everything and the law firm says they are just waiting on Bayer to release the funds. Seriously?! I asked if there was a time frame and they said no, but hopefully soon. How long can Bayer hold onto that money? Like many of you I had a blood clot on my lung and almost died. This is ridiculous. Anyone know how long it typically takes to receive the funds?

    I often check this site for any updates on the gallbladder settlement. As I’ve finally got some news and believe that I see the light at the end of the tunnel, I’ve decided to share what I’ve learned recently. I was finally told last month, that I was approved for the $3000, but needed to fill out some PLRP paperwork to make sure there wasn’t any liens from Insurance. Today, I called the group that I had to send my PLRP paperwork and am being told that they have all my paperwork and that goes to an attorney that will approve my funds to be released to my defense attorney and that could take from 2-4 months. I can’t believe a settlement takes this long!! I hope that the ones that opted to pursue their legal cases and go to trial get the money due to them in their lifetime..

    I am glad to see I am not alone, I haven’t seen anyone else say they had what I had. I was on yaz for three months, gig pen to me free by my doctor, I was 44 and periods were irregular. Three months later I had horrible headaches, found out I had cavernous venous and jugular thrombosis. A bunch of clots in my brain, it caused me to lose the ability to speak and erased my memory. It took months but I did recover speech and most of my memory (that took four years). Thankfully tofay I am about 90% and am back to working. I filed in 2009 in az, my atty joined a group in California. I rarely hear anything on my case other then it is still being settled. Very frustrating.. I will be patient. Personally if I only get reimbursed the 25,000 I spent in out of pocket I would be happy!! Thanks for sharing your stories.

    Hi everyone, I too am still waiting to hear anything. I filed in 2011. I took yaz for three months then suffered a series of blood clots in my cavernous, venous, sinus and jugular areas. Lost the ability to speak, and lost my memory. Luckily I was able to regain all over a period of time. My attorney here in az joined with a firm, Robinson and associates in ca. Have not heard much for over a year. I am calling tomorrow to see what the heck is going on. I was so glad to find this site, it is nice to know I am not alone although my clots were in a different area.

    I called garretson lien solutions last week thinking they were actually processing my gallbladder removal check. They have had my file since june and treated me like i was being impatient. They couldn’t. Tell me if they have gotten to my case yet or not because they have only been rceiving updates once a month. I think anyonr whos waiting for them should call every single day. They have put is all off for way to long. I filef a lawsuit in 2009. I had gallstones them gallbladder removal then heart attack them a baby. They said since my dad had a heart attack at 62 and my mom has hypertension that they had tp drop the heart attack case. I hate yaz. O was. When yaz turned my life upside down. Now 3000 less fees is disgusting but making you wait for years for it is even more disgusting.

They also said they believe it will be before that so if I haven’t received something in the mail in those 30 days to contact them back. This seems promising because that means it is close!     I filed July 2013 – all my liens are paid – just got word Ill be getting my final payout in 40 days or less. I too had a blood clots in my brain and jugular – mine went fast as Tricare is not private insurance – I was told if you have private insurance it takes much longer.

    Just a ray of hope I received my settlement payment last year. It took six years to receive the final payment. Still waiting on the interest check and the person that helped me the most is not longer there. I am praying all who had been injured or worse receive their compensation. These drugs are a joke and we need to try and find alternatives to our pain, our birth control, or whatever other reason we had taken this drug. God Bless. Mary

    I posted in March of 2012, speaking of my near death experience. I wanted to let you know that I have received half of my settlement, finally. Haven’t been told when the rest will arrive. Still going through the waiting period with the company handling the liens etc. At least now I know the process is legit. I honestly was feeling like it was all a hoax. Hang in there, it will come.

    My wife died back in September 2009. The way she died, surrounded by doctors and specialists unable to do anything, I would not wish anybody to die. My former mother and father-in-law have lost their only child. They both currently fight cancer. It is not that I have not had any communication from my attorney, each year I get a call which basically sums it up – corporation is nowhere close to even looking into her case. My wife is dead, both of her parents are dying and I doubt any of those corporate sharks will ever come to a point of giving my family and I any form of satisfaction or closure.

    I initially filed in 2010 with a firm in IL, and I received word last week that they were waiting on the funding (I think from Garretson?), and that once that has happened, they would prepare the statements and mail out the checks. I received that word last week. I know I am getting the amount for actual gallbladder injury and removal, but I have since paid off all the medical bills, so I guess whatever this check is for, will be the settlement, minus their legal fees, but do they also take out $$ for Garretson? I just want this to be done and over. I have tried asking the law firm, but the person I ask doesn’t seem too keen on answering my questions… hey, four years off and on, I think I have the right to ask what is going on, since I seemed to have signed my life, first born and probably soul over while doing all of this, so I think I’m allowed to ask what’s going on, especially if you say I’m finally getting a settlement. Anyway, I am told that it’ll be happening in the next few weeks, so maybe before December? I do have a question: for anyone who did do the gallbladder thing, and maybe went through Garretson, did you receive one check or multiples (installments)?

    I took yasmin back in 2002 and had gallbladder surgery in December 2003. I filed my lawsuit at the very beginning and have still not been paid. I am beyond disgusted with the lack of responsibility and how long I’ve waited. I no longer can eat some of my favorite foods (thanks to the surgery) because it either makes me sick or my stomach won’t digest it anymore and I have to watch what I eat and how much acid is in food … it’s just not fair

    I was 19 , when I found out I had pulmanary embolisms in both of my lungs one the size of a golf ball in my left lung , two in my right lung . I had absolutely no symptoms of the blood clots before that day. That day however I experienced trouble breathing. I then went in to the emergency room and after examination I was admitted to the ICU . I was told of I had waited a day or two possibly hours they would exploded. I have never smoked . I was given heprin and later put on cumiden . I was taken off all birth control for a year , taken off blood thinners after 6 months . At 24 I became pregnant with my first child , I was not informed that doing so would be high risk . I had to put lovenox shots in my stomach once a day . This was terrifying but necessary . These would prevent blood clots from forming . Being pregnant made me 6x as likely to get a blood clot . Knowing that if I were to get a p.e or blood clot . My husband would have to choose which of us to save was a lot for us to take on . My baby was born healthy but we have discussed adoption instead of trying for a second child like we had originally planned. I also don’t understand why this product is still on the market . Has ruined so many lives.

    Finally after waiting 8 longs months, I got a response from my attorney thru a email…. I mean, this whole waiting game is getting old. She said that she doesn’t know when I will get my money. My name hasn’t dropped down to be paid. I don’t understand. I have waited long enough. Has anyone got there settlement from the gallbladder?

    Heather, I filed a case in 2010. I was approved for my settlement in July and was told in August that it would take 2-4 months to get my money as they had all the PLRP paperwork. As of today, I’ve yet to receive my money and it’s past the four months now. When I call Garrettson, they just check and say that I don’t have a check posted. My law firm has been like most and won’t return my emails or phone calls. The last time I talked to someone at my law firm was almost three weeks ago. At that point, I had been trying to reach them for 5 or 6 weeks. I was told by my law firm three weeks ago that they had no information, but if I would call back the following Wed., she would provide me with an update. I placed the call, but had to leave a message (not surprised) and have yet to hear from her or the firm. I thought that taking a settlement meant things wouldn’t be dragged out for more years, but guess I was wrong!! I’m so ready for my money and this to be over. I check this site often and doesn’t seem like anyone has got their gallbladder settlement check yet. I really hoping it will come at any time and will post when it does; however, I’m not holding my breath.

    Well, after 10years of bullshit,and a big wig kansas attorney, and word as of december 2014 i owe no insurance so im cleared to receive a settlement check…looks positive before christmas, same damn asshole just hung up on me qhen i asked to verify the release of funds to us by opposing party…..soo i dont think that anything they tell us is truth!!! I signed 3years ago and lost my gallbladder 10yeard ago on this case….either our attorneys are lying to us and holding our checks for interest n the banks or we need to make a move on bayet ourselves in numbers…there shud b a statuet of limitations feom the day we signed and frankly,im tired of lopsing notary fees…how about u guys?

    That doesn’t surprise me at all! I’m tired of playing the waiting gAme. I just think this whole thing is a joke. I still haven’t heard anything. I also filed back in 2010. A phone call or email would be nice. My attorney is in Texas. Where is urs? I sure hope to be getting a check soon.

    Heather, my attorney is in GA. It’s been over 2 1/2 months now and I’ve yet to hear back from them by email or phone. I called a few weeks ago and left another message for a status update or courtesy call back and that didn’t make any difference as I’m still waiting. I call Garrettson weekly to see if a payment has posted yet, but no luck so far. I’m hoping this will all be over soon. It has been about two years now since Bayer agreed to settle the gallbladder cases. Wonder if Tanya who was told in January that her check was being mailed by certified mail has received her money yet. Or has anyone else who agreed to the gallbladder settlement actually received the funds yet? I check this site weekly for updates, but have yet to find anyone who has actually received any money for a gallbladder settlement case. I hope it comes for all of us soon.

    Joined also in 2010. Called over and over to find out where is the check, only to just now be told they need me to fill a form out to verify my health insurance company that I paid for and covered my gallbladder removal. JUST ONLY NOW!!!!!!!!!!!!!!!!! Well I am P.O.’d about this… shoddy communications. THEY ALREADY KNOW EVERYTHING ABOUT WHO WHAT WHEN WHERE AND WHY IN MY TWO INCH FILE! Well I have been told that if Kaiser wants to take the money they can?!!!?!?!? What? I paid for that insurance and they do not have a right to my pain and suffering funds!!!!!!!!!!!!!! Its a meager $2250.00 and they want to screw me out of that too! FRICKEN CORPORATIONS!

    I received the final release from my attorney. They have advised that my settlement offer is $xxxk but the final release only says $1k, it says that $1,000 is the standard amount on every yaz settlement release….is that right?

    Jessica, it was suppose to be $2000 for those settling that didn’t have gallbladder removal and $3000 for those that did have gallbladder removal. However, there may be some attorney fees, etc. and that would probably vary for everyone I’m sure. I’m still waiting on information myself. Garrettson is not giving out any information any longer and referred me back to my attorney that still doesn’t know anything. My case opened in 2010 and I was told approx. in August that it would take 2 to 4 months to process my payment and I’m still waiting.

    I have some light at the end of the tunnel. I emailed my attorney asking for answers and this is what I got: ” The settlement administrator has notified us that your claim was sent to defense counsel this month for approval of payment. Typically, once that is done, we receive the settlement funds the following month. ” So hopefully I will see some money in March. I hope!

    Jim how dare you claim that most of these women were smokers that suffered by taking this birth control pill. My daughter was a college cheerleader and in pristine health and only on Yaz for 4 months before having a stroke. The hospital ran every test under the sun on her and concluded that it could have only been caused from Yaz. This drug should be off of the market period. I am quite sure that you do not have a daughter or wife or sister that has had to experience this or you would not be so bold as to blast these women.

    Why has this blog come to a complete hault? Also why is garettson lien resolution been let off the hook with yaz settlements. How many millions of dollars is everyone sitting around waiting and listening to lies and told call your lawyer. They are breaking rules that they stated to thej udge and investors would be followed. How much interest and fees do they need to make off of our misfortunate circumstances? When arethe lawyers going to help with the pitiful gallbladder settlement checks. Rip off report and other complaint sites along with the investors should be informed by every single woman who sitswaits and crs. When is somebody…anybody going to help us?

    Heather, I was told in Nov 2014 by Garettson that we were just waiting on my gallbladder settlement money to be released. It is now April 2015 and still no $$$$. Garettson will not give out any more updates and said all gallbladder claims are being advised to contact their attorney. Well, my attorney office will not respond to messages left on the phone nor return emails. I’m beyond frustrated and it looks like no one has received their gallbladder settlement money yet. What was the point in settling?

    I just got my email last nite saying that they wanted to verify that I still lived at the same address. There FINALLY mailing my check!!! I can not believe it! They didn’t say the amount tho…so that is my only concern. I will def get back on here after I receive it and let u know. I sure hope u hear back with your attorney soon!

    Today I received my check for the gallbladder removal. All I can say, is how I’m dissipointed in my amount. The attorney was the one that came out shining. I’m just glad this over with and I’m not playing the waiting game no longer. Good luck to everyone

    I had my incident in 2011 I was 29 I had bilateral pulmonary embolism, and an ischemic stroke in my right temporal lobe. I was on Yaz. Now I am on permanent blood thinners, its hard to walk, hard to speak, and I developed a severe mental illness. I’m on so many meds now. I was with an attorney office before who dropped my case they said I’d been taking Yaz too long. Now I have a new lawyer who says they have to work fast to get me in on time so I’m nervous that I won’t even be approved for a settlement.

    Barbara- that is true that your attorney will need to move quickly. Just make sure, on your end, that you get all the releases for records, information, etc back to them asap.

    I too had a similar experience I’m so sorry sweetheart.

    I had my stroke May 31, 2008. I filed my lawsuit in 2009. All I have gotten is the runaround, told I have no case, told I’m not covered due to my stroke being caused by an arterial clot, stacks upon stacks of papers that I’ve had to deal with, told my lawyers will get most of my measly amount anyway and been devastated to find out while I have to take “maintenance meds” for the rest of my life, I have to settle for whatever Bayer deems appropriate!!! How dare they, and the lawyers are a joke too! I’ve accused mine of working for Bayer! I’ve gathered all of my own info for these people yet I still have to pay them as if they did it! Going on 7 years and I haven’t been told I was getting anything anytime soon. All I know is these people have ALL ruined my life. I have even had to have a medically necessary abortion to save my life. How do you come back from that? What price can you possibly put on that? I’m never going to recover mentally, and only partially physically. I’m especially mad that all the others got $200,000! I won’t even see $10,000. Let me know if you can figure that one out.

    My spouse died after taking Ocella within 4 days. After almost 7 years, w hear the same story – you have no case. Basically, here is the deal. To prove that one suffered, from let’s say Ocella, they must do experiments on humans, which will not happen, as it is obviously unethical and unlawful. My wife died and maybe, maybe I will receive 20,000$ after all is said and done. They talk about some Tier2, which I doubt will ever happen. I even doubt Tier 1 will ever happen. I thought of writing a book, interviewing the victims and publishing their stories, but very few people want to share such personal struggle publically.

    My spouse died from the same problem as you have, in September of 2009. After flowery BS, law firm basically sent us paperwork, twice, stating that as per Tier 1, we may get (after all payouts) 20,000$, and there is a possibility of Tier 2 payout, too. As of May 2016, almost 7 years since she died…we saw 0 dollars, 0 apology, etc.

    We were told that Bayer set aside 60 millions to avoid having multiple trials, which would cost them more money even if all plantiffs loose their cases.

    I would be interested to get stories of the people who lived through this nightmare.

    I received my first portion back in August 2016. I have been on the wait list since 2009 for a case. The attorney fees was 45% plus other fee from the court which totaled out to be 54 %. This not fair nor it’s right that lawyers get close to half. Now I am waiting for the medical liens to release so that I can get my second portion. Hopefully I will get all 20k in full and no hold backs.
