ANSWER

The product liability lawyers at Saiontz & Kirk, P.A. pursue claims for individuals nationwide who suffered severe and painful injuries due to defective hernia repair mesh, and settlements have been reached in a number of prior litigations that our law firm was involved in.

At this time, we are pursuing hernia mesh settlements for problems caused by a new group of products, including the Atrium C-Qur Mesh, Ethicon Physiomesh and others. However, these cases remain in the early stages of litigation, and it will likely be several years before the manufacturers are willing to discuss settling cases.

Based on our investigation and evaluation so far, due to the unreasonably dangerous and defective design of the hernia mesh, settlements are likely to be paid for individuals who have required revision surgery due to:

  • Severe Pain
  • Adhesions or Perforations
  • Allergic Reactions or Infections
  • Recurrent Hernias
  • Other Complications

Since most individuals are unaware of the specific product implanted in their body, free consultations and claim evaluations are provided to help individuals determine if they may be eligible to pursue settlement of a hernia mesh case.

Factors Considered in Settling Hernia Mesh Injury Lawsuits

Throughout the handling of Atrium C-Qur mesh cases and Ethicon Physiomesh cases, our lawyers will prepare claims for eventual settlement negotiations. Although a large number of individuals are pursuing claims for similar injuries caused by these products, the cases will not be handled as a hernia mesh class action lawsuit, and any settlement will be based on the individual circumstances involved in the case.

Throughout the litigation process, additional information will be discovered about the design, manufacture and sale of the hernia mesh products, including internal company documents and other discovery. As the cases proceed through the court system, it will have a substantial impact on hernia mesh settlement negotiations that may ultimately occur with the manufacturers.

Any discussions about Atrium C-Qur settlement or Ethicon Physiomesh settlements will ultimately be based on the likelihood for success in each individual case, as well as an evaluation of what a jury is likely to award if that claim went to trial.

At trial, a jury would weigh several factors in determining the amount of any hernia mesh settlement, including:

  • The extent and duration of the hernia mesh complications, including the medical care or treatment required as a result of the injury.
  • The amount of any lost wages, medical expenses or other economic damages.
  • The effect that the injury from the hernia mesh had on the overall physical and mental health or well-being of the plaintiff.
  • The pain and mental anguish suffered in the past and which will likely be suffered in the future.
  • Any long-term injuries that may affect the plaintiff’s future health or enjoyment of life.

REVIEW YOUR HERNIA MESH CASE

Find Out If You May Qualify for a Settlement

As a growing number of lawsuits continue to be filed in courts nationwide, it will likely be several years before the first bellwether trials go before a jury.

As the first trial dates get closer, pressure will increase on the manufacturers to settle cases to avoid the potential for substantially higher awards in courts nationwide. Plaintiffs will also have an incentive to discuss settlement, to avoid the lengthy litigation process and inherent uncertainty associated with a jury trial.

Time still remains for individuals to join the litigation and pursue a hernia mesh case for themselves or a loved one. It is not necessary to know what type of hernia repair product was implanted, as our lawyers can help!

To review a claim for your self or a family member, contact Saiontz & Kirk, P.A. today.

I had to have Hernia Surgery back in 2006 the doctor split me from my breast plate below my belly button the hernia was high up nice size knot hurt every time I would eat something or drink to take any meds, then about a month later after the surgery he told me he used some type of mesh to cover up the hole, well now the hernia has come back just like that day I went back to complain to him about the pain plus unable to throw up I stay sick everyday now, he told me he could not do another hernia surgery that is would be to life threating for me, now my hernia is about the size of a peach hurts all the time, plus I ended up with all my stiches inside my belly came loose now I have a knot about the size of half of a football, right where a man or women has the six pack with the nice muscles not me, it’s called and Ills something of that nature; this hernia I wish the pain away and pray for it to go away, but it just keeps getting larger and hurts even more, gets where at times I’m unable to catch my breadth because of where the hernia is located at, May have no other choice but find someone that can repair this hernia without me dying from the surgery. I really wish I could find a real doctor that knows how to repair one of these types of hernia’s without me dying from the surgery. I should have woken up that day with 5 tiny holes, instead I woke up with a line if staples from my breast plate passed my belly button, then after I was awake enough he sent me home never stayed overnight in the hospital. the problem started about a month after the Hernia surgery was done, he told me the mesh was still in place by looking and feeling of the area I told him I didn’t believe that, because I knew how I felt. and today it’s about as big as a large Georgia Peach and not slowing down either, I’m afraid one day I’ll wake up and my guts will pop through that area, because that is what makes that hugh knot above your belly sits over your heart and in between your lungs too. does cause you to have chest pains too. I know I’ll have to go see my stomach doctor for him to see how much bigger this hernia has grew in the past 6 months. If I have to have the Hernia Repaired it won’t be done by the same doctor, I’ll have my stomach doctor locate one that I can be Reefer too , and have him or her check it out. I pray that if I do have to have the surgery again I pray I survive the surgery. Just pray they won’t use another defected piece of MESH to cover over the large area this hernia has made. Maybe the doctors are more advanced today than back then.

Hi, I had an umbellical hernia repair surgery in 2012. It wasn’t til about 2 yrs later I really started noticing problems. I started getting really sick around Xmas of 2014 into 2015. Also the surgery site started leaking bad green /yellow fluids. I did go to another surgeon who said I had a chronic infection from the mesh . He did his best to cut the mesh out a month later. I lost feeling down my right leg and have alot of pain an discomfort still. I can not surf anymore ,. (Favorite hobby +sport) with my right leg problems from removal surgery . Plus I have a hard time doing my job as an electrician. I am not exactly sure the type of mesh used. But it was the mesh that was a polyprophlene I believe. Not sure ?

Had a hernia repair, then 3 years of agony, pain and infection. They kept saying diverticulitis even though it didn’t show in ct scans. Said I had “low tolerance to pain”….. smh. Eventually had emergency surgery: colon resection showed ALL issues were due to the mesh being caught on my colon and destroying tissue.
I’d like to see ANY big pharma executive go through 3 years of fevers, puking, diarrhea, slowly dying of a painful infection in front of their own families – all while still agreeing that this plastic crap was OK to be installed in them. FDA approved it, so it must be OK… There are more than just a few of me out there. I want my life back.

You said it! I want my life back as well!!! I can’t believe I’ve lived through 3 hernia mesh revisions.all with severe complications. The struggle is real. Our families suffer with us. I just had my 2015 placement snap. I knew it immediately since my gut fell out. Few weeks later, bowel obstruction. Add Crohn’s disease to the mix and try to keep your sanity. Lost many friends to long standing infections. Most had non healing wounds with drainage and fistulas. If you don’t live it, you’d never believe the horrors.

PLEASE PLEASE find a laposcopic surgeon. I can’t imagine a professional that let their patients experience what you have.!!! If it wasn’t for the compatience of the surgeon, I would be done. The other surgeons had years of experience, but they only knew how-to open their patients. Yes! Laposcopic., If I was more informed of the procedure, I would have had one surgery instead of 6”’ Yes, Six. I am praying for each and everyone dealing with this fiasco of manufactures. They’re experimenting on PEOPLE in excuciating ‘Pain,’ Oh how I wish I was a surgeon, because I would have turned the manufacturers in.!!! They say, ” Money Is The Root of Evils.” Agreed. PLEASE Stop Putting Trust In Individuals We Have known for years. This my opinion, because I too have had several hernia surgeries, I will leave out the attitudes of the doctors and nurses who was supposed to take care of me. #HerniaPainAndScareTissueForLife.

I know that most the drs had no clue people need to understand this lawsuit has nothing to do with the drs that make huge much major decisions than a mesh that would hokd up hernia issues of course therr going for it. Anyways the mesh is a foreign piece abd that in no way would work on any human. I was a high schooler when I got this pyt in me and I don’t blame drs for doing their job its the makers of this shit that failed to let everyone know the extent of damages and underlying issues with this mesh product.

Hello, my name is Miron. I to had umbilical hernia surgery back in 2014. Everything went okay as far as the surgery, but I noticed a bulge about 10o’clock of my belly button. I’ve been to the ER a couple of times because of the issue. The pain was a 12 out of 10. The doctor had to massage the area to allow the Bulge to pop back out. Now it’s 2018, and I’m still fighting with the Bulge. After reading all these comments, I don’t know if I want to go through another surgery to repair. I have a lawsuit right now. But I don’t know if I should go have it repaired or just hold out to see what the lawsuit brings.

I have had hernia surgery in jan 2017 and it took some getting used to . My nuts were purple and have had complications using the bathroom. It hurts like hell and im told to have a revision surgery. So i went to doctors and they wanted to get a cat scan of the abdominal area. Had to drink this nasty ass shit and had the scan done. The results came in and i went back to doctors and they said everything is fine, however usually when they check for hernia is when you are standing position. I had told them that the pain was coming from the other side and thats what he said that if anything I might have a double hernia. When they did the surgery they took a cyst off of my vasteferen tube and said I probably couldnt have kids. Im involved in a lawsuit now with phillups and associates and they are telling me that I need to have a revision surgery. I really dont know if I should because of all the horror stories ive heard.

I had (2) hernia repairs back in 2000 or 2001. About a month ago I had to have an Ex-ray done and the Doctor who read the ex-ray asked me if I had been shot, due to the mesh piece that is now lodged in my hip. The reason for the ex-ray was because I have been having pains in my hip and tail bone area for quit some time. Hernia repairs were in my groin and naval.

July 2016 I had a hernia repair surgery in lower abdominal area. October 2016 the hernia made it through the mesh that was placed for repair. That brought on a myriad of complications. I was unwell constantly on antibiotics for infection, ungodly and excruciating pain, Not being able to do anything but lie around and be sick. Finally aftre numerous attempts to find a surgeon to help me God blessed me with the original surgeon.(whom by the way I value in my life and love him). Well May 23rd 2018 I finally had the surgery I had been praying for. I spent one month in the hospital, and in CCU unit was discharged to a local rehab hospital. I spent a month there. I was on a wound vac since May to September it is now the end of September and I’m on wet to dry dressing twice daily. Sick everyday, in pain that has me miserable. I already suffer from depression that’s worse than ever. I’m bedridden, can’t hardly eat, my teeth are falling out due to being nutritionally deficient. Until recently I was a vibrant, pretty woman looking 20 years Unger than my age, well, Not any more. I have worn the Elders of my church out for blessings of healing. Pray every night that Heavenly Father will find me worthy enough to call home so I can get the he’ll out of here. I’m so BATTLE WEARY.more so than my soldier son. I am miserable and alone and so lonely. And pain, excruciating, will follow me to the grave. My life is over ,in my eyes, I would like at least one day to feel good again and have a wee bit of a life. But, I will continue to be sick and fight the good fight and try to endure to the end. I hope by the end of the year things will be better.

Had abdominal mesh put in 2006 for hernia repair. Got red blister at old scar site December 2018 so i Went to surgeon. She sent me for scan and I was told mesh was infected and had to be removed. I went for surgery on January 7 2019. Surgery went for over 5 hours as the mesh had attached to bowel in multiple plays and had rooted into bowel at on point. Had to have a piece of bowel removed. The doctor put new mesh in but she said it is biological and will dissolve after about 1 1/2 years. I hope this will all go well only time will tell. This surgery was and is very painful as I had to be cut from under my breast down to my pubic area.

Well you see Brad tried to effect the bottom line for more profit my using cheap plastic on mesh screen so these companies CARE more about Profit line than the healthcare of human being.Maybe they need to look at CRIMINAL CHARGES against these companies for they knew ahead that the material was no good. NOW they have people going thru 2 or more correct surgeries putting their lives at stake everytime they go thru a surgery. THE SETTLEMENT should be GREAT because we the PLANTIFFS MAKE THIS CASE every man or woman who was put at risk should be HEAVY COMPENSATE,to teach these companies that every human being life should be treated HIGHLY,and not like a guinea pig for experiment. The pandemic delay the settlement they finally announce a settlemaster to the case.Hopefully this Mesh screen lawsuit came to a good end for the poor plantiffs who went through the PAIN going thru these surgeries.Lawyers in this lawsuit doing a good job. This particular lawsuit stsrted in 2018,and it been 4 years now and the plantiffs still waiting to be COMPENSATE,hopefully 2023 will be the year for a Good Settlement against BARD, the PAIN,PAIN,PAIN,they have cause.IT TIME to end this and research how to make these screen mesh better and hold these companies respondisible.I think the laws shouldd be change when dealing with a class action lawsuits against these medical companies, should be a statue of limitations put on these cases concerning human being healthcare and a settlement of these cases should be decided in at least 3 years because these medical companies must learn the people healh come FIRST,and PROFIT come SECOND,abd the only way to teach these companies a lesson is by putting a GREAT GREAT SETTLEMENT AMOUNT OF MONEY,they will understand MONEY.

Lawyers why the Feb. court date cancel, did the plantiffs lawyers was against this and if so why we plantiffs are not inform of this decision we the plantiffs are the GUINEA PIGS for everybody concerning who looking for their CASH COW return .Do extension mean more money for the lawyers i guess so nothing free, so was that a determing reason to not to complain about not to cancel the Feb court date in this America we live in today your title position cannot be trusted because we the people are the ones in pain, or was the cancel do to some close agreement to a settlement hey man us GUINEA PIGS deserve to know tell us something besides the same old lines asking for more clients i understand that but understand us whst we going thru .You going to get paid before we see anything they will put us in TIER GROUPS in order to save so money that should be a large settlement for the plantiffs because of all the revision surgeries i bet that the hang up on settlement do to so many plantiffs had revision surgeries and pain and complications afterward.Yes i like lawyers but COME ON MAN put your FOOT DOWN these guys playing you the judge while nothing good to say so i say nothing. The pandemic was a Blessing for this Hernia lawsuit a good excuse to delay the case, but cases like the major case in Minnesota went on during the pandemic. While whatever the settlement be it want hurt the company or during all these years in court these millions dollars companies could had put millions away to draw interest to pay off whatever the settlement will be, the settlement will not hurt the company.Maybe on the day of the settlement maybe they will have PR person to represent the company and tell us the plantiffs that they are sorry for the pain that they cause so many people Worldwide.I want hold my breathe for it but the Lawyers DO YOUR JOB they USE US AS GUINEA PIGS AND THE ONLY WAY THESE PHARMACEUTICAL COMPANIES CAN LEARN THEIR LESSON IS BY A VERY LARGE SETTLEMENT TO THE PLANTIFFS .THIS SHOULD NEVER HAPPEN AGAIN TO A HUMAN BEING WHO SEEKING HEALTHCARE TO BE USE FOR THE SAKE FOR BOTTOM LINE PROFIT IN OTHER WORDS MONEY IN AMERICA ITS A DAM SHAME THIS HAPPEN TO INNOCENT PEOPLE.THEY MADE THEIR PROFITS NOW ITS SETTLEMENT TIME FOR THE PEOPLE WE ARE HUMAN BEING NOT GUINEA PIGS putting parts in people that are not safe. This is 2023 HERNIA COMPANY PUT MORE MONEY IN YOUR RESEARCH DEPARTNENT and come up with a solution to this MEDICAL PROBLEM.
