Ortho-McNeil Pharmaceutical (a subsidiary of Johnson & Johnson) failed to warn physicians and consumers of the increased risk of developing blood clots, pulmonary embolism, stroke, heart attack and/or deep vein thrombosis.
ORTHO EVRA SIDE EFFECTS AND WARNINGS
Ortho Evra side effects are caused by the delivery of estrogen and progestin through a patch placed on the skin. This method of delivery has different results than metabolizing the hormones orally with birth control pills. The manufacturer was aware of the dangers posed by the patch when they introduced this product in 2002. They have failed to adequately warn that the patch carries an increased risk of potentially life threatening blood clots, which is three times higher then the risk associated with the use of traditional birth control pills.
The initial warning label indicated that the birth control patch carried similar risks to other hormonal contraceptives. However, this safety information was based on studies of birth control pills and was contrary to data collected during the clinical studies for the patch. In November 2005 the warning label was amended to indicate that the dose of estrogen was 60% more than delivered by birth control pills. In September 2006, further warnings were added indicating a potential increased risk of blood clots. However, many experts believe that the warnings remain inadequate and some have called for the product to be removed from the market.

ORTHO EVRA LAWSUITS
Ortho Evra lawsuits have been filed across the country on behalf of users who have suffered serious and life-threatening injuries. Despite knowledge that the birth control patch carries significant safety hazards, the manufacturer heavily marketed the Ortho Evra patch immediately after FDA approval and provided no warnings of these dangers.
Many believe that the manufacturer placed profits above consumer safety. Ortho Evra was introduced as the manufacturer, Ortho-McNeil Pharmaceutical, was about to lose the exclusive patent for their best selling birth control pill, Ortho Tri-Cyclen. The new birth control patch was a top priority for Ortho-McNeil, since they needed to offset the anticipated lost income from Ortho Tri-Cyclen.
