Polaris Industries, Inc. has issued an ATV recall for their 2006 Hawkeye model 2×4 and 4×4 all-terrain vehicles (ATV).  The front bearing carrier and steering posts could break, causing the driver to lose control of their vehicle.  Since ATVs are designed to be driven at high speeds on rough terrain, the consequences of the defect could lead to serious or potentially fatal injuries.  The product liability recall lawyers at Saiontz & Kirk, P.A. are investigating Polaris Hawkeye ATV lawsuits for individuals injured in an accident.

Polaris, a Medina, Minnesota company, issued the ATV recall on May 30, 2007, after receiving reports of at least 30 incidents where the front bearing carrier failed.  The ATV problems are caused by design defects, since the building material used to support the front bearing carrier is too thin.  This could result in failure where the lower A-frame and ball joint of the ATV meet.

ATVs, or all-terrain vehicles, are motorized vehicles designed for off-road use.  The Consumer Product Safety Commission (CPSC) reports that at least 6.2 million ATVs were in use as of 2003, and their popularity has consistently grown over the last decade.

All-terrain vehicles are fast and powerful, and in many cases they prove to be dangerous or deadly.  The CPSC has estimated that 740 people died in 2003 due to ATV accidents. This is accompanied by 136,100 emergency room visits linked to ATV use.  Since there is no age limitation placed on ATV drivers, about a third of all accidents happen to those under the age of 16.

According to statistics released by Polaris, there are approximately 9,400 Hawkeye 2×4 and 4×4 units which have been recalled.  These units were sold nationwide at Polaris dealers between August 2005 and April 2007, for between $3,900 and $4,700.  Only ATVs made before January 2006 are subject to recall.  Owners of a Polaris Hawkeye ATV should immediately stop using the vehicle and contact the nearest Polaris dealer to determine if their vehicle has been recalled.

    Since August of 07′ we purchaed two Hawkeye Polaris quads, brand new. During that time we have had two accidents, which we believe that may be due to a manufacures defect. I
