Denture Cream Class Action: Fixodent and Poligrip Lawsuits Consolidated in MDL

A panel of U.S. judges has agreed to centralize all federal denture cream lawsuits against the makers of Super Poligrip and Fixodent in a Multidistrict Litigation (MDL). Although the cases will all be consolidated and handled in a manner similar to how a denture cream class action lawsuit would be handled during discovery, the lawsuits will still remain individual claims and if they do not settle or resolve during pretrial litigation, they will be returned back to the original courts where they were filed for trial.

The denture cream poisoning lawyers at Saiontz & Kirk, P.A. represent individuals throughout the country who are pursuing potential zinc poisoning lawsuits over injuries caused by use of Fixodent or Super Poligrip adhesives. As cases are filed in federal courts throughout the country, they will be transferred to the MDL, which was centralized in the U.S. District Court for the Southern District of Florida before U.S. District Judge Cecilia M. Altonaga.

According to the Transfer Order issued June 9, 2009:

On the basis of the papers filed and hearing session held, we find that these actions involve common questions of fact and centralization under Section 1407 in the Southern District of Florida will serve the convenience of the parties and witnesses and promote the just and efficient conduct of this litigation. These actions share questions of fact arising out of the allegation that the levels of zinc contained in certain brands of denture cream can cause copper deficiency and neurological injuries. Centralization under Section 1407 will eliminate duplicative discovery; prevent inconsistent pretrial rulings; and conserve the resources of the parties, their counsel and the judiciary.

While the cases are only consolidated and coordinated for pretrial litigation, most people equate an MDL with being a class action for the denture cream lawsuits. However, the cases will remain individual claims and will be judged independently.

    I have been using Fixdent for 15 years, every since I got dentures. The symptoms you described are all present except paralysis.

    Poligrip makes me feel nauseous and dizzy. When I use the product, within a few hours most of the cream has dissolved and apparently goes into the digestive tract.

    Since August of last year I have been seeing different doctors about the extreme pain in my ankles and they have had me do all kinds of tests and to this day, they have not found anything to be the problem. I can barely do my job, for the pain I have in my ankles. I have pain meds, but I can’t take them and do my duties at work.

    Since August of last year I have been to several doctors about the extreme pain in both my ankles, been though all kinds of tests and they cannot pin point the problem. It is so bad I can barely do my duties at work. I have difficulty walking and also numbness. I have been given pain medication but I can’t take them and work.
    I do use fixdent for my dentures after I had them out a few years ago, and don’t know if this has anything to do with using this product or not.

    fixodent and poligrip the both I have been using and yes I have seen the doctor about unexplained and weakness also numbness and I still have the same complaints since december 2008

    my wife uses super polyigrip and gets dizzy and loss of taste started the the last 3 weeks

    I have been using fixodent every since I got my denture around June 2001. Over the years I have swallowed more than my share of this cream. The synptoms that are describe fits me and are present except for paralysis. As this article suggested, I am going to request a blood test for zinc and copper levels with my doctor one day this week.

    I have been dentures for approx. 30 years and after reading the problems, I am wondering if some of my pain, numbness could be from the use of fixodent. Just recently I have begun to use the adhesives more often.

    Oh my gosh! I have hd lots of pain (bad) in my fingers and arms, total extreme pain in my joints like severe arthritis but the arthritis medication doesn’t touch it. My ankles are weak and sore and it hurts very bad to walk sometimes after I have been sitting either for a long time or a short time. I am definetely getting a blood test.

    My mom has been using poligrip since 1990, she stopped walking, was put through every test possible, shes been diganosed with cancer, copper defiency, etc (the cancer came back to be a misdiagnoses) shes been through the works and currently still isnt walking due to the neuropathy! She called a lawyer and they are still getting her case together but they do have a case. Shes been through so much over the past years due to this cooper and neuropathy its crazy, we actually planned her funeral a few years back. This mess is serious I urge anyone who takes it to STOP now and find something else

    I have used fixodent for about 20 yrs and I have some of the symptoms described above the numbness and tingling in my arms feet hands as well as some pain and occasional loss of balance. What do I need to do?

    how do i get involved with the class action suit. been using fixdent for 10 years and often experience dizzinezz and tingle in legs. will be requesting a physical to determine level of cooper in my body. hae alwsy had problems with balancing.

    i got my teeth pulled last year and i been using fixdent and it makes me so sick my arm get to feeling numb and my legs hurt so bad it buts blisters on my gums and gets to hurting so bad i cant eat becouse i can not chue

    I have used fixdent for a fewyears after I hacd all my teeth removed. Im no longer able to work due to Pain that not one doctor has determined why the pain.I have numbness,loss of sensation,tingling and pain in hands,legs and feet.Muscle weakness,diffcuilty walking and struggle to get out of bed or chair,and this unexplained pain. Last week was told I have neuropathy. This has changed my entire life as I am very limited what I can do and Im very young but feel very old.

    i have all of the same problem numbness,pain in arms ,legs, back and nerves damage ,tingling,diffcuilty walking.getting out of bed,sitting and standing. leg locks up on me and loss of balance sometimes

    I have been using Fixodent for nearly 10 years and never knew that the numbness in my left hand and the sharp pain in my shoulder was due to using it.

    I been using polygrip and fixodent since May 2007. I had my bottom teeth pulled out the Friday before Mothers Day by Memorial Day I started to see something weird in my eyes, I seen a haze when I was looking around me. I went to see a eye doctor he told me I had uvitis I thought he was joking with me because I never heard of this in my life. It is caused by a autoimmune problem. I had a complete blood work for this condition and everything seem to come our normal. I never had this before. I also have arthritis and numbness in my fingertips time to time.I do get pain in my ankles and legs. and also weakness. I still see the eye doctor because my eye condition comes and goes. I need to put predisone drops when this happens which I do not like to do.

    November 2011: I am going next week to a lab to be tested for zinc and copper levels. I have been using fixodent since 1998. I have tingling and burning in my feet. my hands tingle most of the time. I have gotten so clumsy that I fall down sometimes. my balance is terrible. I,ve run into walls and fallen when i tried to get into bed

    I found out what is wrong with me after all these years and surgery’s, colonoscopy’s, meds and more meds, something finally makes sense. I’ve used Fixodent (Free) for a very, very long time right up until last night (03/16/2024 as a matter of fact. I had been looking for it in CVS and they weren’t stocking it for a long time. So, I went to Walmart and they had it but my insurance won’t pay for over the counter medical items unless there purchased at CVS. I went to CVS last night and I asked them to order it for me because it is the best adhesive (Fixodent Free) so the manager went to order it and he found out that it was discontinued I was very upset because I could not figure out why. So, I went home and looked it up on the internet and sure enough there it was all of the symptoms was listed and I had just had a bone density test and it came back that I had osteoporosis also.
