Tylenol Class Action vs MDL (Multi-District Litigation)

In April 2013, the U.S. Judicial Panel on Multidistrict Litigation decided to centralize all federal Tylenol lawsuits before one judge for coordinated pretrial proceedings as part of an MDL, or multidistrict litigation.

All cases filed in U.S. District Courts throughout the country will be consolidated during the discovery phase and for a small group of “bellwether” trials, which are designed to allow the parties to gauge how juries are likely to respond to certain evidence and promote a possible Tylenol settlement agreement.

The MDL process is often confused for a class action, as it offers many of the advantages typically associated with a Tylenol class action, allowing a large number of individuals to pursue similar claims against a common defendant through a process that increases efficiency and lowers the cost of litigating their case. However, unlike a class action, each Tylenol claim will remain an individual lawsuit that is pursued based on the damages suffered by the individual plaintiff.

Since the impact of Tylenol liver damage will be different for every individual, it is not possible for a large number of claims to be litigated through one class representative.

Following the consolidated proceedings, if Johnson & Johnson does not agree to settle Tylenol lawsuits over their failure to adequately warn about the risk of liver damage, each claim may be remanded back to the court where it was originally filed for a separate trial date.

    I was just prescribed So
    Malicious on 2/13/19 at 90. @10 mg by mouth once a day. If this is a lawsuit drug or recalled, why would my doctor still be prescribing it? Please help as I am confused. Thank you

    I take pain medication that is mixed with Tylenol because of stomach issues.Its 325mg 4-5 times daily for years.I have non alcoholic fatty liver.Would Tylenol factor into that also?
