Nursing home neglect and abuse occur with surprising frequency at some facilities.  In many cases, these injuries could be prevented if the owners and administrators provide proper staffing, training and support for the employees who are entrusted with caring for the elderly residents.    Although nursing home lawsuits are often filed by those who suffer an injury, it is rare to see criminal nursing home investigations.

Local prosecutors in Kenton County, Kentucky announced this week that they are conducting a nursing home investigation to explore the possibility of criminal charges after at least five residents have died and many more are suspected to have suffered from abuse and neglect.  The investigation involves a Northern Kentucky nursing home, Villaspring of Erlanger Health Care.

At a press conference Thursday, the County Attorney pointed out that nursing home neglect is just like child abuse, since elderly are dependent on the nursing home and unable to care for themselves.  When a facility does not provide proper care and follow through in doing what they are supposed to do, the prosecutors  indicated that it is a criminal activity.  Since the investigation was reported by local media, the County Attorney has received at least 50 additional complaints from residents and family members.

This nursing home investigation is focused on the administrators and the owners.  Understaffing and inadequate training have been identified as the primary problems leading to the nursing home deaths and injuries. 

Unfortunately, most local governments do not believe that criminal prosecution is necessary to protect our parents, grandparents and loved ones.  However, the fear of possible jail time for nursing home administrators may cause them to think twice before they cut corners at the expense of their residents’ health.
