On October 30, 2006, a Maryland toxic mold lawsuit filed in St. Mary’s County resulted in a verdict of $270,000.  The claim was filed against a landlord by individuals who were injured by mold in the home they rented.

The toxic mold lawsuit was filed because the landlords failed to fulfill their obligation to respond to the renters’ requests for repairs and failed to maintain the property in a reasonably safe condition.  The law suit, which was filed by Maryland lawyer Scott Nevin, indicates that the renters told the landlord of a water problem which developed in the rental home, but adequate repairs were never completed.  They claimed that the water problem led to mold, fungus and other toxic substances in the home.  Serious personal injuries were caused by the exposure, requiring hospitalization on multiple occasions and significant out of pocket expenses.

    Hi,I family have been renting a townhouse in Mt.Airy MD for 7 years. We have had a serious water problem in one of the bathrooms. The lalndlord was aware of a issue when we moved in. She just keeps having us fix it. We even had to paint over the water stains. And do all the patch work on the ceiing. I have Emphasyma and RA. The landlord knows about my condition. Now one of my daughters has a dry cough. I am looking for a little guidance at this point! My husband fears that she will make us move or we wont find housing by June when our lease is up.

    We rented a townhome also and our landlord did not repair a plumbing nightmare and it caused major leakage throughout our home on three floors. We are very ill now, become permanently disabled and it has shortened and compromised our life span. Before this mold, we were healthy and active. Now we are in motorized wheelchairs, suffering from so many problems due to the awful living condition of mold that we endured for months. We had children also who suffer from the aftermath.     We moved out of the townhouse on 07-2009. Landlord did give our deposit back with interest after arguing with her about the %. We gave her a letter stating we were moving due to living conditions and all we did as tenants to repair and maintain her home. Now she is selling the house for 199,000! Who ever purchases this townhome is going to become very ill! The mold is horrible!

    Hello, My fiance, myself and our 4 children moved into a townhouse in St Mary’s County, on October 1st 2009 and did not know the roof was leaking until living there less then a week. We immediately called the landlord and this is what he did/said (this will really get you) he took MY car washing bucket in the attic and placed it under the water leak (once it fills up there is water everywhere again) I told him I could fix the roof and he could just deduct it from rent, he said; no he would have a roofing company come and do it. We have since had very bad rain and snow. It is now January 12, 2010 and there is BLACK MOLD in the attic all my children are sick with runny nose’s, coughing, and vomiting. I do not know who to contact? don’t know what to do and this problem was in the attic before we moved in and he was very much aware of it. can you please advise as to what we should do or whom to contact to inspect. Children’s ages are: 8, 3, and twins 23 months old.

    @Ray : what if the landlord says that the problem was fixed, then later you have medical issues, and then finally you find out that they only painted over the problem.. is that the tenant’s fault? Your comment makes me believe that you don’t fully understand the issues at hand.

    i am going through the samething with my renters except my son has asthma and is in the intensive care unit, on breathing machine and had a tube down his throat(he is 12) my renters falled SEVERAL times to fix the mold problem(which came from leaky air condition unit in closet) and as a result my son is going on his 2nd week in the hospital.

    i live in a half a dupliex which i own, the other half is a rental which
    no one has ever kept up on the maintence of it for years now. well
    there is mold all over the ceiling of the backporch and now we noticed
    that there is mold on the side of the front door entrance. i called the
    city they came and looked at it but i know they give them so long to fix the problem and then fine them. but in the meantime i am afraid that the mold will spread into and onto my house. what can you do in those cases.

    It is possible to have fungus in your house and not see it. It can destroy your home from the inside out and make you sick because you are breathing the spores unknowingly.My landlord refuses to have my apt. tested and treat it because she says she can’t see the fungus. Meanwhile, my and my daughter’s heath are deteriorating and we are having to live in hotels.My personal poessessions are derteriorating and we can see spores everywhere–they are inside our bodies as well. The landlord says the spores are just dirt. We have a doctor’s note with diagnosis of hyphae fungus.

    I live in maryland balti county in a apartment and the empty storage room below me flooded many times the windows are full of mold thats all I can see I know theres alot of it in there in the walls it looks like black mold its black I always feel tired n sick I cough alot so does my kid and girl so its not just me I called the office about this but they never responded what can I do can I call a layer I haven’t went to doctors because I cant aford the bill rate now

    I moved in a rental in Maryland with my girlfriend in 2007 and a few months later there was a water leak in the bathroom under the Tub and the ceiling started bowing that’s when we let our landlord know and come and see it and it has been brought to his attention several times and was never attended to.Now I had to put a screen mesh over the spot where the leak is to keep the ceiling from falling in.It is now filled up with black mold.We are very poor and my girlfriend is the only one who works.I am trying to collect disability because a year or so after I moved in with her I became Ill with many health problems depression, chronic fatigue syndrom, skin issues.chronic sinus problems.I’m going to the doctor on a regular basis because of my illnesses.We are afraid of being kicked out if we continue to make a big deal over this.We would have moved out but as I said before we have virtually no money and the rent here where we are at is barely affordable compared to other rentals in our area.We / I would like to know what are our rights we / I have as far as a lawsuit is concerned now because it has gone past the point of just repairing.We really don’t want to live there anymore but things for us are so bad we can’t afford to move.

    My landlord says “it’s probably harmless” but I’ve lived here 2yr and mold keeps reappearing on the walls of my my apartment in east Baltimore. The basement leaks every time it rains. He replaced the molded drywall but didn’t find the leak instead he covered it with paint when I reported it to the city for inspection. I have had health problems such as bronchitis, coughing up blood, abscesses, stomach aches, fatigue and joint pain. The smell hits me when I enter the residence and I’ve even had to discard lots of clothing due to mold damage which I have pictures of and I showed him the damage. I am prevented from having a professional mold inspection because companies won’t do it without the property owners permission and the city won’t move forward on the issue if there is no appearance of anything harmful. But as I stated he comes through with a small can of spray paint and covers it up.

    I own a townhouse condomimium in Baltimore county the condos association is responsible for the roof repairs. During the storm and several rains the roof started leaking causing damage. I am seeing mold on the ceiling. I have developed asthma, joint pain,headaches,sore throat,chest pain

    We (my family of four) have been living in a rental home for almost ten years. We have complain to the landlord for many years about the mold problem. All he ever told us was to clean the walls with bleach and water. He also told us to make sure nothing was against the walls in-house or outside. The black mold was throughout the house. Three bed rooms and the bathroom. The entire family has been getting ill for many years. Headaches, sinus infections and two years ago my husband had heart failure. The mold was growing on the walls behind the headboards in each bedroom. We know nothing of all of the side effects of black mold until we was moving and a friend of ours that works for the county. he informs us that we should not even be in the room while we was moving because the black mold is poison for humans. He also advised us to get rid of our bedroom sets because they had mold on them. We took pictures of all of the walls.

    hello i live in an section 8 rented apartment, we have had multiple water problems and problems with the piping and plumbing for a very long time maybe a yr and 1/2, recently about 4 months ago i started smelling a weird smell we alerted landlords and they discovered it was mold in the house but did not do anything then, 4 months later which is now and the mold problem has significantly increased and so has the smell and just 2 days ago workers came and made me move all of my big bedroom items out the way and ripped a hole in my bedroom floor, placed some kind of machine that isnt helping threw some cheap plastic over my clothes and funiture and i havent been able to sleep in my room, or get dressed with clean clothes because now everything inside of the room is wreaks of this horrible odor I just want to know is it anything I can do about this.

    I work in a dental office that is an old house. The black mold is so bad when it rains there is a foul smell that stays for days. The floor has fallen and wood is rotting. The floor gives when walking on it. The dr. Refuses to pay to fix the problem and staff has complained of headaches and runny noses. How can a Dr. Not care about that?

    In Dec 2013, my fam and I rented a property w/a smaller connecting and separate unit for my adult son and his fiance. We have expericed a multiple of problems, mice, high energy bills, water heater and HVAC unit burn out. At first, the owner was responsive to the issues and replaced the HVAC unit and hot water heater. Then my son began having problems, leaky faucet and discovery of black mold behind toilet, in carpet near frig and leaky AC unit in window. When reported to LL, she became hostile and bully aggresive. We are not afraid of her. I contacted ServPro and the County who did inspections. She tried to blame the presence of mold on my son. She demanded that i clean it because mold was normal wear and maintenance. I flatly refused. Since April, i was hospitalized for pnemonia and now have a persistent cough and upper respiratory issues. MD Landlord Tenant laws are clear on environmemtal health hazards. I went to Loews and purchased a Mold Test Kit for $10. I will send to the Prolab for results, i will consult in a free session w/an attorney who is an expert in this matter. Landlord is trying to use scare tactics to intimidate me and my family. However, the law is the deciding factor and that’s all that matters. So I say bring it on slumlord!! Don’t put up w/a LL who falls short of providing a safe environment…they are wrong, learn your rights and if your income is low, seek out free legal counsel for renters who are on low fixed income.     my mother and I have been living in my apt for almost two years.     i’m having quite a time with my rental I have only been there a month and I feel as though I have rented a used car that was put together with duct tape. First the flooring started to crack when I stepped on it and put pressure down. Then the doors were swollen and difficult to open and shut which is an indication of too much moisture. The dryer was not properly ventilated and causes smoke detectors to go off. Really I could go on and on and on.I contacted my landlord via text message. He has refused to engage in any other conversation method. I have no email address for him. I do have a mailing address for him he lives all the way in Texas. I suppose my next step will be to send him a certified letter. I have notified him several times of the necessary repairs and I offered to fix them myself if he wanted to take the expenses out of my rent. he refused to acknowledge my thing and only asked if the sub pump in the back room was plugged in. After I told him yes, he told me he found it surprising that I would find so many things wrong with the rental after I had already moved in. Then said he could rent the apartment anytime of the day and if I didn’t like it I could leave. However, this is again all via text message.
    contacted the local health inspector and this will be out to the place within 10 days. My concern is not only for my health, but the health of my pets. Ihave a dog with an autoimmune disease. I feel like it is written having him in the building until things are confirmed one way or another. I have no clue what to do I have had a friend who works in the field of law to help me come up with a document for this man to sign regarding the termination of my lease. Still I cannot stay in the apartment now that I have seen this mold. It’s almost time to pay rent and I can’t see paying this man all that money when he has been disrespectful and negligent of his professional obligations.

    Hi my name is Charles, I live with my girlfriend that has been staying in the apartment that we are in at this present time that has multiple HCVs the worst of all is BLACK MOLD. She has been living here for almost eight years now and has complained about it as well as the other HCVs and nothing has been done yet.     I moved into a home 2 years ago and since we moved in my 2 yr old son has had sickness after sickness, I have had depression, migraines, breathing problems and everyone has had some of the same issues. THe house has had severe water problems and before we moved in it was vacant for 3 years and neighbors say the house flooded due to pipes bursting and the owners did nothing about it till the county forced them to. We have had pipes burst, toilets leak, ceilings leak etc. and he sends the same guy out that is a familiy friend owing him money and the guy patches it up and moves on. A pipe burst in the basement recently and it took him 3 almost 4 weeks to fix it. He said put a bucket under it. The bathroom leaks and there is mold around the toilet and tub and he sent the same guy out to say it was a little harmless mildew and he woudl replace the drywall. Well he never came back and it looks like mold to me and everyone else i show the house has a musty smell and i am starting to believe it is mold but he refuses to have a professional look at it

    I moved into an apartment building in 2013. Ever since I have lived here I have been living with mold and a heavy infestation of pests. I have contacted every management office that has taken over this building. Since living here it has went through three management companies and two owners. I have paid my rent faithfully regardless of what I have had to live with. My doors, walls and ceiling are infested with mold. The ceiling is coming apart. While they are steadily renovating the other apartments (due to damage caused by previous residents) I asked about moving into another unit when they are done. I was told that they have been heavily renovated, and I would not be able to afford the rent. Hello?? I have lived here for almost two years, and they will ‘talk’ about fixing the mold in my apartment. The mold is only half of the problem. It is NOT okay to live with mold and pest infestation. It is NOT okay to have someone tell you that you have to remain living here, because they are going to raise the rent on the other units.It is NOT okay for them to treat me like trash. I have went above and beyond for this apartment. Yet, no one in Washington County, MD will help me. You might suggest for me to move, but with me paying $700 in rent I have no means to move.

    Hello
    I have been telling my landlord about the rodent problem in my apt in Baltimore City, she has yet to professionally address the issue. When I moved into the unit she was aware of the mice because she informed me after I signed the lease.

    There is mice feces and urine on my couch, bed and everywhere else the mice deside to go. I have asthma and allergies and I have been dizzy often and itching more than my allergies have ever made me itch.

    My question is what can I do every time I talk to the Landlord she says things like “Well your lease is month to month if your not happy you can leave please help if you can.

    I have been renting an apartment now for 2 1/2 years. Over time I have become very ill. I been diagnosed with bronchitis asthma and now on a nebulizer machine every 6 hours.Since been diagnosed my condition is not getting any better even with medication. About a month ago I found mold in my apartment and reported the findings to the landlord. They came out to inspect the mold and I was told they will be back but never returned. I followed up on calling them back and still no one has come to remove the mold. Since then I have paid for someone to come out to test the air quality in my home (still awaiting the results). I also reported the problem to the health department. They came out to inspect my home and said in was unsanitary and ordered for them to clean it up. No one has yet to come out to remove the mold.

    Mean while I still struggle to breath inside my home, my children often complains about headaches. I have scheduled an appointment to get my children examined to make sure their health is not affected as well.

    Are you serious! You think its that simple! You need thousands of dollars to move your family to another home. My husband has worked for the last 17 yrs and due to cut backs his overtime was taken away! I also work 2 jobs. We have 3 kids. Both work for living and dnt have any help like most do in our area! A lot of people work from check to check. We pay 1450.00 + utl.. We shouldnt have to worry about our health and simply coming home to toxic hidden mold that took forever to figure out why my family and dog has been getting so sick and bodies weak. Its a silent killer. It has been an emotionally, physically and mentally roller coaster on our health. So you ignorant prick before you WRITE try to THINK. Close your eyes and imagine if this was your mother, father,child or dog or even yourself going through health issues day after day and stuck in a situation that is extremely hard to get out. We have told our landlord about our concerns and the asshole cover of what I saw with paint. Its in the walls and the attick. Floors ripped and left open for my family to breathe in. Shame on your heart less soul. People are on here reaching out for help. Comments like yours just added to how selfish and heartless like the kind of person my landlord is! Ugh.. Dont you think if it was easy and possible to move HELLO We would’ve by now. If anything im glad I just vented out my anger on you!

    My husband and I came out to look at a home for rent in November of this year. We met tge landlord at tge home, walked through went into the basement where in a back corner of the basement, there was no light, we were told that corner housed the sump pump. We liked the house, filled out an application and was offered to rent. Once we paid the security, we met with the landlord to do another walk through having already Givin up our previous rental, the light was all lit up even in that corner, we noticed a huge humidifier and mold all along the wall. We brought it to her attention and she responded as if she had no idea, I told my husband that there was no way she didn’t no that mold was there, we had no choice but to move in, having no where else to go and along with her saying that she would take care of it. It hasn’t been taking care of yet, I have been experiencing a very dry cough, burning in my chest, headache and nausea, I also already suffer from Urticaria (Chronic Hives), my 12 yr old son haf a dry hacking cough, nose congestion and headache. I let my landlord know that I was very concerned about the mold because of this. The landlord has some company coming out to do mold remediation. I really don’t think that it’s safe for me and my family to stay in the home while this is being done.

    My daughter and I moved in a Condo in Prince George’s Maryland. Where I became terribly sick and for the life of me I could never find out after seeing doctor after doctor for several years. And one day I got very weak and went to our bathroom and by me being so weak. I sat down on my toilet to try to get myself together before trying to soak and my toilet broke apart. So I call my landlord to let her know our only toilet had broke into pieces. Andd she told me there wasn’t nothing she could do but she would call a repair and I would have to pay him. So he arrived and when he removed the toilet I noticed that the whole for was covered in Black tight mold. With me being sick and only trying to get my together as well as myself prepared for the for the next day. I didn’t even think about the black mold only to have the toilet installed and continue on with our lives.

    I have black toxic mold everywhere in my apt. also was pained with lead paint when built in early 70s. Very visible. Lots of photos of black and green colors mold in air-conditioning vents. In the rug, on the bed, outside this apt. Complex even has black mold rotting black wood on roofs. I showed the pictures to my Dr. Even blood in my sputum. She diagnosed me with COPD, then sent me to a pulmanologist. he saw the pics. Listen to me breath. He said I also have asbestos poisoning. And now has to do a pumanary function test. Since I live in a sec.8 home the management was told by the Pinellas housing authority to clean it. they egnored it. That was in Nov.2nd. since they haven’t fixed it, the PHA, hasn’t played there share of the rent, I’ve been paying my share, and got an eviction notice I have to move, but this happens every year, since 2010. They saw the drs letter, handed it back and just said, you have to move by July, were not taking sec.8 anymore. I can’t find an available apt. I also suffer from multiple sclerosis. I have to get out of here. I tried to find a motel, and have 2cats. Nothing available. Can u help me get out if here I’m during..

    In 2011, I was living in a basement apartment, my throat closed, I have life threatening asthma, I needed an apartment , note from doctor got me in emergency. housing, I had 7days to take it or be off all lists for section 8, etc. I am and was disabled at that time, I now have custody of grandchildren, also bad asthmatics, they got me out of one BDRM. To take a basement apt. I refreshed their memory about having to get emergency housing in the first place, that’s all we have, OK I said, now there is black mold inside,from ice on inside of Windows, I told maintenance oh the whole apt. Building needs to be fixed , my doctor said move, wrote me a letter, kids and I have been so sick, I had to sign lease before I even saw apartment, back and knee problems put me on disability, housing said, take this apartment bathroom and bdrms.on second floor, housing said,take it or stay in mold,showed me apt.on 6/2716 must move by in by 7/1/16, was in basement apt. 2/2016,its now 6/3016, if I don’t take new apartment, I don’t think they will be happy, what can I do, it’s hard to move in 2 or 3 days,any ideas?

    My brother in law and I are business partners, our shop was under 4 to 5 ft of water in hurricain sandy. Shortly after storm our landlord had a crew come to fix problems, they made a bigger mess, molding not replaced, walls unfinished, sloppy carpenter work. I asked about mold when walls were taken down, they assured me they knew what they were doing . When I asked about the peel and stick vinyl floor I was told the landlord said no she wasn’t replacing it, we have asked every year since .All the adjoining shops were repaired, even the empty one next to us had tile removed and replaced by landlord before it was rented. For the past couple months starting with my brother in law, he’s been feeling off and sick,dizzy and stomach problems, now has vertigo , I am dizzy, eyes tearing,lost for words, disorientated and nauseous …now both employees are feeling sick, headache, sore throat, exhaustion, mental imbalance …normally I’d know what steps to take ….any input would be appreciated

    Hello …ok so striaght to point we were renting a house for ten years from a friends father verbal lease ..We were ignorant of the fact that we had mold poisoning most likely because we lived there for so long and just didnt realize things wernt right. Got so bad now have sores all over skin. Its painful . We made him aware and have since moved even though we continue to pay rent have pictures of water coming through walls 10 yrs he never set a foot inside no repairs on house built in early 1900s. It was cheap but He still should have checked the home yearly. We pay on 2 homes, 2 bge bills, 2 heating bills…. we thought he would fix it and we would move back in. Well now he’s trying to sell it asap! Like now. However, because if the issues noone can obtain a loan. Do we have a case? We have 3 kids, 10 year old daughter has her period reguraly with cramps so severe she pukes, 4 year old is Sooooo hyper and has serious behavior issues and our 1 year old just starting walking at 16 months old. Not normal.

    Please, if we have a case we need to know. My landlord knew of the issues even after we moved and continued to pay. He has an obligation to msintain the propertyn we have stubs to prove weve paid for 10 years every month.

    I lived in a basement/1 bedroom apartment in Brooklyn, NY for 5 years and 8 months.
    I had a boiler in my apartment which I used to smell the fumes. I didn’t know that the fumes are toxic.
    And also I had Floods, Mold and Moldy smell in my apartment. The smell used to stay for weeks!
    I didn’t know, the mold is toxic! I could have DIED in that apartment.
    Since it was singal family house and the landlord lived in the house, I used to Complain verbally, and they used to Complain that it will cost then lot of money to fix, “we’ll see”. And nevre did anything.
    The fifth year I started to get sick.
    For a year I didn’t know that the toxic mold and fumes are causing me to be sick!
    I left the apartment and didn’t do mold and air testing by specialist or my self. I didn’t know there is such a thing!

    I live in a rental in Dundalk md we found out around Christmas when I started smelling moldy mildew smell in my bedroom I had gotten pneumonia which lasted Alittle over 9 weeks I am always wheezing, coughing etc. my husband saw a hole in the roof a that is where the rain comes in there is also black mold up there right over my bed there is a crack in the ceiling and discoloration which I was told mold. I called Chesapeake mold and they came out and said yes it is black mold in the attic and mold in my room. I told my landlord numerous times and it is still the same no work has been done and I am yet again sick. What can I do

    Hello, my family moved into a rental house in March or 2013. That summer it rained severely, flooding our unusable basement. 3 weeks later we had mold growing in our kitchen. The owner only had the water pumped from the basement, no mold removing chemicals. I have suffering with severe Dermatitis with lesiono growing all over my body for 4 years now. Because we moved out we got no compensation. #SlumlordFioretti

    I moved into a condo in Annapolis in July 2017 upon the initial inspection the landlord pointed out an area in the floor where the tile had lifted and the padding had expanded. You guaranteed it would be repaired right away. Within 2 weeks I noticed that the padding was wet every time it would rain I reported this to her ASAP and advised there was a water leak. After me alerting her of the danger of the moisture and the potential health problems it can cause, she finally had a plumber come out and advise her that it was leaking from a rear door and the leak would need to be repaired. She instead contacted a handyman who can in and ripped the floor up in the area and was just instructed to replace the floor. There is obvious black mold in the opening and because this was a foreclosure that she just purchased I have no idea of the mold has grown up the walls because it has not been occupied. She is refusing to have the area tested for mold and said she will only respond it after I have an inspection mold is found.

    Hello..I’m a 51 year old renter on permanent disability with a compromised immune system who has been exposed to mold within my facility for @ least the past 4 or more months..Before I even discovered the mold ,I have been experiencing the symptoms of extreme fatigue,extreme respiratory issues with constant coughing & post nasal drips..Plus I have even experienced a vertigo like dizziness from time to time…
    Around the 20th of August ,I started noticing a sickening odor coming an area in the living room carpet so I purchased a shampooer to clean it only to the disappointment it didn’t solve the problem.. A few days later I then moved my sofa out only to discover my sofa pillow was literally stuck & sealed to the wall via heavy black mold & upon further investigation & opened the utility close where both the furnace & AC unit is located & suddenly discovered colonies(plural) of various colored molds growing within on the standing old stagnated water from an AC condensation leak…I’m renting an apt.unit in the basement therefore everyones AC unit from the other 2 floor above me leaks down to my unit..I immediately call in the rental office which was August 25th & the maintenance guys came in an examined it & then called it in as a maintenance emergency…While they were there,I literally heard 1 maintenance guy tell the other that the problem was caused via the company’s negligence to maintain a certain drainage pipe…..They eventually called in an independent mold removal expert which literally had to remove several sections of drywall from all around the AC closet & dry the stagnant in the carpet…He then left his dehumidifier & also an air filter in my apt.unit until around September 14th when he extracted both pieces of equipment…Nearly a week later they then send in a man to repair/ replace the removed drywall & tell me they will finish everything up including replacing the carpet on the 20th of September..Well its now the 22th & they have not shown back up to complete anything more as promised..
    Now pertaining to my health situation, I went to an emergency room on September 12th only to hear that they dont treat mold situations & then advised that I seek a specialist..
    What must I do from here on out?

    I moved in an apartment 2wks after the original move in date on 19 Aug 2019. The landlord did not tell me the apartment was flooded. Carpet was placed in the entire apartment and the baseboards were never changed out.
    In April or May 2020 I spotted mold on the ceiling of my bathroom and living room. The landlord was informed and they pained over it. In the summer of 2020 I reported the mold coming back and again they painted over it. I started experiencing headaches and dizziness. I was prescribed medication for headaches. In October of 2022 the headaches were getting worse. I asked the landlord to have a mold test done but they refused. I had one done myself and aspergillosis | penicilleum was found in the apartment and in my CPAP. I had been breathing through the CPAP from 2020 April until I got a new one and we were asked to move in April 2023.
    Since moving I have been prescribed Flovent Diskus and Albuterol. My breathing has been short from time to time. The landlord basically told me maintenance could clean the mold and not professionals. Are there any cases that are similar to mine? Please comment
