Frozen hamburger recall lawsuits pursued as manufacturer goes out of business

As food poisoning lawsuits are reviewed and filed throughout the United States as a result of a frozen hamburger recall issued late last week, the company which makes the ground beef patties announced Friday that they are closing their business.

On September 29, Topps Meat Company recalled 21.7 million pounds of ground beef, which was the second largest meat recall in U.S. history.  On Friday, the company announced that they will be closing their business as a result of the financial impact of the frozen hamburger recall. 

Production was halted at the company’s New Jersey meat processing plant on September 26, after an initially recall of 331,582 pounds of ground beef patties on September 25.  The company claims that they were the top manufacturer of frozen hamburgers in the United States, selling the patties to supermarkets, schools, hospitals, restaurants and hotels.

Reports from the CDC indicate that at least 30 people in eight states have suffered severe food poisoning as a result of the contaminated hamburger meat.  While most adults who suffer food poisoning as a result of e. coli are able to recover within a few weeks, those who are young, old or have weak immune systems could suffer more severe injuries.  At least one confirmed case of hemolytic-uremic syndrome, which is a severe form of kidney failure caused by e.coli, has been linked to the hamburger recall.

FROZEN HAMBURGER RECALL

All of the boxes of frozen hamburger have a ‘sell by date” or ‘best if used by’ date between September 25, 2007 and September 25, 2008.  They also have a a USDA establishment number “EST 9748” which could be printed on the back panel or in the USDA legend.

On behalf of individuals impacted by the Topp’s frozen hamburger recall, a class action lawsuit was filed in the United States District Court in New York by one law firm and several individual food poisoning lawsuits were filed by other attorneys.  The lawsuits name Topps Meat Company, as well as several stores who sold the contaminated meat, including Wal-mart, ShopRite, Pathmark and Rastelli Fine Foods.
