The U.S. Consumer Product Safety Commission announced a nationwide KYMCO ATV recall due to defects in some vehicles which could pose a risk of injury or death to the operator. Suspension failure problems could cause riders to lose control of their vehicle and crash. The lawyers at Saiontz & Kirk are reviewing potential KYMCO ATV recall lawsuits for individuals who have suffered a serious physical injury as a result of the defective all terrain vehicles.

The ATV recall applies to 2006 through 2008 model year KYMCO MXU 500 All Terrain Vehicles. Defective pivot bolts which hold the rear suspension onto the frame could become loose. As a result, the rear swing arm could detach from the chassis of the vehicle, resulting in an accident.

KYMCO MXU 500 ATV Recall

There have been reports of at least 6 ATV accidents caused by the defects. The US CPSC indicates that owners of these vehicle should immediately stop using the recalled ATVs. If no problems have been experienced, a free repair can be obtained from authorized KYMCO dealers. However, if any accidents have resulted from the use of the recalled KYMCO ATV, the vehicle should be preserved without modification until it is decided whether an ATV accident lawsuit will be pursued.

The recalled KYMCO MXU 500 ATVs were sold throughout the United States between November 2006 and December 2007. The vehicles are manufactured in Taiwan and sold by KYMCO USA of Spartanburg, South Carolina.
